<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad8454ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292"><num value="16292">§ 16292.</num><heading> Coal and related technologies program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8454bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">In addition to the programs authorized under subchapter IV, the Secretary shall conduct a program of technology research, development, demonstration, and commercial application for coal and power systems, including programs to facilitate production and generation of coal-based power through—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad8454bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/1"><num value="1">(1)</num><content> innovations for existing plants (including mercury removal);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8454bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/2"><num value="2">(2)</num><content> gasification systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8454be-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/3"><num value="3">(3)</num><content> advanced combustion systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8454bf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/4"><num value="4">(4)</num><content> turbines for synthesis gas derived from coal;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8454c0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/5"><num value="5">(5)</num><content> carbon capture and sequestration research and development;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad847ad1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/6"><num value="6">(6)</num><content> coal-derived chemicals and transportation fuels;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad847ad2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/7"><num value="7">(7)</num><content> liquid fuels derived from low rank coal water slurry;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad847ad3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/8"><num value="8">(8)</num><content> solid fuels and feedstocks;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad847ad4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/9"><num value="9">(9)</num><content> advanced coal-related research;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad847ad5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/10"><num value="10">(10)</num><content> advanced separation technologies; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad847ad6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/a/11"><num value="11">(11)</num><content> fuel cells for the operation of synthesis gas derived from coal.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad847ad7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b"><num value="b" class="bold">(b)</num><heading class="bold"> Cost and performance goals</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad847ad8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out programs authorized by this section, during each of calendar years 2008, 2010, 2012, and 2016, and during each fiscal year beginning after <date date="2021-09-30">September 30, 2021</date>, the Secretary shall identify cost and performance goals for coal-based technologies that would permit the continued cost-competitive use of coal for the production of electricity, chemical feedstocks, and transportation fuels.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad847ad9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Administration</heading><chapeau style="-uslm-lc:I12" class="indent1">In establishing the cost and performance goals, the Secretary shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad847ada-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/A"><num value="A">(A)</num><content> consider activities and studies undertaken as of <date date="2005-08-08">August 8, 2005</date>, by industry in cooperation with the Department in support of the identification of the goals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad847adb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/B"><num value="B">(B)</num><chapeau> consult with interested entities, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad847adc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/B/i"><num value="i">(i)</num><content> coal producers;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad847add-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/B/ii"><num value="ii">(ii)</num><content> industries using coal;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad847ade-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/B/iii"><num value="iii">(iii)</num><content> organizations that promote coal and advanced coal technologies;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad847adf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/B/iv"><num value="iv">(iv)</num><content> environmental organizations;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad847ae0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/B/v"><num value="v">(v)</num><content> organizations representing workers; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad847ae1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/B/vi"><num value="vi">(vi)</num><content> organizations representing consumers;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad847ae2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/C"><num value="C">(C)</num><content> not later than 120 days after <date date="2005-08-08">August 8, 2005</date>, publish in the Federal Register proposed draft cost and performance goals for public comments; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad847ae3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/D"><num value="D">(D)</num><chapeau> not later than 180 days after <date date="2005-08-08">August 8, 2005</date>, and every 4 years thereafter, submit to Congress a report describing the final cost and performance goals for the technologies that includes—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad847ae4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/D/i"><num value="i">(i)</num><content> a list of technical milestones; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad847ae5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/b/2/D/ii"><num value="ii">(ii)</num><content> an explanation of how programs authorized in this section will not duplicate the activities authorized under the Clean Coal Power Initiative authorized under subchapter IV.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad847ae6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/c"><num value="c" class="bold">(c)</num><heading class="bold"> Powder River Basin and Fort Union lignite coal mercury removal</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad847ae7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">In addition to the programs authorized by subsection (a), the Secretary shall establish a program to test and develop technologies to control and remove mercury emissions from subbituminous coal mined in the Powder River Basin, and Fort Union lignite coals, that are used for the generation of electricity.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad847ae8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Efficacy of mercury removal technology</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out the program under paragraph (1), the Secretary shall examine the efficacy of mercury removal technologies on coals described in that paragraph that are blended with other types of coal.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad847ae9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/d"><num value="d" class="bold">(d)</num><heading class="bold"> Fuel cells</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad847aea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall conduct a program of research, development, demonstration, and commercial application on fuel cells for low-cost, high-efficiency, fuel-flexible, modular power systems.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad847aeb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16292/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Demonstrations</heading><content><p style="-uslm-lc:I12" class="indent1">The demonstrations referred to in paragraph (1) shall include solid oxide fuel cell technology for commercial, residential, and transportation applications, and distributed generation systems, using improved manufacturing production and processes.</p>
