and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad84a202-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/a/2\"><num value=\"2\">(2)</num><content> on the fleet of coal-based units in existence on <date date=\"2005-08-08\">August 8, 2005</date>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad84a203-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Objectives</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The objectives of the program under subsection (a) shall be—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad84a204-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/b/1\"><num value=\"1\">(1)</num><content> to develop carbon dioxide capture technologies, including adsorption and absorption techniques and chemical processes, to remove the carbon dioxide from gas streams containing carbon dioxide potentially amenable to sequestration;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad84a205-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/b/2\"><num value=\"2\">(2)</num><content> to develop technologies that would directly produce concentrated streams of carbon dioxide potentially amenable to sequestration;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad84a206-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/b/3\"><num value=\"3\">(3)</num><content> to increase the efficiency of the overall system to reduce the quantity of carbon dioxide emissions released from the system per megawatt generated;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad84a207-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/b/4\"><num value=\"4\">(4)</num><content> in accordance with the carbon dioxide capture program, to promote a robust carbon sequestration program and continue the work of the Department, in conjunction with the private sector, through regional carbon sequestration partnerships; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad84a208-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/b/5\"><num value=\"5\">(5)</num><content> to expedite and carry out large-scale testing of carbon sequestration systems in a range of geologic formations that will provide information on the cost and feasibility of deployment of sequestration technologies.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad84a209-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Programmatic activities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad84a20a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Fundamental science and engineering research and development and demonstration supporting carbon capture and sequestration technologies and carbon use activities</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad84a20b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall carry out fundamental science and engineering research (including laboratory-scale experiments, numeric modeling, and simulations) to develop and document the performance of new approaches to capture and sequester, or use carbon dioxide to lead to an overall reduction of carbon dioxide emissions.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad84a20c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Program integration</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall ensure that fundamental research carried out under this paragraph is appropriately applied to energy technology development activities, the field testing of carbon sequestration, and carbon use activities, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a20d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/1/B/i\"><num value=\"i\">(i)</num><content> development of new or advanced technologies for the capture and sequestration of carbon dioxide;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a20e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/1/B/ii\"><num value=\"ii\">(ii)</num><content> development of new or advanced technologies that reduce the cost and increase the efficacy of advanced compression of carbon dioxide required for the sequestration of carbon dioxide;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a20f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/1/B/iii\"><num value=\"iii\">(iii)</num><content> modeling and simulation of geologic sequestration field demonstrations;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a210-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/1/B/iv\"><num value=\"iv\">(iv)</num><content> quantitative assessment of risks relating to specific field sites for testing of sequestration technologies;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a211-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/1/B/v\"><num value=\"v\">(v)</num><content> research and development of new and advanced technologies for carbon use, including recycling and reuse of carbon dioxide; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a212-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/1/B/vi\"><num value=\"vi\">(vi)</num><content> research and development of new and advanced technologies for the separation of oxygen from air.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad84a213-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Field validation testing activities</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad84a214-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall promote, to the maximum extent practicable, regional carbon sequestration partnerships to conduct geologic sequestration tests involving carbon dioxide injection and monitoring, mitigation, and verification operations in a variety of candidate geologic settings, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a215-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/A/i\"><num value=\"i\">(i)</num><content> operating oil and gas fields;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a216-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/A/ii\"><num value=\"ii\">(ii)</num><content> depleted oil and gas fields;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a217-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/A/iii\"><num value=\"iii\">(iii)</num><content> unmineable coal seams;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a218-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/A/iv\"><num value=\"iv\">(iv)</num><content> deep saline formations;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84a219-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/A/v\"><num value=\"v\">(v)</num><content> deep geologic systems that may be used as engineered reservoirs to extract economical quantities of heat from geothermal resources of low permeability or porosity; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84c92a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/A/vi\"><num value=\"vi\">(vi)</num><content> deep geologic systems containing basalt formations.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad84c92b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Objectives</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The objectives of tests conducted under this paragraph shall be—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84c92c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/B/i\"><num value=\"i\">(i)</num><content> to develop and validate geophysical tools, analysis, and modeling to monitor, predict, and verify carbon dioxide containment;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84c92d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/B/ii\"><num value=\"ii\">(ii)</num><content> to validate modeling of geologic formations;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84c92e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/B/iii\"><num value=\"iii\">(iii)</num><content> to refine sequestration capacity estimated for particular geologic formations;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84c92f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/B/iv\"><num value=\"iv\">(iv)</num><content> to determine the fate of carbon dioxide concurrent with and following injection into geologic formations;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84c930-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/B/v\"><num value=\"v\">(v)</num><content> to develop and implement best practices for operations relating to, and monitoring of, carbon dioxide injection and sequestration in geologic formations;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84c931-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/B/vi\"><num value=\"vi\">(vi)</num><content> to assess and ensure the safety of operations related to geologic sequestration of carbon dioxide;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84c932-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/B/vii\"><num value=\"vii\">(vii)</num><content> to allow the Secretary to promulgate policies, procedures, requirements, and guidance to ensure that the objectives of this subparagraph are met in large-scale testing and deployment activities for carbon capture and sequestration that are funded by the Department of Energy; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad84c933-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/2/B/viii\"><num value=\"viii\">(viii)</num><content> to provide information to States, the Environmental Protection Agency, and other appropriate entities to support development of a regulatory framework for commercial-scale sequestration operations that ensure the protection of human health and the environment.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad84c934-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Large-scale carbon dioxide sequestration testing</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad84c935-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall conduct not less than 7 initial large-scale sequestration tests, not including the FutureGen project, for geologic containment of carbon dioxide to collect and validate information on the cost and feasibility of commercial deployment of technologies for geologic containment of carbon dioxide. These 7 tests may include any Regional Partnership projects awarded as of <date date=\"2007-12-19\">December 19, 2007</date>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad84c936-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Diversity of formations to be studied</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In selecting formations for study under this paragraph, the Secretary shall consider a variety of geologic formations across the United States, and require characterization and modeling of candidate formations, as determined by the Secretary.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad84c937-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Source of carbon dioxide for large-scale sequestration tests</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In the process of any acquisition of carbon dioxide for sequestration tests under subparagraph (A), the Secretary shall give preference to sources of carbon dioxide from industrial sources. To the extent feasible, the Secretary shall prefer tests that would facilitate the creation of an integrated system of capture, transportation and sequestration of carbon dioxide. The preference provided for under this subparagraph shall not delay the implementation of the large-scale sequestration tests under this paragraph.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad84c938-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/3/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of this paragraph, the term “large-scale” means the injection of more than 1,000,000 tons of carbon dioxide from industrial sources annually or a scale that demonstrates the ability to inject and sequester several million metric tons of industrial source carbon dioxide for a large number of years.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad84c939-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Preference in project selection from meritorious proposals</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In making competitive awards under this subsection, subject to the requirements of <ref href=\"/us/usc/t42/s16353\">section 16353 of this title</ref>, the Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad84c93a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/4/A\"><num value=\"A\">(A)</num><content> give preference to proposals from partnerships among industrial, academic, and government entities; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad84c93b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16293/c/4/B\"><num value=\"B\">(B)</num><content> require recipients to provide assurances that all laborers and mechanics employed by contractors and subcontractors in the construction, repair, or alteration of new or existing facilities performed in order to carry out a demonstration or commercial application activity authorized under this subsection shall be paid wages at rates not less than those prevailing on similar construction in the locality, as determined by the Secretary of Labor in accordance with subchapter IV of chapter 31 of title 40, and the Secretary of Labor shall, with respect to the labor standards in this paragraph, have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (15 Fed. Reg. 3176; 5 U.S.C.
