<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad8565e3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312"><num value="16312">§ 16312.</num><heading> Fusion energy sciences program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8565e4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/a"><num value="a" class="bold">(a)</num><heading class="bold"> Declaration of policy</heading><content><p style="-uslm-lc:I11" class="indent0">It shall be the policy of the United States to conduct research, development, demonstration, and commercial applications to provide for the scientific, engineering, and commercial infrastructure necessary to ensure that the United States is competitive with other countries in providing fusion energy for its own needs and the needs of other countries, including by demonstrating electric power or hydrogen production for the United States energy grid using fusion energy at the earliest date.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8565e5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b"><num value="b" class="bold">(b)</num><heading class="bold"> Planning</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8565e6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 180 days after <date date="2005-08-08">August 8, 2005</date>, the Secretary shall submit to Congress a plan (with proposed cost estimates, budgets, and lists of potential international partners) for the implementation of the policy described in subsection (a) in a manner that ensures that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565e7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/1/A"><num value="A">(A)</num><content> existing fusion research facilities are more fully used;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565e8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/1/B"><num value="B">(B)</num><content> fusion science, technology, theory, advanced computation, modeling, and simulation are strengthened;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565e9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/1/C"><num value="C">(C)</num><content> new magnetic and inertial fusion research and development facilities are selected based on scientific innovation and cost effectiveness, and the potential of the facilities to advance the goal of practical fusion energy at the earliest date practicable;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565ea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/1/D"><num value="D">(D)</num><content> facilities that are selected are funded at a cost-effective rate;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565eb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/1/E"><num value="E">(E)</num><content> communication of scientific results and methods between the fusion energy science community and the broader scientific and technology communities is improved;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565ec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/1/F"><num value="F">(F)</num><content> inertial confinement fusion facilities are used to the extent practicable for the purpose of inertial fusion energy research and development;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/1/G"><num value="G">(G)</num><content> attractive alternative inertial and magnetic fusion energy approaches are more fully explored; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565ee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/1/H"><num value="H">(H)</num><content> to the extent practicable, the recommendations of the Fusion Energy Sciences Advisory Committee in the report on workforce planning, dated March 2004, are carried out, including periodic reassessment of program needs.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8565ef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Costs and schedules</heading><chapeau style="-uslm-lc:I12" class="indent1">The plan shall also address the status of and, to the extent practicable, costs and schedules for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565f0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/2/A"><num value="A">(A)</num><content> the design and implementation of international or national facilities for the testing of fusion materials; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8565f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/b/2/B"><num value="B">(B)</num><content> the design and implementation of international or national facilities for the testing and development of key fusion technologies.</content>
</subparagraph>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8565f2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c"><num value="c" class="bold">(c)</num><heading class="bold"> United States participation in ITER</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8565f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad8565f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Construction</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idad8565f5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/1/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I14" class="indent3">The term “construction” means—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idad858d06-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/1/A/i/I"><num value="I">(I)</num><content> the physical construction of the ITER facility; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idad858d07-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/1/A/i/II"><num value="II">(II)</num><content> the physical construction, purchase, or manufacture of equipment or components that are specifically designed for the ITER facility.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idad858d08-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/1/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Exclusions</heading><content><p style="-uslm-lc:I14" class="indent3">The term “construction” does not include the design of the facility, equipment, or components.</p>

</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad858d09-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> ITER</heading><content><p style="-uslm-lc:I13" class="indent2">The term “ITER” means the international burning plasma fusion research project in which the President announced United States participation on <date date="2003-01-30">January 30, 2003</date>, or any similar international project.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad858d0a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Participation</heading><content><p style="-uslm-lc:I12" class="indent1">The United States may participate in the ITER only in accordance with this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad858d0b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Agreement</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad858d0c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may negotiate an agreement for United States participation in the ITER.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad858d0d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I13" class="indent2">Any agreement for United States participation in the ITER shall, at a minimum—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad858d0e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3/B/i"><num value="i">(i)</num><content> clearly define the United States financial contribution to construction and operating costs, as well as any other costs associated with a project;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad858d0f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3/B/ii"><num value="ii">(ii)</num><content> ensure that the share of high-technology components of the ITER manufactured in the United States is at least proportionate to the United States financial contribution to the ITER;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad858d10-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3/B/iii"><num value="iii">(iii)</num><content> ensure that the United States will not be financially responsible for cost overruns in components manufactured in other ITER participating countries;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad858d11-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3/B/iv"><num value="iv">(iv)</num><content> guarantee the United States full access to all data generated by the ITER;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad858d12-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3/B/v"><num value="v">(v)</num><content> enable United States researchers to propose and carry out an equitable share of the experiments at the ITER;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad858d13-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3/B/vi"><num value="vi">(vi)</num><content> provide the United States with a role in all collective decisionmaking related to the ITER; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad858d14-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/3/B/vii"><num value="vii">(vii)</num><content> describe the process for discontinuing or decommissioning the ITER and any United States role in that process.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad858d15-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Plan</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad858d16-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> Development</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary, in consultation with the Fusion Energy Sciences Advisory Committee, shall develop a plan for the participation of United States scientists in the ITER that shall include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad858d17-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/4/A/i"><num value="i">(i)</num><content> the United States research agenda for the ITER;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad858d18-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/4/A/ii"><num value="ii">(ii)</num><content> methods to evaluate whether the ITER is promoting progress toward making fusion a reliable and affordable source of power; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad858d19-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/4/A/iii"><num value="iii">(iii)</num><content> a description of how work at the ITER will relate to other elements of the United States fusion program.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad858d1a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Review</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall request a review of the plan by the National Academy of Sciences.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad858d1b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> Limitation</heading><chapeau style="-uslm-lc:I12" class="indent1">No Federal funds shall be expended for the construction of the ITER until the Secretary has submitted to Congress—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad858d1c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/5/A"><num value="A">(A)</num><content> the agreement negotiated in accordance with paragraph (3) and 120 days have elapsed since that submission;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad858d1d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/5/B"><num value="B">(B)</num><content> a report describing the management structure of the ITER and providing a fixed dollar estimate of the cost of United States participation in the construction of the ITER, and 120 days have elapsed since that submission;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad858d1e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/5/C"><num value="C">(C)</num><content> a report describing how United States participation in the ITER will be funded without reducing funding for other programs in the Office of Science (including other fusion programs), and 60 days have elapsed since that submission; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad858d1f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/5/D"><num value="D">(D)</num><content> the plan required by paragraph (4) (but not the National Academy of Sciences review of that plan), and 60 days have elapsed since that submission.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad858d20-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/6"><num value="6" class="bold">(6)</num><heading class="bold"> Alternative to ITER</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad858d21-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">If at any time during the negotiations on the ITER, the Secretary determines that construction and operation of the ITER is unlikely or infeasible, the Secretary shall submit to Congress, along with the budget request of the President submitted to Congress for the following fiscal year, a plan for implementing a domestic burning plasma experiment such as the Fusion Ignition Research Experiment, including costs and schedules for the plan.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad858d22-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Administration</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad858d23-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/6/B/i"><num value="i">(i)</num><content> refine the plan in full consultation with the Fusion Energy Sciences Advisory Committee; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad85b434-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16312/c/6/B/ii"><num value="ii">(ii)</num><content> transmit the plan to the National Academy of Sciences for review.</content>
