<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad8713ec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354"><num value="16354">§ 16354.</num><heading> External technical review of departmental programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8713ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/a"><num value="a" class="bold">(a)</num><heading class="bold"> National energy research and development advisory boards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8713ee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish one or more advisory boards to review research, development, demonstration, and commercial application programs of the Department in energy efficiency, renewable energy, nuclear energy, and fossil energy.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8713ef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Alternatives</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8713f0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/a/2/A"><num value="A">(A)</num><content> designate an existing advisory board within the Department to fulfill the responsibilities of an advisory board under this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8713f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/a/2/B"><num value="B">(B)</num><content> enter into appropriate arrangements with the National Academy of Sciences to establish such an advisory board.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad873a02-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/b"><num value="b" class="bold">(b)</num><heading class="bold"> Use of existing committees</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall continue to use the scientific program advisory committees chartered under the Federal Advisory Committee Act (5 U.S.C. App.) by the Office of Science to oversee research and development programs under that Office.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad873a03-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/c"><num value="c" class="bold">(c)</num><heading class="bold"> Membership</heading><content><p style="-uslm-lc:I11" class="indent0">Each advisory board under this section shall consist of persons with appropriate expertise representing a diverse range of interests.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad873a04-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/d"><num value="d" class="bold">(d)</num><heading class="bold"> Meetings and goals</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad873a05-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Meetings</heading><content><p style="-uslm-lc:I12" class="indent1">Each advisory board under this section shall meet at least semiannually to review and advise on the progress made by the respective one or more research, development, demonstration, and commercial application programs.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad873a06-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Goals</heading><content><p style="-uslm-lc:I12" class="indent1">The advisory board shall review the measurable cost and performance-based goals for the programs as established under <ref href="/us/usc/t42/s16181">section 16181 of this title</ref>, and the progress on meeting the goals.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad873a07-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/e"><num value="e" class="bold">(e)</num><heading class="bold"> Periodic reviews and assessments</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad873a08-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall enter into appropriate arrangements with the National Academy of Sciences to conduct periodic reviews and assessments of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad873a09-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/e/1/A"><num value="A">(A)</num><content> the research, development, demonstration, and commercial application programs authorized by this Act and amendments made by this Act;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad873a0a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/e/1/B"><num value="B">(B)</num><content> the measurable cost and performance-based goals for the programs as established under <ref href="/us/usc/t42/s16181">section 16181 of this title</ref>, if any; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad873a0b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/e/1/C"><num value="C">(C)</num><content> the progress on meeting the goals.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad873a0c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16354/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Timing</heading><content><p style="-uslm-lc:I12" class="indent1">The reviews and assessments shall be conducted every 5 years or more often as the Secretary considers necessary.</p>
