<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad87fdbd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391"><num value="16391">§ 16391.</num><heading> Improved technology transfer of energy technologies</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad87fdbe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/a"><num value="a" class="bold">(a)</num><heading class="bold"> Technology Transfer Coordinator</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall appoint a Technology Transfer Coordinator to be the principal advisor to the Secretary on all matters relating to technology transfer and commercialization.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad87fdbf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/b"><num value="b" class="bold">(b)</num><heading class="bold"> Qualifications</heading><content><p style="-uslm-lc:I11" class="indent0">The Coordinator shall be an individual who, by reason of professional background and experience, is specially qualified to advise the Secretary on matters pertaining to technology transfer at the Department.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad87fdc0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/c"><num value="c" class="bold">(c)</num><heading class="bold"> Duties of the Coordinator</heading><chapeau style="-uslm-lc:I11" class="indent0">The Coordinator shall oversee—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad87fdc1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/c/1"><num value="1">(1)</num><content> the activities of the Technology Transfer Working Group established under subsection (d);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad87fdc2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/c/2"><num value="2">(2)</num><content> the expenditure of funds allocated for technology transfer within the Department;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad87fdc3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/c/3"><num value="3">(3)</num><content> the activities of each technology partnership ombudsman appointed under <ref href="/us/usc/t42/s7261c">section 7261c of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad87fdc4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/c/4"><num value="4">(4)</num><content> efforts to engage private sector entities, including venture capital companies.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad87fdc5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/d"><num value="d" class="bold">(d)</num><heading class="bold"> Technology Transfer Working Group</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall establish a Technology Transfer Working Group, which shall consist of representatives of the National Laboratories and single-purpose research facilities, to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad87fdc6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/d/1"><num value="1">(1)</num><content> coordinate technology transfer activities occurring at National Laboratories and single-purpose research facilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad87fdc7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/d/2"><num value="2">(2)</num><content> exchange information about technology transfer practices, including alternative approaches to resolution of disputes involving intellectual property rights and other technology transfer matters; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad87fdc8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/d/3"><num value="3">(3)</num><content> develop and disseminate to the public and prospective technology partners information about opportunities and procedures for technology transfer with the Department, including opportunities and procedures related to alternative approaches to resolution of disputes involving intellectual property rights and other technology transfer matters.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8824d9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/e"><num value="e" class="bold">(e)</num><heading class="bold"> Technology Commercialization Fund</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall establish an Energy Technology Commercialization Fund, using 0.9 percent of the amount made available to the Department for applied energy research, development, demonstration, and commercial application for each fiscal year based on future planned activities and the amount of the appropriations for the fiscal year, to be used to provide matching funds with private partners to promote promising energy technologies for commercial purposes.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8824da-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/f"><num value="f" class="bold">(f)</num><heading class="bold"> Technology transfer responsibility</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section affects the technology transfer responsibilities of Federal employees under the Stevenson-Wydler Technology Innovation Act of 1980 (<ref href="/us/usc/t15/s3701">15 U.S.C. 3701</ref> et seq.).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8824db-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/g"><num value="g" class="bold">(g)</num><heading class="bold"> Early stage technology demonstration</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall permit the directors of the National Laboratories to use funds authorized to support technology transfer within the Department to carry out early stage and precommercial technology demonstration activities to remove technology barriers that limit private sector interest and demonstrate potential commercial applications of any research and technologies arising from National Laboratory activities.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8824dc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/h"><num value="h" class="bold">(h)</num><heading class="bold"> Planning and reporting</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8824dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 180 days after <date date="2005-08-08">August 8, 2005</date>, the Secretary shall submit to Congress a technology transfer execution plan.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8824de-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16391/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Updates</heading><content><p style="-uslm-lc:I12" class="indent1">Each year after the submission of the plan under paragraph (1), the Secretary shall submit to Congress an updated execution plan and reports that describe progress toward meeting goals set forth in the execution plan and the funds expended under subsection (e).</p>
