L. 109–58, title X, § 1003, Aug. 8, 2005, 119 Stat. 929.)","seq_in_title":7601,"parent_identifier":"/us/usc/t42/ch149/schX","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch149","level":"chapter","num":"CHAPTER 149—","heading":"NATIONAL ENERGY POLICY AND PROGRAMS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch149/schX","level":"subchapter","num":"SUBCHAPTER X—","heading":"DEPARTMENT OF ENERGY MANAGEMENT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad887336-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393\"><num value=\"16393\">§ 16393.</num><heading> Small business advocacy and assistance</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad887337-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Small business advocate</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall require the Director of each National Laboratory, and may require the Director of a single-purpose research facility, to designate a small business advocate to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad887338-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/a/1\"><num value=\"1\">(1)</num><content> increase the participation of small business concerns, including socially and economically disadvantaged small business concerns (as defined in <ref href=\"/us/usc/t15/s637/a/4\">section 637(a)(4) of title 15</ref>), in procurement, collaborative research, technology licensing, and technology transfer activities conducted by the National Laboratory or single-purpose research facility;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad887339-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/a/2\"><num value=\"2\">(2)</num><content> report to the Director of the National Laboratory or single-purpose research facility on the actual participation of small business concerns in procurement and collaborative research along with recommendations, if appropriate, on how to improve participation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad88733a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/a/3\"><num value=\"3\">(3)</num><content> make available to small business concerns training, mentoring, and information on how to participate in procurement and collaborative research activities;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad88733b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/a/4\"><num value=\"4\">(4)</num><content> increase the awareness inside the National Laboratory or single-purpose research facility of the capabilities and opportunities presented by small business concerns; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad88733c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/a/5\"><num value=\"5\">(5)</num><content> establish guidelines for the program under subsection (b) and report on the effectiveness of the program to the Director of the National Laboratory or single-purpose research facility.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad88733d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Establishment of small business assistance program</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall require the Director of each National Laboratory, and may require the Director of a single-purpose research facility, to establish a program to provide small business concerns with—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad88733e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/b/1\"><num value=\"1\">(1)</num><content> assistance directed at making the small business concerns more effective and efficient subcontractors or suppliers to the National Laboratory or single-purpose research facilities; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad88733f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/b/2\"><num value=\"2\">(2)</num><content> general technical assistance, the cost of which shall not exceed $10,000 per instance of assistance, to improve the products or services of the small business concern.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad887340-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Use of funds</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">None of the funds expended under subsection (b) may be used for direct grants to small business concerns.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad889a51-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16393/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There is authorized to be appropriated to the Secretary for activities under this section $5,000,000 for each of fiscal years 2006 through 2008.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idad889a52-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/109/58/tX/s1003\">Pub.
