<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad8935ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411"><num value="16411">§ 16411.</num><heading> Workforce trends and traineeship grants</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8935ee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8935ef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Energy technology industry</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “energy technology industry” includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8935f0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/1/A"><num value="A">(A)</num><content> a renewable energy industry;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8935f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/1/B"><num value="B">(B)</num><content> a company that develops or commercializes a device to increase energy efficiency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad895d02-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/1/C"><num value="C">(C)</num><content> the oil and gas industry;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad895d03-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/1/D"><num value="D">(D)</num><content> the nuclear power industry;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad895d04-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/1/E"><num value="E">(E)</num><content> the coal industry;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad895d05-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/1/F"><num value="F">(F)</num><content> the electric utility industry; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad895d06-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/1/G"><num value="G">(G)</num><content> any other industrial sector, as the Secretary determines to be appropriate.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad895d07-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Skilled technical personnel</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “skilled technical personnel” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad895d08-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/2/A"><num value="A">(A)</num><content> journey- and apprentice-level workers who are enrolled in, or have completed, a federally-recognized or State-recognized apprenticeship program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad895d09-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/a/2/B"><num value="B">(B)</num><content> other skilled workers in energy technology industries, as determined by the Secretary.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad895d0a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/b"><num value="b" class="bold">(b)</num><heading class="bold"> Workforce trends</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad895d0b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Monitoring</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary, in consultation with, and using data collected by, the Secretary of Labor, shall monitor trends in the workforce of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad895d0c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/b/1/A"><num value="A">(A)</num><content> skilled technical personnel that support energy technology industries; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad895d0d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/b/1/B"><num value="B">(B)</num><content> electric power and transmission engineers.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad895d0e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Report on trends</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 1 year after <date date="2005-08-08">August 8, 2005</date>, the Secretary shall submit to Congress a report on current trends under paragraph (1), with recommendations (as appropriate) to meet the future labor requirements for the energy technology industries.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad895d0f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Report on shortage</heading><content><p style="-uslm-lc:I12" class="indent1">As soon as practicable after the date on which the Secretary identifies or predicts a significant national shortage of skilled technical personnel in one or more energy technology industries, the Secretary shall submit to Congress a report describing the shortage.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad895d10-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/c"><num value="c" class="bold">(c)</num><heading class="bold"> Traineeship grants for skilled technical personnel</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary, in consultation with the Secretary of Labor, may establish programs in the appropriate offices of the Department under which the Secretary provides grants to enhance training (including distance learning) for any workforce category for which a shortage is identified or predicted under subsection (b)(2).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad895d11-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16411/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There is authorized to be appropriated to carry out this section $20,000,000 for each of fiscal years 2006 through 2008.</p>
