L. 109–58, title XI, § 1103, Aug. 8, 2005, 119 Stat. 939.)","seq_in_title":7606,"parent_identifier":"/us/usc/t42/ch149/schXI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch149","level":"chapter","num":"CHAPTER 149—","heading":"NATIONAL ENERGY POLICY AND PROGRAMS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch149/schXI","level":"subchapter","num":"SUBCHAPTER XI—","heading":"PERSONNEL AND TRAINING","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad895d13-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412\"><num value=\"16412\">§ 16412.</num><heading> Training guidelines for nonnuclear electric energy industry personnel</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad895d14-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary of Labor, in consultation with the Secretary and in conjunction with the electric industry and recognized employee representatives, shall develop model personnel training guidelines to support the reliability and safety of the nonnuclear electric system.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad895d15-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Requirements</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The training guidelines under subsection (a) shall, at a minimum—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad895d16-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/b/1\"><num value=\"1\">(1)</num><chapeau> include training requirements for workers engaged in the construction, operation, inspection, or maintenance of nonnuclear electric generation, transmission, or distribution systems, including requirements relating to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad895d17-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/b/1/A\"><num value=\"A\">(A)</num><content> competency;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad895d18-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/b/1/B\"><num value=\"B\">(B)</num><content> certification; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad895d19-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/b/1/C\"><num value=\"C\">(C)</num><chapeau> assessment, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad895d1a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/b/1/C/i\"><num value=\"i\">(i)</num><content> initial and continuous evaluation of workers;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad895d1b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/b/1/C/ii\"><num value=\"ii\">(ii)</num><content> recertification procedures; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad895d1c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/b/1/C/iii\"><num value=\"iii\">(iii)</num><content> methods for examining or testing the qualification of an individual who performs a covered task; and</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad895d1d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s16412/b/2\"><num value=\"2\">(2)</num><content> consolidate training guidelines in existence on the date on which the guidelines under subsection (a) are developed relating to the construction, operation, maintenance, and inspection of nonnuclear electric generation, transmission, and distribution facilities, such as guidelines established by the National Electric Safety Code and other industry consensus standards.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idad89842e-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/109/58/tXI/s1103\">Pub.
