<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd92aa22e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421"><num value="16421">§ 16421.</num><heading> Third-party finance</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92aa22f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/a"><num value="a" class="bold">(a)</num><heading class="bold"> Existing facilities</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary, acting through the Administrator of the Western Area Power Administration (hereinafter in this section referred to as “WAPA”), or through the Administrator of the Southwestern Power Administration (hereinafter in this section referred to as “SWPA”), or both, may design, develop, construct, operate, maintain, or own, or participate with other entities in designing, developing, constructing, operating, maintaining, or owning, an electric power transmission facility and related facilities (“Project”) needed to upgrade existing transmission facilities owned by SWPA or WAPA if the Secretary, in consultation with the applicable Administrator, determines that the proposed Project—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa230-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/a/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="idd92aa231-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/a/1/A"><num value="A">(A)</num><content> is located in a national interest electric transmission corridor designated under section 216(a) of the Federal Power Act [<ref href="/us/usc/t16/s824p/a">16 U.S.C. 824p(a)</ref>] and will reduce congestion of electric transmission in interstate commerce; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd92aa232-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/a/1/B"><num value="B">(B)</num><content> is necessary to accommodate an actual or projected increase in demand for electric transmission capacity;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa233-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/a/2"><num value="2">(2)</num><chapeau> is consistent with—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd92aa234-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/a/2/A"><num value="A">(A)</num><content> transmission needs identified, in a transmission expansion plan or otherwise, by the appropriate Transmission Organization (as defined in the Federal Power Act [<ref href="/us/usc/t16/s791a">16 U.S.C. 791a</ref> et seq.]), if any, or approved regional reliability organization; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92aa235-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/a/2/B"><num value="B">(B)</num><content> efficient and reliable operation of the transmission grid; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa236-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/a/3"><num value="3">(3)</num><content> would be operated in conformance with prudent utility practice.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92aa237-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/b"><num value="b" class="bold">(b)</num><heading class="bold"> New facilities</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary, acting through WAPA or SWPA, or both, may design, develop, construct, operate, maintain, or own, or participate with other entities in designing, developing, constructing, operating, maintaining, or owning, a new electric power transmission facility and related facilities (“Project”) located within any State in which WAPA or SWPA operates if the Secretary, in consultation with the applicable Administrator, determines that the proposed Project—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa238-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/b/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="idd92aa239-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/b/1/A"><num value="A">(A)</num><content> is located in an area designated under section 216(a) of the Federal Power Act [<ref href="/us/usc/t16/s824p/a">16 U.S.C. 824p(a)</ref>] and will reduce congestion of electric transmission in interstate commerce; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd92aa23a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/b/1/B"><num value="B">(B)</num><content> is necessary to accommodate an actual or projected increase in demand for electric transmission capacity;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa23b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/b/2"><num value="2">(2)</num><chapeau> is consistent with—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd92aa23c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/b/2/A"><num value="A">(A)</num><content> transmission needs identified, in a transmission expansion plan or otherwise, by the appropriate Transmission Organization (as defined in the Federal Power Act [<ref href="/us/usc/t16/s791a">16 U.S.C. 791a</ref> et seq.]) if any, or approved regional reliability organization; and</content>
</subparagraph>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa23e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/b/3"><num value="3">(3)</num><content> will be operated in conformance with prudent utility practice;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa23f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/b/4"><num value="4">(4)</num><content> will be operated by, or in conformance with the rules of, the appropriate (A) Transmission Organization, if any, or (B) if such an organization does not exist, regional reliability organization; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa240-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/b/5"><num value="5">(5)</num><content> will not duplicate the functions of existing transmission facilities or proposed facilities which are the subject of ongoing or approved siting and related permitting proceedings.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92aa241-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/c"><num value="c" class="bold">(c)</num><heading class="bold"> Other funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92aa242-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out a Project under subsection (a) or (b), the Secretary may accept and use funds contributed by another entity for the purpose of carrying out the Project.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92aa243-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Availability</heading><chapeau style="-uslm-lc:I12" class="indent1">The contributed funds shall be available for expenditure for the purpose of carrying out the Project—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd92aa244-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/c/2/A"><num value="A">(A)</num><content> without fiscal year limitation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92aa245-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/c/2/B"><num value="B">(B)</num><content> as if the funds had been appropriated specifically for that Project.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92aa246-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Allocation of costs</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out a Project under subsection (a) or (b), any costs of the Project not paid for by contributions from another entity shall be collected through rates charged to customers using the new transmission capability provided by the Project and allocated equitably among these project beneficiaries using the new transmission capability.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92aa247-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/d"><num value="d" class="bold">(d)</num><heading class="bold"> Relationship to other laws</heading><chapeau style="-uslm-lc:I11" class="indent0">Nothing in this section affects any requirement of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa248-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/d/1"><num value="1">(1)</num><content> any Federal environmental law, including the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321">42 U.S.C. 4321</ref> et seq.);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa249-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/d/2"><num value="2">(2)</num><content> any Federal or State law relating to the siting of energy facilities; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92aa24a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/d/3"><num value="3">(3)</num><content> any existing authorizing statutes.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92aa24b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/e"><num value="e" class="bold">(e)</num><heading class="bold"> Savings clause</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall constrain or restrict an Administrator in the utilization of other authority delegated to the Administrator of WAPA or SWPA.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92aa24c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/f"><num value="f" class="bold">(f)</num><heading class="bold"> Secretarial determinations</heading><content><p style="-uslm-lc:I11" class="indent0">Any determination made pursuant to subsections <ref class="footnoteRef" idref="fn004139">1</ref><note type="footnote" id="fn004139"><num>1</num> So in original. Probably should be “subsection”.</note> (a) or (b) shall be based on findings by the Secretary using the best available data.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92aa24d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16421/g"><num value="g" class="bold">(g)</num><heading class="bold"> Maximum funding amount</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall not accept and use more than $100,000,000 under subsection (c)(1) for the period encompassing fiscal years 2006 through 2015.</p>
