<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad8a20f0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431"><num value="16431">§ 16431.</num><heading> Federal utility participation in transmission organizations</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8a20f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8a20f2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Appropriate Federal regulatory authority</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “appropriate Federal regulatory authority” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8a20f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a/1/A"><num value="A">(A)</num><content> in the case of a Federal power marketing agency, the Secretary, except that the Secretary may designate the Administrator of a Federal power marketing agency to act as the appropriate Federal regulatory authority with respect to the transmission system of the Federal power marketing agency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8a20f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a/1/B"><num value="B">(B)</num><content> in the case of the Tennessee Valley Authority, the Board of Directors of the Tennessee Valley Authority.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8a20f5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Federal power marketing agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Federal power marketing agency” has the meaning given the term in <ref href="/us/usc/t16/s796">section 796 of title 16</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8a20f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Federal utility</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “Federal utility” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8a20f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a/3/A"><num value="A">(A)</num><content> a Federal power marketing agency; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8a20f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a/3/B"><num value="B">(B)</num><content> the Tennessee Valley Authority.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8a20f9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Transmission Organization</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Transmission Organization” has the meaning given the term in <ref href="/us/usc/t16/s796">section 796 of title 16</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8a20fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Transmission system</heading><content><p style="-uslm-lc:I12" class="indent1">The term “transmission system” means an electric transmission facility owned, leased, or contracted for by the United States and operated by a Federal utility.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8a20fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/b"><num value="b" class="bold">(b)</num><heading class="bold"> Transfer</heading><content><p style="-uslm-lc:I11" class="indent0">The appropriate Federal regulatory authority may enter into a contract, agreement, or other arrangement transferring control and use of all or part of the transmission system of a Federal utility to a Transmission Organization.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8a480c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/c"><num value="c" class="bold">(c)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I11" class="indent0">The contract, agreement, or arrangement shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad8a480d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/c/1"><num value="1">(1)</num><chapeau> performance standards for operation and use of the transmission system that the head of the Federal utility determines are necessary or appropriate, including standards that ensure—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8a480e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/c/1/A"><num value="A">(A)</num><content> recovery of all of the costs and expenses of the Federal utility related to the transmission facilities that are the subject of the contract, agreement, or other arrangement;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8a480f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/c/1/B"><num value="B">(B)</num><content> consistency with existing contracts and third-party financing arrangements; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8a4810-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/c/1/C"><num value="C">(C)</num><content> consistency with the statutory authorities, obligations, and limitations of the Federal utility;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8a4811-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/c/2"><num value="2">(2)</num><content> provisions for monitoring and oversight by the Federal utility of the Transmission Organization’s terms and conditions of the contract, agreement, or other arrangement, including a provision for the resolution of disputes through arbitration or other means with the Transmission Organization or with other participants, notwithstanding the obligations and limitations of any other law regarding arbitration; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8a4812-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/c/3"><num value="3">(3)</num><content> a provision that allows the Federal utility to withdraw from the Transmission Organization and terminate the contract, agreement, or other arrangement in accordance with its terms.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8a4813-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/d"><num value="d" class="bold">(d)</num><heading class="bold"> Commission</heading><chapeau style="-uslm-lc:I11" class="indent0">Neither this section, actions taken pursuant to this section, nor any other transaction of a Federal utility participating in a Transmission Organization shall confer on the Commission jurisdiction or authority over—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad8a4814-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/d/1"><num value="1">(1)</num><content> the electric generation assets, electric capacity, or energy of the Federal utility that the Federal utility is authorized by law to market; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8a4815-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/d/2"><num value="2">(2)</num><content> the power sales activities of the Federal utility.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8a4816-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/e"><num value="e" class="bold">(e)</num><heading class="bold"> Existing statutory and other obligations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8a4817-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> System operation requirements</heading><content><p style="-uslm-lc:I12" class="indent1">No statutory provision requiring or authorizing a Federal utility to transmit electric power or to construct, operate, or maintain the transmission system of the Federal utility prohibits a transfer of control and use of the transmission system pursuant to, and subject to, the requirements of this section.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8a4818-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Other obligations</heading><chapeau style="-uslm-lc:I12" class="indent1">This subsection does not—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8a4819-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/e/2/A"><num value="A">(A)</num><content> suspend, or exempt any Federal utility from, any provision of Federal law in effect on <date date="2005-08-08">August 8, 2005</date>, including any requirement or direction relating to the use of the transmission system of the Federal utility, environmental protection, fish and wildlife protection, flood control, navigation, water delivery, or recreation; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8a481a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16431/e/2/B"><num value="B">(B)</num><content> authorize abrogation of any contract or treaty obligation.</content>
</subparagraph>
