<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad8c6a4d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513"><num value="16513">§ 16513.</num><heading> Eligible projects</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8c6a4e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may make guarantees under this section only for projects that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad8c6a4f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/a/1"><num value="1">(1)</num><content> avoid, reduce, or sequester air pollutants or anthropogenic emissions of greenhouse gases; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c6a50-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/a/2"><num value="2">(2)</num><content> employ new or significantly improved technologies as compared to commercial technologies in service in the United States at the time the guarantee is issued.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8c6a51-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b"><num value="b" class="bold">(b)</num><heading class="bold"> Categories</heading><chapeau style="-uslm-lc:I11" class="indent0">Projects from the following categories shall be eligible for a guarantee under this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad8c6a52-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/1"><num value="1">(1)</num><content> Renewable energy systems.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c9163-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/2"><num value="2">(2)</num><content> Advanced fossil energy technology (including coal gasification meeting the criteria in subsection (d)).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c9164-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/3"><num value="3">(3)</num><content> Hydrogen fuel cell technology for residential, industrial, or transportation applications.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c9165-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/4"><num value="4">(4)</num><content> Advanced nuclear energy facilities.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c9166-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/5"><num value="5">(5)</num><content> Carbon capture and sequestration practices and technologies, including agricultural and forestry practices that store and sequester carbon.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c9167-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/6"><num value="6">(6)</num><content> Efficient electrical generation, transmission, and distribution technologies.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c9168-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/7"><num value="7">(7)</num><content> Efficient end-use energy technologies.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c9169-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/8"><num value="8">(8)</num><content> Production facilities for the manufacture of fuel efficient vehicles or parts of those vehicles, including electric drive vehicles and advanced diesel vehicles.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c916a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/9"><num value="9">(9)</num><content> Pollution control equipment.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8c916b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/b/10"><num value="10">(10)</num><content> Refineries, meaning facilities at which crude oil is refined into gasoline.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8c916c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c"><num value="c" class="bold">(c)</num><heading class="bold"> Gasification projects</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may make guarantees for the following gasification projects:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8c916d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Integrated gasification combined cycle projects</heading><chapeau style="-uslm-lc:I12" class="indent1">Integrated gasification combined cycle plants meeting the emission levels under subsection (d), including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8c916e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/A"><num value="A">(A)</num><chapeau> projects for the generation of electricity—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad8c916f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/A/i"><num value="i">(i)</num><chapeau> for which, during the term of the guarantee—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idad8c9170-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/A/i/I"><num value="I">(I)</num><content> coal, biomass, petroleum coke, or a combination of coal, biomass, and petroleum coke will account for at least 65 percent of annual heat input; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idad8c9171-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/A/i/II"><num value="II">(II)</num><content> electricity will account for at least 65 percent of net useful annual energy output;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8c9172-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/A/ii"><num value="ii">(ii)</num><content> that have a design that is determined by the Secretary to be capable of accommodating the equipment likely to be necessary to capture the carbon dioxide that would otherwise be emitted in flue gas from the plant;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8c9173-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/A/iii"><num value="iii">(iii)</num><content> that have an assured revenue stream that covers project capital and operating costs (including servicing all debt obligations covered by the guarantee) that is approved by the Secretary and the relevant State public utility commission; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8c9174-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/A/iv"><num value="iv">(iv)</num><content> on which construction commences not later than the date that is 3 years after the date of the issuance of the guarantee;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8c9175-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/B"><num value="B">(B)</num><chapeau> a project to produce energy from coal (of not more than 13,000 Btu/lb and mined in the western United States) using appropriate advanced integrated gasification combined cycle technology that minimizes and offers the potential to sequester carbon dioxide emissions and that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad8c9176-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/B/i"><num value="i">(i)</num><content> may include repowering of existing facilities;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8c9177-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/B/ii"><num value="ii">(ii)</num><content> may be built in stages;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8c9178-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/B/iii"><num value="iii">(iii)</num><content> shall have a combined output of at least 100 megawatts;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8c9179-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/B/iv"><num value="iv">(iv)</num><content> shall be located in a western State at an altitude greater than 4,000 feet; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8c917a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/B/v"><num value="v">(v)</num><content> shall demonstrate the ability to use coal with an energy content of not more than 9,000 Btu/lb;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8c917b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/C"><num value="C">(C)</num><content> a project located in a taconite-producing region of the United States that is entitled under the law of the State in which the plant is located to enter into a long-term contract approved by a State public utility commission to sell at least 450 megawatts of output to a utility;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8c917c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/D"><num value="D">(D)</num><chapeau> facilities that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad8c917d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/D/i"><num value="i">(i)</num><content> generate one or more hydrogen-rich and carbon monoxide-rich product streams from the gasification of coal or coal waste; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8c917e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/D/ii"><num value="ii">(ii)</num><content> use those streams to facilitate the production of ultra clean premium fuels through the Fischer-Tropsch process; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8c917f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/E"><num value="E">(E)</num><chapeau> a project to produce energy and clean fuels, using appropriate coal liquefaction technology, from Western bituminous or subbituminous coal, that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad8c9180-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/E/i"><num value="i">(i)</num><content> is owned by a State government; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8c9181-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/1/E/ii"><num value="ii">(ii)</num><content> may include tribal and private coal resources.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8c9182-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Industrial gasification projects</heading><content><p style="-uslm-lc:I12" class="indent1">Facilities that gasify coal, biomass, or petroleum coke in any combination to produce synthesis gas for use as a fuel or feedstock and for which electricity accounts for less than 65 percent of the useful energy output of the facility.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8c9183-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Petroleum coke gasification projects</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary is encouraged to make loan guarantees under this subchapter available for petroleum coke gasification projects.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8cb894-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Liquefaction project</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of law, funds awarded under the Department of Energy’s Clean Coal Power Initiative for Fischer-Tropsch coal-to-oil liquefaction projects may be used to finance the cost of loan guarantees for projects awarded such funds.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8cb895-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/d"><num value="d" class="bold">(d)</num><heading class="bold"> Emission levels</heading><chapeau style="-uslm-lc:I11" class="indent0">In addition to any other applicable Federal or State emission limitation requirements, a project shall attain at least—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad8cb896-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/d/1"><num value="1">(1)</num><content> total sulfur dioxide emissions in flue gas from the project that do not exceed 0.05 lb/MMBtu;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8cb897-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/d/2"><num value="2">(2)</num><content> a 90-percent removal rate (including any fuel pretreatment) of mercury from the coal-derived gas, and any other fuel, combusted by the project;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8cb898-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/d/3"><num value="3">(3)</num><content> total nitrogen oxide emissions in the flue gas from the project that do not exceed 0.08 lb/MMBtu; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8cb899-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/d/4"><num value="4">(4)</num><content> total particulate emissions in the flue gas from the project that do not exceed 0.01 lb/MMBtu.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8cb89a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16513/e"><num value="e" class="bold">(e)</num><heading class="bold"> Qualification of facilities receiving tax credits</heading><content><p style="-uslm-lc:I11" class="indent0">A project that receives tax credits for clean coal technology shall not be disqualified from receiving a guarantee under this subchapter.</p>
