<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad8df124-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536"><num value="16536">§ 16536.</num><heading> Protecting America’s Competitive Edge (PACE) graduate fellowship program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8df125-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definition of eligible student</heading><content><p style="-uslm-lc:I11" class="indent0">In this section, the term “eligible student” means a student who attends an institution of higher education that offers a doctoral degree in a field relevant to a mission area of the Department.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8df126-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/b"><num value="b" class="bold">(b)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall establish a graduate fellowship program for eligible students pursuing a doctoral degree in a mission area of the Department.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8df127-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c"><num value="c" class="bold">(c)</num><heading class="bold"> Selection</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8df128-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall award fellowships to eligible students under this section through a competitive merit review process, involving written and oral interviews, that will result in a wide distribution of awards throughout the United States, as determined by the Secretary.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8df129-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Criteria</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall establish selection criteria for awarding fellowships under this section that require an eligible student—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8e183a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c/2/A"><num value="A">(A)</num><content> to pursue a field of science or engineering of importance to a mission area of the Department;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8e183b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c/2/B"><num value="B">(B)</num><chapeau> to demonstrate to the Secretary—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad8e183c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c/2/B/i"><num value="i">(i)</num><content> the capacity of the eligible student to understand technical topics relating to the fellowship that can be derived from the first principles of the technical topics;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8e183d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c/2/B/ii"><num value="ii">(ii)</num><content> imagination and creativity;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8e183e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c/2/B/iii"><num value="iii">(iii)</num><content> leadership skills in organizations or intellectual endeavors, demonstrated through awards and past experience; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8e183f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c/2/B/iv"><num value="iv">(iv)</num><content> excellent verbal and communication skills to explain, defend, and demonstrate an understanding of technical subjects relating to the fellowship; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8e1840-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/c/2/C"><num value="C">(C)</num><content> to be a citizen or legal permanent resident of the United States.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8e1841-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/d"><num value="d" class="bold">(d)</num><heading class="bold"> Awards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8e1842-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Amount</heading><chapeau style="-uslm-lc:I12" class="indent1">A fellowship awarded under this section shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad8e1843-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/d/1/A"><num value="A">(A)</num><content> provide an annual living stipend; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad8e1844-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/d/1/B"><num value="B">(B)</num><chapeau> cover—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad8e1845-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/d/1/B/i"><num value="i">(i)</num><content> graduate tuition at an institution of higher education described in subsection (a); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad8e1846-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/d/1/B/ii"><num value="ii">(ii)</num><content> incidental expenses associated with curricula and research at the institution of higher education (including books, computers, and software).</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8e1847-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Duration</heading><content><p style="-uslm-lc:I12" class="indent1">A fellowship awarded under this section shall be up to 3 years duration within a 5-year period.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad8e1848-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Portability</heading><content><p style="-uslm-lc:I12" class="indent1">A fellowship awarded under this section shall be portable with the eligible student.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8e1849-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/e"><num value="e" class="bold">(e)</num><heading class="bold"> Administration</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary, acting through the Director of Science, Engineering, and Mathematics Education—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad8e184a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/e/1"><num value="1">(1)</num><content> shall administer the program established under this section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8e184b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/e/2"><num value="2">(2)</num><content> may enter into a contract with a nonprofit entity to administer the program, including the selection and award of fellowships.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad8e184c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/f"><num value="f" class="bold">(f)</num><heading class="bold"> Authorization of appropriations</heading><chapeau style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated to carry out this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad8e184d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/f/1"><num value="1">(1)</num><content> $7,500,000 for fiscal year 2008;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8e184e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/f/2"><num value="2">(2)</num><content> $12,000,000 for fiscal year 2009, including nonexpiring fellowships for the preceding fiscal year;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8e184f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/f/3"><num value="3">(3)</num><content> $20,000,000 for fiscal year 2010, including nonexpiring fellowships for preceding fiscal years;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8e1850-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/f/4"><num value="4">(4)</num><content> $20,600,000 for fiscal year 2011;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8e1851-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/f/5"><num value="5">(5)</num><content> $21,200,000 for fiscal year 2012; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad8e1852-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16536/f/6"><num value="6">(6)</num><content> $21,900,000 for fiscal year 2013.</content>
