<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f8487-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Director</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Director” means the Director of ARPA-E appointed under subsection (d).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f8489-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/b"><num value="b" class="bold">(b)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">There is established the Advanced Research Projects Agency—Energy within the Department to overcome the long-term and high-risk technological barriers in the development of energy technologies.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f848a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c"><num value="c" class="bold">(c)</num><heading class="bold"> Goals</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f848b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The goals of ARPA-E shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f848c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/1/A"><num value="A">(A)</num><chapeau> to enhance the economic and energy security of the United States through the development of energy technologies that result in—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd92f848d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/1/A/i"><num value="i">(i)</num><content> reductions of imports of energy from foreign sources;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f848e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/1/A/ii"><num value="ii">(ii)</num><content> reductions of energy-related emissions, including greenhouse gases; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f848f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/1/A/iii"><num value="iii">(iii)</num><content> improvement in the energy efficiency of all economic sectors; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f8490-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/1/B"><num value="B">(B)</num><content> to ensure that the United States maintains a technological lead in developing and deploying advanced energy technologies.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f8491-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Means</heading><chapeau style="-uslm-lc:I12" class="indent1">ARPA-E shall achieve the goals established under paragraph (1) through energy technology projects by—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f8492-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/2/A"><num value="A">(A)</num><content> identifying and promoting revolutionary advances in fundamental and applied sciences;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f8493-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/2/B"><num value="B">(B)</num><content> translating scientific discoveries and cutting-edge inventions into technological innovations; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f8494-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/c/2/C"><num value="C">(C)</num><content> accelerating transformational technological advances in areas that industry by itself is not likely to undertake because of technical and financial uncertainty.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f8495-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/d"><num value="d" class="bold">(d)</num><heading class="bold"> Director</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f8496-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Appointment</heading><content><p style="-uslm-lc:I12" class="indent1">There shall be in the Department of Energy a Director of ARPA-E, who shall be appointed by the President, by and with the advice and consent of the Senate.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f8497-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Qualifications</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall be an individual who, by reason of professional background and experience, is especially qualified to advise the Secretary on, and manage research programs addressing, matters pertaining to long-term and high-risk technological barriers to the development of energy technologies.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f8498-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Relationship to Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall report to the Secretary.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f8499-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Relationship to other programs</heading><content><p style="-uslm-lc:I12" class="indent1">No other programs within the Department shall report to the Director.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f849a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e"><num value="e" class="bold">(e)</num><heading class="bold"> Responsibilities</heading><chapeau style="-uslm-lc:I11" class="indent0">The responsibilities of the Director shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd92f849b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/1"><num value="1">(1)</num><content> approving all new programs within ARPA-E;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92f849c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/2"><num value="2">(2)</num><content> developing funding criteria and assessing the success of programs through the establishment of technical milestones;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92f849d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/3"><num value="3">(3)</num><chapeau> administering the Fund through awards to institutions of higher education, companies, research foundations, trade and industry research collaborations, or consortia of such entities, which may include federally-funded research and development centers, to achieve the goals described in subsection (c) through targeted acceleration of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f849e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/3/A"><num value="A">(A)</num><content> novel early-stage energy research with possible technology applications;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f849f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/3/B"><num value="B">(B)</num><content> development of techniques, processes, and technologies, and related testing and evaluation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f84a0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/3/C"><num value="C">(C)</num><content> research and development of advanced manufacturing process and technologies for the domestic manufacturing of novel energy technologies; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f84a1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/3/D"><num value="D">(D)</num><content> coordination with nongovernmental entities for demonstration of technologies and research applications to facilitate technology transfer;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92f84a2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/4"><num value="4">(4)</num><content> terminating programs carried out under this section that are not achieving the goals of the programs; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92f84a3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/5"><num value="5">(5)</num><chapeau> pursuant to subsection (c)(2)(C)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f84a4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/5/A"><num value="A">(A)</num><content> ensuring that applications for funding disclose the extent of current and prior efforts, including monetary investments as appropriate, in pursuit of the technology area for which funding is being requested;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f84a5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/5/B"><num value="B">(B)</num><content> adopting measures to ensure that, in making awards, program managers adhere to the purposes of subsection (c)(2)(C); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f84a6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/e/5/C"><num value="C">(C)</num><content> providing as part of the annual report required by subsection (h)(1) a summary of the instances of and reasons for ARPA–E funding projects in technology areas already being undertaken by industry.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f84a7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/f"><num value="f" class="bold">(f)</num><heading class="bold"> Awards</heading><content><p style="-uslm-lc:I11" class="indent0">In carrying out this section, the Director may provide awards in the form of grants, contracts, cooperative agreements, cash prizes, and other transactions.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f84a8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g"><num value="g" class="bold">(g)</num><heading class="bold"> Personnel</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f84a9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall establish and maintain within ARPA–E a staff with sufficient qualifications and expertise to enable ARPA–E to carry out the responsibilities of ARPA–E under this section in conjunction with other operations of the Department.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f84aa-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Program directors</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd92f84ab-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Director shall designate employees to serve as program directors for the programs established pursuant to the responsibilities established for ARPA-E under subsection (e).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd92f84ac-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Responsibilities</heading><chapeau style="-uslm-lc:I13" class="indent2">A program director of a program shall be responsible for—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd92f84ad-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/i"><num value="i">(i)</num><content> establishing research and development goals for the program, including through the convening of workshops and conferring with outside experts, and publicizing the goals of the program to the public and private sectors;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f84ae-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/ii"><num value="ii">(ii)</num><content> soliciting applications for specific areas of particular promise, especially areas that the private sector or the Federal Government are not likely to undertake alone;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f84af-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/iii"><num value="iii">(iii)</num><content> building research collaborations for carrying out the program;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f84b0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/iv"><num value="iv">(iv)</num><chapeau> selecting on the basis of merit each of the projects to be supported under the program after considering—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd92f84b1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/iv/I"><num value="I">(I)</num><content> the novelty and scientific and technical merit of the proposed projects;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd92f84b2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/iv/II"><num value="II">(II)</num><content> the demonstrated capabilities of the applicants to successfully carry out the proposed project;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd92f84b3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/iv/III"><num value="III">(III)</num><content> the consideration by the applicant of future commercial applications of the project, including the feasibility of partnering with 1 or more commercial entities; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd92f84b4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/iv/IV"><num value="IV">(IV)</num><content> such other criteria as are established by the Director;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f84b5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/v"><num value="v">(v)</num><content> identifying innovative cost-sharing arrangements for ARPA–E projects, including through use of the authority provided under <ref href="/us/usc/t42/s16352/b/3">section 16352(b)(3) of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f84b6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/vi"><num value="vi">(vi)</num><content> monitoring the progress of projects supported under the program;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f84b7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/vii"><num value="vii">(vii)</num><content> identifying mechanisms for commercial application of successful energy technology development projects, including through establishment of partnerships between awardees and commercial entities; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f84b8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/B/viii"><num value="viii">(viii)</num><content> recommending program restructure or termination of research partnerships or whole projects.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd92f84b9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Term</heading><content><p style="-uslm-lc:I13" class="indent2">The term of a program manager shall be not more than 3 years and may be renewed.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f84ba-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Hiring and management</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd92f84bb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The Director shall have the authority to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd92f84bc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/A/i"><num value="i">(i)</num><content> make appointments of scientific, engineering, and professional personnel without regard to the civil service laws;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f84bd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/A/ii"><num value="ii">(ii)</num><content> fix the basic pay of such personnel at a rate to be determined by the Director at rates not in excess of Level II of the Executive Schedule (EX–II) without regard to the civil service laws; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd92f84be-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/A/iii"><num value="iii">(iii)</num><chapeau> pay any employee appointed under this subpart <ref class="footnoteRef" idref="fn004147">1</ref><note type="footnote" id="fn004147"><num>1</num> So in original.</note> payments in addition to basic pay, except that the total amount of additional payments paid to an employee under this subpart <ref class="footnoteRef" idref="fn004147">1</ref> for any 12-month period shall not exceed the least of the following amounts:</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd92f84bf-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/A/iii/I"><num value="I">(I)</num><content> $25,000.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd92f84c0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/A/iii/II"><num value="II">(II)</num><content> The amount equal to 25 percent of the annual rate of basic pay of the employee.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd92f84c1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/A/iii/III"><num value="III">(III)</num><content> The amount of the limitation that is applicable for a calendar year under <ref href="/us/usc/t5/s5307/a/1">section 5307(a)(1) of title 5</ref>.</content>

</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd92f84c2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Number</heading><content><p style="-uslm-lc:I13" class="indent2">The Director shall appoint not more than 120 personnel under this section.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd92f84c3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Private recruiting firms</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary, or the Director serving as an agent of the Secretary, may contract with private recruiting firms for the hiring of qualified technical staff to carry out this section.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd92f84c4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/g/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Additional staff</heading><content><p style="-uslm-lc:I13" class="indent2">The Director may use all authorities in existence on <date date="2007-08-09">August 9, 2007</date>, that are provided to the Secretary to hire administrative, financial, and clerical staff as necessary to carry out this section.</p>

</subsection>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f84d5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/l"><num value="l" class="bold">(l)</num><heading class="bold"> ARPA-E evaluation</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f84d6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/l/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">After ARPA-E has been in operation for 6 years, the Secretary shall offer to enter into a contract with the National Academy of Sciences under which the National Academy shall conduct an evaluation of how well ARPA-E is achieving the goals and mission of ARPA-E.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f84d7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/l/2"><num value="2" class="bold">(2)</num><heading class="bold"> Inclusions</heading><chapeau style="-uslm-lc:I12" class="indent1">The evaluation shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f84d8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/l/2/A"><num value="A">(A)</num><content> the recommendation of the National Academy of Sciences on whether ARPA-E should be continued or terminated; and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f84d9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/l/2/B"><num value="B">(B)</num><content> a description of lessons learned from operation of ARPA-E, and the manner in which those lessons may apply to the operation of other programs of the Department.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f84da-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/l/3"><num value="3" class="bold">(3)</num><heading class="bold"> Availability</heading><content><p style="-uslm-lc:I12" class="indent1">On completion of the evaluation, the evaluation shall be made available to Congress and the public.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f84db-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/m"><num value="m" class="bold">(m)</num><heading class="bold"> Existing authorities</heading><chapeau style="-uslm-lc:I11" class="indent0">The authorities granted by this section are—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd92f84dc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/m/1"><num value="1">(1)</num><content> in addition to existing authorities granted to the Secretary; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92f84dd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/m/2"><num value="2">(2)</num><content> are not intended to supersede or modify any existing authorities.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f84de-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/n"><num value="n" class="bold">(n)</num><heading class="bold"> Protection of information</heading><chapeau style="-uslm-lc:I11" class="indent0">The following types of information collected by ARPA–E from recipients of financial assistance awards shall be considered commercial and financial information obtained from a person and privileged or confidential and not subject to disclosure under <ref href="/us/usc/t5/s552/b/4">section 552(b)(4) of title 5</ref>:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd92f84df-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/n/1"><num value="1">(1)</num><content> Plans for commercialization of technologies developed under the award, including business plans, technology-to-market plans, market studies, and cost and performance models.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92f84e0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/n/2"><num value="2">(2)</num><content> Investments provided to an awardee from third parties (such as venture capital firms, hedge funds, and private equity firms), including amounts and the percentage of ownership of the awardee provided in return for the investments.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd92f84e1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/n/3"><num value="3">(3)</num><chapeau> Additional financial support that the awardee—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f84e2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/n/3/A"><num value="A">(A)</num><content> plans to or has invested into the technology developed under the award; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd92f84e3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/n/3/B"><num value="B">(B)</num><content> is seeking from third parties.</content>
</subparagraph>

<paragraph style="-uslm-lc:I12" class="indent1" id="idd92f84e4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/n/4"><num value="4">(4)</num><content> Revenue from the licensing or sale of new products or services resulting from research conducted under the award.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd92f84e5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/o"><num value="o" class="bold">(o)</num><heading class="bold"> Funding</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd92f84e6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16538/o/1"><num value="1" class="bold">(1)</num><heading class="bold"> Fund</heading><content><p style="-uslm-lc:I12" class="indent1">There is established in the Treasury of the United States a fund, to be known as the “Energy Transformation Acceleration Fund”, which shall be administered by the Director for the purposes of carrying out this section.</p>
