<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad9125e6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011"><num value="17011">§ 17011.</num><heading> Transportation electrification</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad9125e7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad9125e8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Administrator</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Administrator” means the Administrator of the Environmental Protection Agency.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad9125e9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Battery</heading><content><p style="-uslm-lc:I12" class="indent1">The term “battery” means an electrochemical energy storage system powered directly by electrical current.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad9125ea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Electric transportation technology</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “electric transportation technology” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125eb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/3/A"><num value="A">(A)</num><content> technology used in vehicles that use an electric motor for all or part of the motive power of the vehicles, including battery electric, hybrid electric, plug-in hybrid electric, fuel cell, and plug-in fuel cell vehicles, or rail transportation; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125ec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/3/B"><num value="B">(B)</num><chapeau> equipment relating to transportation or mobile sources of air pollution that use an electric motor to replace an internal combustion engine for all or part of the work of the equipment, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad9125ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/3/B/i"><num value="i">(i)</num><content> corded electric equipment linked to transportation or mobile sources of air pollution; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad9125ee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/3/B/ii"><num value="ii">(ii)</num><content> electrification technologies at airports, ports, truck stops, and material-handling facilities.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad9125ef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Nonroad vehicle</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “nonroad vehicle” means a vehicle—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125f0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/4/A"><num value="A">(A)</num><chapeau> powered—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad9125f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/4/A/i"><num value="i">(i)</num><content> by a nonroad engine, as that term is defined in <ref href="/us/usc/t42/s7550">section 7550 of this title</ref>; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad9125f2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/4/A/ii"><num value="ii">(ii)</num><content> fully or partially by an electric motor powered by a fuel cell, a battery, or an off-board source of electricity; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/4/B"><num value="B">(B)</num><content> that is not a motor vehicle or a vehicle used solely for competition.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad9125f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Plug-in electric drive vehicle</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “plug-in electric drive vehicle” means a vehicle that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125f5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/5/A"><num value="A">(A)</num><content> draws motive power from a battery with a capacity of at least 4 kilowatt-hours;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/5/B"><num value="B">(B)</num><content> can be recharged from an external source of electricity for motive power; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/5/C"><num value="C">(C)</num><content> is a light-, medium-, or heavy-duty motor vehicle or nonroad vehicle (as those terms are defined in <ref href="/us/usc/t42/s7550">section 7550 of this title</ref>).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad9125f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Qualified electric transportation project</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “qualified electric transportation project” means an electric transportation technology project that would significantly reduce emissions of criteria pollutants, greenhouse gas emissions, and petroleum, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125f9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6/A"><num value="A">(A)</num><content> shipside or shoreside electrification for vessels;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6/B"><num value="B">(B)</num><content> truck-stop electrification;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6/C"><num value="C">(C)</num><content> electric truck refrigeration units;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad9125fc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6/D"><num value="D">(D)</num><content> battery-powered auxiliary power units for trucks;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad914d0d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6/E"><num value="E">(E)</num><content> electric airport ground support equipment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad914d0e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6/F"><num value="F">(F)</num><content> electric material and cargo handling equipment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad914d0f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6/G"><num value="G">(G)</num><content> electric or dual-mode electric rail;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad914d10-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6/H"><num value="H">(H)</num><content> any distribution upgrades needed to supply electricity to the project; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad914d11-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/a/6/I"><num value="I">(I)</num><content> any ancillary infrastructure, including panel upgrades, battery chargers, in-situ transformers, and trenching.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad914d12-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b"><num value="b" class="bold">(b)</num><heading class="bold"> Plug-in electric drive vehicle program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d13-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish a competitive program to provide grants on a cost-shared basis to State governments, local governments, metropolitan transportation authorities, air pollution control districts, private or nonprofit entities, or combinations of those governments, authorities, districts, and entities, to carry out one or more projects to encourage the use of plug-in electric drive vehicles or other emerging electric vehicle technologies, as determined by the Secretary.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d14-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Administration</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall, in consultation with the Secretary of Transportation and the Administrator, establish requirements for applications for grants under this section, including reporting of data to be summarized for dissemination to grantees and the public, including safety, vehicle, and component performance, and vehicle and component life cycle costs.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d15-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Priority</heading><chapeau style="-uslm-lc:I12" class="indent1">In making awards under this subsection, the Secretary shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad914d16-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/3/A"><num value="A">(A)</num><chapeau> give priority consideration to applications that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad914d17-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/3/A/i"><num value="i">(i)</num><content> encourage early widespread use of vehicles described in paragraph (1); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad914d18-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/3/A/ii"><num value="ii">(ii)</num><content> are likely to make a significant contribution to the advancement of the production of the vehicles in the United States; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad914d19-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/3/B"><num value="B">(B)</num><content> ensure, to the maximum extent practicable, that the program established under this subsection includes a variety of applications, manufacturers, and end-uses.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d1a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Reporting</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall require a grant recipient under this subsection to submit to the Secretary, on an annual basis, data relating to safety, vehicle performance, life cycle costs, and emissions of vehicles demonstrated under the grant, including emissions of greenhouse gases.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d1b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Cost sharing</heading><content><p style="-uslm-lc:I12" class="indent1"><ref href="/us/usc/t42/s16352">Section 16352 of this title</ref> shall apply to a grant made under this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d1c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/b/6"><num value="6" class="bold">(6)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">There is authorized to be appropriated to carry out this subsection $90,000,000 for each of fiscal years 2008 through 2012, of which not less than ⅓ of the total amount appropriated shall be available each fiscal year to make grants to local and municipal governments.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad914d1d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/c"><num value="c" class="bold">(c)</num><heading class="bold"> Near-term transportation sector electrification program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d1e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 1 year after <date date="2007-12-19">December 19, 2007</date>, the Secretary, in consultation with the Secretary of Transportation and the Administrator, shall establish a program to provide grants for the conduct of qualified electric transportation projects.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d1f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Priority</heading><content><p style="-uslm-lc:I12" class="indent1">In providing grants under this subsection, the Secretary shall give priority to large-scale projects and large-scale aggregators of projects.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d20-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Cost sharing</heading><content><p style="-uslm-lc:I12" class="indent1"><ref href="/us/usc/t42/s16352">Section 16352 of this title</ref> shall apply to a grant made under this subsection.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d21-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">There is authorized to be appropriated to carry out this subsection $95,000,000 for each of fiscal years 2008 through 2013.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad914d22-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/d"><num value="d" class="bold">(d)</num><heading class="bold"> Education program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d23-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall develop a nationwide electric drive transportation technology education program under which the Secretary shall provide—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad914d24-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/d/1/A"><num value="A">(A)</num><content> teaching materials to secondary schools and high schools; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad914d25-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/d/1/B"><num value="B">(B)</num><content> assistance for programs relating to electric drive system and component engineering to institutions of higher education.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad914d26-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Electric vehicle competition</heading><content><p style="-uslm-lc:I12" class="indent1">The program established under paragraph (1) shall include a plug-in hybrid electric vehicle competition for institutions of higher education, which shall be known as the “Dr. Andrew Frank Plug-In Electric Vehicle Competition”.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad917337-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Engineers</heading><chapeau style="-uslm-lc:I12" class="indent1">In carrying out the program established under paragraph (1), the Secretary shall provide financial assistance to institutions of higher education to create new, or support existing, degree programs to ensure the availability of trained electrical and mechanical engineers with the skills necessary for the advancement of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad917338-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/d/3/A"><num value="A">(A)</num><content> plug-in electric drive vehicles; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad917339-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/d/3/B"><num value="B">(B)</num><content> other forms of electric drive transportation technology vehicles.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad91733a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17011/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">There are authorized to be appropriated such sums as may be necessary to carry out this subsection.</p>
