<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd9343df2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013"><num value="17013">§ 17013.</num><heading> Advanced technology vehicles manufacturing incentive program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343df3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343df4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Advanced technology vehicle</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “advanced technology vehicle” means an ultra efficient vehicle or a light duty vehicle that meets—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343df5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/1/A"><num value="A">(A)</num><content> the Bin 5 Tier II emission standard established in regulations issued by the Administrator of the Environmental Protection Agency under section 202(i) of the Clean Air Act (<ref href="/us/usc/t42/s7521/i">42 U.S.C. 7521(i)</ref>), or a lower-numbered Bin emission standard;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343df6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/1/B"><num value="B">(B)</num><content> any new emission standard in effect for fine particulate matter prescribed by the Administrator under that Act (<ref href="/us/usc/t42/s7401">42 U.S.C. 7401</ref> et seq.); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343df7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/1/C"><num value="C">(C)</num><content> at least 125 percent of the average base year combined fuel economy for vehicles with substantially similar attributes.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343df8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Combined fuel economy</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “combined fuel economy” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343df9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/2/A"><num value="A">(A)</num><content> the combined city/highway miles per gallon values, as reported in accordance with <ref href="/us/usc/t49/s32904">section 32904 of title 49</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343dfa-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/2/B"><num value="B">(B)</num><content> in the case of an electric drive vehicle with the ability to recharge from an off-board source, the reported mileage, as determined in a manner consistent with the Society of Automotive Engineers recommended practice for that configuration or a similar practice recommended by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343dfb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Engineering integration costs</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “engineering integration costs” includes the cost of engineering tasks relating to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343dfc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/3/A"><num value="A">(A)</num><content> incorporating qualifying components into the design of advanced technology vehicles; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343dfd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/3/B"><num value="B">(B)</num><content> designing tooling and equipment and developing manufacturing processes and material suppliers for production facilities that produce qualifying components or advanced technology vehicles.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343dfe-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Qualifying components</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “qualifying components” means components that the Secretary determines to be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343dff-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/4/A"><num value="A">(A)</num><content> designed for advanced technology vehicles; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e00-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/4/B"><num value="B">(B)</num><content> installed for the purpose of meeting the performance requirements of advanced technology vehicles.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343e01-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Ultra efficient vehicle</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “ultra efficient vehicle” means a fully closed compartment vehicle designed to carry at least 2 adult passengers that achieves—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e02-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/5/A"><num value="A">(A)</num><content> at least 75 miles per gallon while operating on gasoline or diesel fuel;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e03-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/5/B"><num value="B">(B)</num><content> at least 75 miles per gallon equivalent while operating as a hybrid electric-gasoline or electric-diesel vehicle; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e04-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/a/5/C"><num value="C">(C)</num><content> at least 75 miles per gallon equivalent while operating as a fully electric vehicle.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343e05-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/b"><num value="b" class="bold">(b)</num><heading class="bold"> Advanced vehicles manufacturing facility</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall provide facility funding awards under this section to automobile manufacturers, ultra efficient vehicle manufacturers, and component suppliers to pay not more than 30 percent of the cost of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd9343e06-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/b/1"><num value="1">(1)</num><chapeau> reequipping, expanding, or establishing a manufacturing facility in the United States to produce—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e07-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/b/1/A"><num value="A">(A)</num><content> qualifying advanced technology vehicles;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e08-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/b/1/B"><num value="B">(B)</num><content> qualifying components; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e09-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/b/1/C"><num value="C">(C)</num><content> ultra efficient vehicles; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9343e0a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/b/2"><num value="2">(2)</num><content> engineering integration performed in the United States of qualifying vehicles, ultra efficient vehicles, and qualifying components.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343e0b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/c"><num value="c" class="bold">(c)</num><heading class="bold"> Period of availability</heading><chapeau style="-uslm-lc:I11" class="indent0">An award under subsection (b) shall apply to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd9343e0c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/c/1"><num value="1">(1)</num><content> facilities and equipment placed in service before <date date="2020-12-30">December 30, 2020</date>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9343e0d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/c/2"><num value="2">(2)</num><content> engineering integration costs incurred during the period beginning on <date date="2007-12-19">December 19, 2007</date>, and ending on <date date="2020-12-30">December 30, 2020</date>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343e0e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d"><num value="d" class="bold">(d)</num><heading class="bold"> Direct loan program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343e0f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 1 year after <date date="2007-12-19">December 19, 2007</date>, and subject to the availability of appropriated funds, the Secretary shall carry out a program to provide a total of not more than $25,000,000,000 in loans to eligible individuals and entities (as determined by the Secretary) for the costs of activities described in subsection (b). The loans shall be made through the Federal Financing Bank, with the full faith and credit of the United States Government on the principal and interest. The full credit subsidy shall be paid by the Secretary using appropriated funds.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343e10-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Application</heading><chapeau style="-uslm-lc:I12" class="indent1">An applicant for a loan under this subsection shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a written assurance that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e11-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/2/A"><num value="A">(A)</num><content> all laborers and mechanics employed by contractors or subcontractors during construction, alteration, or repair that is financed, in whole or in part, by a loan under this section shall be paid wages at rates not less than those prevailing on similar construction in the locality, as determined by the Secretary of Labor in accordance with sections 3141–3144, 3146, and 3147 of title 40; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e12-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/2/B"><num value="B">(B)</num><content> the Secretary of Labor shall, with respect to the labor standards described in this paragraph, have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (5 U.S.C. App.) and <ref href="/us/usc/t40/s3145">section 3145 of title 40</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343e13-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Selection of eligible projects</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall select eligible projects to receive loans under this subsection in cases in which, as determined by the Secretary, the award recipient—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e14-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/3/A"><num value="A">(A)</num><content> is financially viable without the receipt of additional Federal funding associated with the proposed project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e15-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/3/B"><num value="B">(B)</num><content> will provide sufficient information to the Secretary for the Secretary to ensure that the qualified investment is expended efficiently and effectively; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e16-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/3/C"><num value="C">(C)</num><content> has met such other criteria as may be established and published by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343e17-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Rates, terms, and repayment of loans</heading><chapeau style="-uslm-lc:I12" class="indent1">A loan provided under this subsection—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e18-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/4/A"><num value="A">(A)</num><content> shall have an interest rate that, as of the date on which the loan is made, is equal to the cost of funds to the Department of the Treasury for obligations of comparable maturity;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e19-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/4/B"><num value="B">(B)</num><chapeau> shall have a term equal to the lesser of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd9343e1a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/4/B/i"><num value="i">(i)</num><content> the projected life, in years, of the eligible project to be carried out using funds from the loan, as determined by the Secretary; and <ref class="footnoteRef" idref="fn004149">1</ref><note type="footnote" id="fn004149"><num>1</num> So in original. Probably should be “or”.</note></content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9343e1b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/4/B/ii"><num value="ii">(ii)</num><content> 25 years;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e1c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/4/C"><num value="C">(C)</num><content> may be subject to a deferral in repayment for not more than 5 years after the date on which the eligible project carried out using funds from the loan first begins operations, as determined by the Secretary; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e1d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/d/4/D"><num value="D">(D)</num><content> shall be made by the Federal Financing Bank.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343e1e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/e"><num value="e" class="bold">(e)</num><heading class="bold"> Improvement</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 60 days after <date date="2008-09-30">September 30, 2008</date>, the Secretary shall promulgate an interim final rule establishing regulations that the Secretary deems necessary to administer this section and any loans made by the Secretary pursuant to this section. Such interim final rule shall require that, in order for an automobile manufacturer to be eligible for an award or loan under this section during a particular year, the adjusted average fuel economy of the manufacturer for light duty vehicles produced by the manufacturer during the most recent year for which data are available shall be not less than the average fuel economy for all light duty vehicles of the manufacturer for model year 2005. In order to determine fuel economy baselines for eligibility of a new manufacturer or a manufacturer that has not produced previously produced equivalent vehicles, the Secretary may substitute industry averages.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343e1f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/f"><num value="f" class="bold">(f)</num><heading class="bold"> Fees</heading><content><p style="-uslm-lc:I11" class="indent0">Administrative costs shall be no more than $100,000 or 10 basis point <ref class="footnoteRef" idref="fn004150">2</ref><note type="footnote" id="fn004150"><num>2</num> So in original. Probably should be “points”.</note> of the loan.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343e20-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/g"><num value="g" class="bold">(g)</num><heading class="bold"> Priority</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall, in making awards or loans to those manufacturers that have existing facilities, give priority to those facilities that are oldest or have been in existence for at least 20 years or are utilized primarily for the manufacture of ultra efficient vehicles. Such facilities can currently be sitting idle.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343e21-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/h"><num value="h" class="bold">(h)</num><heading class="bold"> Set aside for small automobile manufacturers and component suppliers</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343e22-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definition of covered firm</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection, the term “covered firm” means a firm that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e23-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/h/1/A"><num value="A">(A)</num><content> employs less than 500 individuals; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9343e24-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/h/1/B"><num value="B">(B)</num><content> manufactures ultra efficient vehicles, automobiles, or components of automobiles.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9343e25-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Set aside</heading><content><p style="-uslm-lc:I12" class="indent1">Of the amount of funds that are used to provide awards for each fiscal year under subsection (b), the Secretary shall use not less than 10 percent to provide awards to covered firms or consortia led by a covered firm.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343e26-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/i"><num value="i" class="bold">(i)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated such sums as are necessary to carry out this section for each of fiscal years 2008 through 2012.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9343e27-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/j"><num value="j" class="bold">(j)</num><heading class="bold"> Appointment and pay of personnel</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idd9343e28-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/j/1"><num value="1">(1)</num><content> The Secretary may use direct hiring authority pursuant to <ref href="/us/usc/t5/s3304/a/3">section 3304(a)(3) of title 5</ref> to appoint such professional and administrative personnel as the Secretary deems necessary to the discharge of the Secretary’s functions under this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd9343e29-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17013/j/2"><num value="2">(2)</num><content> The rate of pay for a person appointed pursuant to paragraph (1) shall not exceed the maximum rate payable for GS-15 of the General Schedule under chapter 53 such <ref class="footnoteRef" idref="fn004151">3</ref><note type="footnote" id="fn004151"><num>3</num> So in original.
