L. 110–140, title II, § 223, Dec. 19, 2007, 121 Stat. 1533.)","seq_in_title":7759,"parent_identifier":"/us/usc/t42/ch152/schII/ptB","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch152","level":"chapter","num":"CHAPTER 152—","heading":"ENERGY INDEPENDENCE AND SECURITY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch152/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"ENERGY SECURITY THROUGH INCREASED PRODUCTION OF BIOFUELS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch152/schII/ptB","level":"part","num":"Part B—","heading":"Biofuels Research and Development","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad923706-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s17032\"><num value=\"17032\">§ 17032.</num><heading> Grants for biofuel production research and development in certain States</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad923707-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s17032/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall provide grants to eligible entities for research, development, demonstration, and commercial application of biofuel production technologies in States with low rates of ethanol production, including low rates of production of cellulosic biomass ethanol, as determined by the Secretary.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad923708-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s17032/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Eligibility</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">To be eligible to receive a grant under this section, an entity shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad923709-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s17032/b/1\"><num value=\"1\">(1)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad92370a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s17032/b/1/A\"><num value=\"A\">(A)</num><content> be an institution of higher education (as defined in <ref href=\"/us/usc/t42/s15801\">section 15801 of this title</ref>), including tribally controlled colleges or universities, located in a State described in subsection (a); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad92370b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s17032/b/1/B\"><num value=\"B\">(B)</num><content> be a consortium including at least 1 such institution of higher education and industry, State agencies, Indian tribal agencies, National Laboratories, or local government agencies located in the State; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad92370c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s17032/b/2\"><num value=\"2\">(2)</num><content> have proven experience and capabilities with relevant technologies.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad92370d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s17032/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There are authorized to be appropriated to the Secretary to carry out this section $25,000,000 for each of fiscal years 2008 through 2010.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idad92370e-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/110/140/tII/s223\">Pub.
