<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad925e53-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17051"><num value="17051">§ 17051.</num><heading> Renewable fuel dispenser requirements</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad925e54-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17051/a"><num value="a" class="bold">(a)</num><heading class="bold"> Market penetration reports</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary, in consultation with the Secretary of Transportation, shall determine and report to Congress annually on the market penetration for flexible-fuel vehicles in use within geographic regions to be established by the Secretary.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad928565-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17051/b"><num value="b" class="bold">(b)</num><heading class="bold"> Dispenser feasibility study</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 24 months after <date date="2007-12-19">December 19, 2007</date>, the Secretary, in consultation with the Department of Transportation, shall report to the Congress on the feasibility of requiring motor fuel retailers to install E–85 compatible dispensers and related systems at retail fuel facilities in regions where flexible-fuel vehicle market penetration has reached 15 percent of motor vehicles. In conducting such study, the Secretary shall consider and report on the following factors:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad928566-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17051/b/1"><num value="1">(1)</num><content> The commercial availability of E–85 fuel and the number of competing E–85 wholesale suppliers in a given region.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idad928567-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17051/b/2"><num value="2">(2)</num><content> The level of financial assistance provided on an annual basis by the Federal Government, State governments, and nonprofit entities for the installation of E–85 compatible infrastructure.</content>
