L. 110–140, title IV, § 401, Dec. 19, 2007, 121 Stat. 1596.)","seq_in_title":7767,"parent_identifier":"/us/usc/t42/ch152/schIII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch152","level":"chapter","num":"CHAPTER 152—","heading":"ENERGY INDEPENDENCE AND SECURITY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch152/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"ENERGY SAVINGS IN BUILDINGS AND INDUSTRY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idd9343f05-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061\"><num value=\"17061\">§ 17061.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this title: <ref class=\"footnoteRef\" idref=\"fn004152\">1</ref><note type=\"footnote\" id=\"fn004152\"><num>1</num> See References in Text note below.</note></chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f06-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Administrator</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Administrator” means the Administrator of General Services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f07-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Advisory Committee</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Advisory Committee” means the Green Building Advisory Committee established under section 484.<sup>1</sup></p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f08-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Commercial Director</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Commercial Director” means the individual appointed to the position established under <ref href=\"/us/usc/t42/s17081\">section 17081 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f09-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Consortium</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Consortium” means the High-Performance Green Building Partnership Consortium created in response to <ref href=\"/us/usc/t42/s17092/c/1\">section 17092(c)(1) of this title</ref> to represent the private sector in a public-private partnership to promote high-performance green buildings and zero-net-energy commercial buildings.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f0a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Cost-effective lighting technology</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9343f0b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “cost-effective lighting technology” means a lighting technology that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f0c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/A/i\"><num value=\"i\">(i)</num><content> will result in substantial operational cost savings by ensuring an installed consumption of not more than 1 watt per square foot; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f0d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/A/ii\"><num value=\"ii\">(ii)</num><chapeau> is contained in a list under—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd9343f0e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/A/ii/I\"><num value=\"I\">(I)</num><content> <ref href=\"/us/usc/t42/s8259b\">section 8259b of this title</ref>;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd9343f0f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/A/ii/II\"><num value=\"II\">(II)</num><content> Federal acquisition regulation 23–203; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd9343f10-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/A/ii/III\"><num value=\"III\">(III)</num><content> is at least as energy-conserving as required by other provisions of this Act, including the requirements of this title <sup>1</sup> and title III <sup>1</sup> which shall be applicable to the extent that they would achieve greater energy savings than provided under clause (i) or this clause.<ref class=\"footnoteRef\" idref=\"fn004153\">2</ref><note type=\"footnote\" id=\"fn004153\"><num>2</num> So in original. Does not fit with cl. (ii) introductory provision.</note></content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9343f11-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Inclusions</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “cost-effective lighting technology” includes—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f12-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/B/i\"><num value=\"i\">(i)</num><content> lamps;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f13-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/B/ii\"><num value=\"ii\">(ii)</num><content> ballasts;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f14-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/B/iii\"><num value=\"iii\">(iii)</num><content> luminaires;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f15-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/B/iv\"><num value=\"iv\">(iv)</num><content> lighting controls;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f16-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/B/v\"><num value=\"v\">(v)</num><content> daylighting; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f17-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/5/B/vi\"><num value=\"vi\">(vi)</num><content> early use of other highly cost-effective lighting technologies.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f18-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Cost-effective technologies and practices</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “cost-effective technologies and practices” means a technology or practice that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f19-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/6/A\"><num value=\"A\">(A)</num><content> will result in substantial operational cost savings by reducing electricity or fossil fuel consumption, water, or other utility costs, including use of geothermal heat pumps;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f1a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/6/B\"><num value=\"B\">(B)</num><content> complies with the provisions of <ref href=\"/us/usc/t42/s8259b\">section 8259b of this title</ref> and Federal acquisition regulation 23–203; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f1b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/6/C\"><num value=\"C\">(C)</num><content> is at least as energy and water conserving as required under this title,<sup>1</sup> including sections 431 through 435, and title V,<sup>1</sup> including sections 511 through 525, which shall be applicable to the extent that they are more stringent or require greater energy or water savings than required by this section.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f1c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Federal Director</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Federal Director” means the individual appointed to the position established under <ref href=\"/us/usc/t42/s17092/a\">section 17092(a) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f1d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Federal facility</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Federal facility” means any building that is constructed, renovated, leased, or purchased in part or in whole for use by the Federal Government.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f1e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Operational cost savings</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9343f1f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/9/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “operational cost savings” means a reduction in end-use operational costs through the application of cost-effective technologies and practices or geothermal heat pumps, including a reduction in electricity consumption relative to consumption by the same customer or at the same facility in a given year, as defined in guidelines promulgated by the Administrator pursuant to <ref href=\"/us/usc/t42/s7628/b\">section 7628(b) of this title</ref>, that achieves cost savings sufficient to pay the incremental additional costs of using cost-effective technologies and practices including geothermal heat pumps by not later than the later of the date established under sections 431 through 434,<sup>1</sup> or—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f20-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/9/A/i\"><num value=\"i\">(i)</num><content> for cost-effective technologies and practices, the date that is 5 years after the date of installation; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f21-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/9/A/ii\"><num value=\"ii\">(ii)</num><content> for geothermal heat pumps, as soon as practical after the date of installation of the applicable geothermal heat pump.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9343f22-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/9/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Inclusions</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “operational cost savings” includes savings achieved at a facility as a result of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f23-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/9/B/i\"><num value=\"i\">(i)</num><content> the installation or use of cost-effective technologies and practices; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f24-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/9/B/ii\"><num value=\"ii\">(ii)</num><content> the planting of vegetation that shades the facility and reduces the heating, cooling, or lighting needs of the facility.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9343f25-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/9/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Exclusion</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “operational cost savings” does not include savings from measures that would likely be adopted in the absence of cost-effective technology and practices programs, as determined by the Administrator.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f26-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Geothermal heat pump</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “geothermal heat pump” means any heating or air conditioning technology that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f27-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/10/A\"><num value=\"A\">(A)</num><content> uses the ground or ground water as a thermal energy source to heat, or as a thermal energy sink to cool, a building; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f28-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/10/B\"><num value=\"B\">(B)</num><content> meets the requirements of the Energy Star program of the Environmental Protection Agency applicable to geothermal heat pumps on the date of purchase of the technology.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f29-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> GSA facility</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9343f2a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/11/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “GSA facility” means any building, structure, or facility, in whole or in part (including the associated support systems of the building, structure, or facility) that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f2b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/11/A/i\"><num value=\"i\">(i)</num><content> is constructed (including facilities constructed for lease), renovated, or purchased, in whole or in part, by the Administrator for use by the Federal Government; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f2c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/11/A/ii\"><num value=\"ii\">(ii)</num><chapeau> is leased, in whole or in part, by the Administrator for use by the Federal Government—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd9343f2d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/11/A/ii/I\"><num value=\"I\">(I)</num><content> except as provided in subclause (II), for a term of not less than 5 years; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd9343f2e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/11/A/ii/II\"><num value=\"II\">(II)</num><content> for a term of less than 5 years, if the Administrator determines that use of cost-effective technologies and practices would result in the payback of expenses.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9343f2f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/11/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Inclusion</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “GSA facility” includes any group of buildings, structures, or facilities described in subparagraph (A) (including the associated energy-consuming support systems of the buildings, structures, and facilities).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9343f30-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/11/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Exemption</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Administrator may exempt from the definition of “GSA facility” under this paragraph a building, structure, or facility that meets the requirements of <ref href=\"/us/usc/t42/s8253/c\">section 8253(c) of this title</ref>.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f31-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/12\"><num value=\"12\" class=\"bold\">(12)</num><heading class=\"bold\"> High-performance building</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “high-performance building” means a building that integrates and optimizes on a life cycle basis all major high performance attributes, including energy conservation, environment, safety, security, durability, accessibility, cost-benefit, productivity, sustainability, functionality, and operational considerations.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f32-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13\"><num value=\"13\" class=\"bold\">(13)</num><heading class=\"bold\"> High-performance green building</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “high-performance green building” means a high-performance building that, during its life-cycle, as compared with similar buildings (as measured by Commercial Buildings Energy Consumption Survey or Residential Energy Consumption Survey data from the Energy Information Agency)—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f33-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/A\"><num value=\"A\">(A)</num><content> reduces energy, water, and material resource use;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f34-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/B\"><num value=\"B\">(B)</num><content> improves indoor environmental quality, including reducing indoor pollution, improving thermal comfort, and improving lighting and acoustic environments that affect occupant health and productivity;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f35-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/C\"><num value=\"C\">(C)</num><content> reduces negative impacts on the environment throughout the life-cycle of the building, including air and water pollution and waste generation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f36-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/D\"><num value=\"D\">(D)</num><content> increases the use of environmentally preferable products, including biobased, recycled content, and nontoxic products with lower life-cycle impacts;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f37-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/E\"><num value=\"E\">(E)</num><content> increases reuse and recycling opportunities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f38-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/F\"><num value=\"F\">(F)</num><content> integrates systems in the building;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f39-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/G\"><num value=\"G\">(G)</num><content> reduces the environmental and energy impacts of transportation through building location and site design that support a full range of transportation choices for users of the building; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f3a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/H\"><num value=\"H\">(H)</num><chapeau> considers indoor and outdoor effects of the building on human health and the environment, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f3b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/H/i\"><num value=\"i\">(i)</num><content> improvements in worker productivity;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f3c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/H/ii\"><num value=\"ii\">(ii)</num><content> the life-cycle impacts of building materials and operations; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f3d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/13/H/iii\"><num value=\"iii\">(iii)</num><content> other factors that the Federal Director or the Commercial Director consider to be appropriate.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f3e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/14\"><num value=\"14\" class=\"bold\">(14)</num><heading class=\"bold\"> Life-cycle</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “life-cycle”, with respect to a high-performance green building, means all stages of the useful life of the building (including components, equipment, systems, and controls of the building) beginning at conception of a high-performance green building project and continuing through site selection, design, construction, landscaping, commissioning, operation, maintenance, renovation, deconstruction or demolition, removal, and recycling of the high-performance green building.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f3f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/15\"><num value=\"15\" class=\"bold\">(15)</num><heading class=\"bold\"> Life-cycle assessment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “life-cycle assessment” means a comprehensive system approach for measuring the environmental performance of a product or service over the life of the product or service, beginning at raw materials acquisition and continuing through manufacturing, transportation, installation, use, reuse, and end-of-life waste management.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f40-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/16\"><num value=\"16\" class=\"bold\">(16)</num><heading class=\"bold\"> Life-cycle costing</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “life-cycle costing”, with respect to a high-performance green building, means a technique of economic evaluation that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f41-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/16/A\"><num value=\"A\">(A)</num><content> sums, over a given study period, the costs of initial investment (less resale value), replacements, operations (including energy use), and maintenance and repair of an investment decision; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f42-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/16/B\"><num value=\"B\">(B)</num><chapeau> is expressed—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f43-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/16/B/i\"><num value=\"i\">(i)</num><content> in present value terms, in the case of a study period equivalent to the longest useful life of the building, determined by taking into consideration the typical life of such a building in the area in which the building is to be located; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9343f44-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/16/B/ii\"><num value=\"ii\">(ii)</num><content> in annual value terms, in the case of any other study period.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9343f45-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/17\"><num value=\"17\" class=\"bold\">(17)</num><heading class=\"bold\"> Office of Commercial High-Performance Green Buildings</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Office of Commercial High-Performance Green Buildings” means the Office of Commercial High-Performance Green Buildings established under <ref class=\"indent1\">The term “zero-net-energy commercial building” means a commercial building that is designed, constructed, and operated to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f49-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/20/A\"><num value=\"A\">(A)</num><content> require a greatly reduced quantity of energy to operate;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f4a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/20/B\"><num value=\"B\">(B)</num><content> meet the balance of energy needs from sources of energy that do not produce greenhouse gases;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f4b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/20/C\"><num value=\"C\">(C)</num><content> therefore result in no net emissions of greenhouse gases; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd9343f4c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s17061/20/D\"><num
