<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd9368871-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071"><num value="17071">§ 17071.</num><heading> Energy Code improvements applicable to manufactured housing</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368872-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment of standards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9368873-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 4 years after <date date="2007-12-19">December 19, 2007</date>, the Secretary shall by regulation establish standards for energy efficiency in manufactured housing.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9368874-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Notice, comment, and consultation</heading><chapeau style="-uslm-lc:I12" class="indent1">Standards described in paragraph (1) shall be established after—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368875-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/a/2/A"><num value="A">(A)</num><content> notice and an opportunity for comment by manufacturers of manufactured housing and other interested parties; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368876-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/a/2/B"><num value="B">(B)</num><content> consultation with the Secretary of Housing and Urban Development, who may seek further counsel from the Manufactured Housing Consensus Committee.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368877-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/b"><num value="b" class="bold">(b)</num><heading class="bold"> Requirements</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9368878-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> International Energy Conservation Code</heading><content><p style="-uslm-lc:I12" class="indent1">The energy conservation standards established under this section shall be based on the most recent version of the International Energy Conservation Code (including supplements), except in cases in which the Secretary finds that the code <ref class="footnoteRef" idref="fn004155">1</ref><note type="footnote" id="fn004155"><num>1</num> So in original. Probably should be “Code”.</note> is not cost-effective, or a more stringent standard would be more cost-effective, based on the impact of the code <ref class="footnoteRef" idref="fn004155">1</ref> on the purchase price of manufactured housing and on total life-cycle construction and operating costs.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9368879-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Considerations</heading><chapeau style="-uslm-lc:I12" class="indent1">The energy conservation standards established under this section may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd936887a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/b/2/A"><num value="A">(A)</num><content> take into consideration the design and factory construction techniques of manufactured homes;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936887b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/b/2/B"><num value="B">(B)</num><content> be based on the climate zones established by the Department of Housing and Urban Development rather than the climate zones under the International Energy Conservation Code; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936887c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/b/2/C"><num value="C">(C)</num><content> provide for alternative practices that result in net estimated energy consumption equal to or less than the specified standards.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd936887d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Updating</heading><chapeau style="-uslm-lc:I12" class="indent1">The energy conservation standards established under this section shall be updated not later than—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd936887e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/b/3/A"><num value="A">(A)</num><content> 1 year after <date date="2007-12-19">December 19, 2007</date>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936887f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/b/3/B"><num value="B">(B)</num><content> 1 year after any revision to the International Energy Conservation Code.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368880-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17071/c"><num value="c" class="bold">(c)</num><heading class="bold"> Enforcement</heading><content><p style="-uslm-lc:I11" class="indent0">Any manufacturer of manufactured housing that violates a provision of the regulations under subsection (a) is liable to the United States for a civil penalty in an amount not exceeding 1 percent of the manufacturer’s retail list price of the manufactured housing.</p>
