<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad94a7ca-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085"><num value="17085">§ 17085.</num><heading> Tenant Star program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad94a7cb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad94a7cc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> High-performance energy efficiency measure</heading><content><p style="-uslm-lc:I12" class="indent1">The term “high-performance energy efficiency measure” has the meaning given the term in <ref href="/us/usc/t42/s17084">section 17084 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad94a7cd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Separate spaces</heading><content><p style="-uslm-lc:I12" class="indent1">The term “separate spaces” has the meaning given the term in <ref href="/us/usc/t42/s17084">section 17084 of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad94a7ce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/b"><num value="b" class="bold">(b)</num><heading class="bold"> Tenant Star</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator of the Environmental Protection Agency, in consultation with the Secretary of Energy, shall develop a voluntary program within the Energy Star program established by <ref href="/us/usc/t42/s6294a">section 6294a of this title</ref>, which may be known as “Tenant Star”, to promote energy efficiency in separate spaces leased by tenants or otherwise occupied within commercial buildings.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad94a7cf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/c"><num value="c" class="bold">(c)</num><heading class="bold"> Expanding survey data</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary of Energy, acting through the Administrator of the Energy Information Administration, shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad94a7d0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/c/1"><num value="1">(1)</num><chapeau> collect, through each Commercial Buildings Energy Consumption Survey of the Energy Information Administration that is conducted after <date date="2015-04-30">April 30, 2015</date>, data on—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad94a7d1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/c/1/A"><num value="A">(A)</num><content> categories of building occupancy that are known to consume significant quantities of energy, such as occupancy by data centers, trading floors, and restaurants; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad94a7d2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/c/1/B"><num value="B">(B)</num><content> other aspects of the property, building operation, or building occupancy determined by the Administrator of the Energy Information Administration, in consultation with the Administrator of the Environmental Protection Agency, to be relevant in lowering energy consumption;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad94cee3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/c/2"><num value="2">(2)</num><content> with respect to the first Commercial Buildings Energy Consumption Survey conducted after <date date="2015-04-30">April 30, 2015</date>, to the extent full compliance with the requirements of paragraph (1) is not feasible, conduct activities to develop the capability to collect such data and begin to collect such data; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad94cee4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/c/3"><num value="3">(3)</num><content> make data collected under paragraphs (1) and (2) available to the public in aggregated form and provide such data, and any associated results, to the Administrator of the Environmental Protection Agency for use in accordance with subsection (d).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad94cee5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/d"><num value="d" class="bold">(d)</num><heading class="bold"> Recognition of owners and tenants</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad94cee6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Occupancy-based recognition</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 1 year after the date on which sufficient data is received pursuant to subsection (c), the Administrator of the Environmental Protection Agency shall, following an opportunity for public notice and comment—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad94cee7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/d/1/A"><num value="A">(A)</num><content> in a manner similar to the Energy Star rating system for commercial buildings, develop policies and procedures to recognize tenants in commercial buildings that voluntarily achieve high levels of energy efficiency in separate spaces;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad94cee8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/d/1/B"><num value="B">(B)</num><content> establish building occupancy categories eligible for Tenant Star recognition based on the data collected under subsection (c) and any other appropriate data sources; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad94cee9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/d/1/C"><num value="C">(C)</num><content> consider other forms of recognition for commercial building tenants or other occupants that lower energy consumption in separate spaces.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad94ceea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s17085/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Design- and construction-based recognition</heading><content><p style="-uslm-lc:I12" class="indent1">After the study required by <ref href="/us/usc/t42/s17084/b">section 17084(b) of this title</ref> is completed, the Administrator of the Environmental Protection Agency, in consultation with the Secretary and following an opportunity for public notice and comment, may develop a voluntary program to recognize commercial building owners and tenants that use high-performance energy efficiency measures in the design and construction of separate spaces.</p>
