<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd9368933-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092"><num value="17092">§ 17092.</num><heading> High-performance green Federal buildings</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368934-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment of Office</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 60 days after <date date="2007-12-19">December 19, 2007</date>, the Administrator shall establish within the General Services Administration an Office of Federal High-Performance Green Buildings, and appoint an individual to serve as Federal Director in, a position in the career-reserved Senior Executive service, to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd9368935-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/a/1"><num value="1">(1)</num><content> establish and manage the Office of Federal High-Performance Green Buildings; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368936-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/a/2"><num value="2">(2)</num><content> carry out other duties as required under this part.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368937-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/b"><num value="b" class="bold">(b)</num><heading class="bold"> Compensation</heading><content><p style="-uslm-lc:I11" class="indent0">The compensation of the Federal Director shall not exceed the maximum rate of basic pay for the Senior Executive Service under <ref href="/us/usc/t5/s5382">section 5382 of title 5</ref>, including any applicable locality-based comparability payment that may be authorized under section 5304(h)(2)(C) of that title.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368938-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c"><num value="c" class="bold">(c)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I11" class="indent0">The Federal Director shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd9368939-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/1"><num value="1">(1)</num><content> coordinate the activities of the Office of Federal High-Performance Green Buildings with the activities of the Office of Commercial High-Performance Green Buildings, and the Secretary, in accordance with <ref href="/us/usc/t42/s6834/a/3/D">section 6834(a)(3)(D) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd936893a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2"><num value="2">(2)</num><chapeau> ensure full coordination of high-performance green building information and activities within the General Services Administration and all relevant agencies, including, at a minimum—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd936893b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2/A"><num value="A">(A)</num><content> the Environmental Protection Agency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936893c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2/B"><num value="B">(B)</num><content> the Office of the Federal Environmental Executive;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936893d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2/C"><num value="C">(C)</num><content> the Office of Federal Procurement Policy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936893e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2/D"><num value="D">(D)</num><content> the Department of Energy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936893f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2/E"><num value="E">(E)</num><content> the Department of Health and Human Services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368940-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2/F"><num value="F">(F)</num><content> the Department of Defense;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368941-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2/G"><num value="G">(G)</num><content> the Department of Transportation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368942-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2/H"><num value="H">(H)</num><content> the National Institute of Standards and Technology; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368943-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/2/I"><num value="I">(I)</num><content> the Office of Science and Technology Policy;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368944-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/3"><num value="3">(3)</num><content> establish a senior-level Federal Green Building Advisory Committee under section 474,<ref class="footnoteRef" idref="fn004156">1</ref><note type="footnote" id="fn004156"><num>1</num> See References in Text note below.</note> which shall provide advice and recommendations in accordance with that section and subsection (d);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368945-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/4"><num value="4">(4)</num><content> identify and every 5 years reassess improved or higher rating standards recommended by the Advisory Committee;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368946-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/5"><num value="5">(5)</num><content> ensure full coordination, dissemination of information regarding, and promotion of the results of research and development information relating to Federal high-performance green building initiatives;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368947-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/6"><num value="6">(6)</num><content> identify and develop Federal high-performance green building standards for all types of Federal facilities, consistent with the requirements of this part and <ref href="/us/usc/t42/s6834/a/3/D">section 6834(a)(3)(D) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368948-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/7"><num value="7">(7)</num><content> establish green practices that can be used throughout the life of a Federal facility;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368949-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/8"><num value="8">(8)</num><content> review and analyze current Federal budget practices and life-cycle costing issues, and make recommendations to Congress, in accordance with subsection (d); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd936894a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/c/9"><num value="9">(9)</num><content> identify opportunities to demonstrate innovative and emerging green building technologies and concepts.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd936894b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/d"><num value="d" class="bold">(d)</num><heading class="bold"> Additional duties</heading><chapeau style="-uslm-lc:I11" class="indent0">The Federal Director, in consultation with the Commercial Director and the Advisory Committee, and consistent with the requirements of <ref href="/us/usc/t42/s6834/a/3/D">section 6834(a)(3)(D) of this title</ref> shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd936894c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/d/1"><num value="1">(1)</num><content> identify, review, and analyze current budget and contracting practices that affect achievement of high-performance green buildings, including the identification of barriers to high-performance green building life-cycle costing and budgetary issues;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd936894d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/d/2"><num value="2">(2)</num><content> develop guidance and conduct training sessions with budget specialists and contracting personnel from Federal agencies and budget examiners to apply life-cycle cost criteria to actual projects;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd936894e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/d/3"><num value="3">(3)</num><content> identify tools to aid life-cycle cost decisionmaking; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd936894f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/d/4"><num value="4">(4)</num><content> explore the feasibility of incorporating the benefits of high-performance green buildings, such as security benefits, into a cost-budget analysis to aid in life-cycle costing for budget and decisionmaking processes.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368950-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/e"><num value="e" class="bold">(e)</num><heading class="bold"> Incentives</heading><chapeau style="-uslm-lc:I11" class="indent0">Within 90 days after <date date="2007-12-19">December 19, 2007</date>, the Federal Director shall identify incentives to encourage the expedited use of high-performance green buildings and related technology in the operations of the Federal Government, in accordance with the requirements of <ref href="/us/usc/t42/s6834/a/3/D">section 6834(a)(3)(D) of this title</ref>, including through—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd9368951-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/e/1"><num value="1">(1)</num><content> the provision of recognition awards; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368952-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/e/2"><num value="2">(2)</num><content> the maximum feasible retention of financial savings in the annual budgets of Federal agencies for use in reinvesting in future high-performance green building initiatives.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368953-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f"><num value="f" class="bold">(f)</num><heading class="bold"> Report</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 2 years after <date date="2007-12-19">December 19, 2007</date>, and biennially thereafter, the Federal Director, in consultation with the Secretary, shall submit to Congress a report that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd9368954-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/1"><num value="1">(1)</num><chapeau> describes the status of compliance with this part, the requirements of <ref href="/us/usc/t42/s6834/a/3/D">section 6834(a)(3)(D) of this title</ref>, and other Federal high-performance green building initiatives in effect as of the date of the report, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368955-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/1/A"><num value="A">(A)</num><content> the extent to which the programs are being carried out in accordance with this part and the requirements of <ref href="/us/usc/t42/s6834/a/3/D">section 6834(a)(3)(D) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368956-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/1/B"><num value="B">(B)</num><content> the status of funding requests and appropriations for those programs;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368957-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/2"><num value="2">(2)</num><content> identifies within the planning, budgeting, and construction process all types of Federal facility procedures that may affect the certification of new and existing Federal facilities as high-performance green buildings under the provisions of <ref href="/us/usc/t42/s6834/a/3/D">section 6834(a)(3)(D) of this title</ref> and the criteria established in subsection (h);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368958-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/3"><num value="3">(3)</num><content> identifies inconsistencies, as reported to the Advisory Committee, in Federal law with respect to product acquisition guidelines and high-performance product guidelines;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368959-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/4"><num value="4">(4)</num><content> recommends language for uniform standards for use by Federal agencies in environmentally responsible acquisition;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd936895a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/5"><num value="5">(5)</num><chapeau> in coordination with the Office of Management and Budget, reviews the budget process for capital programs with respect to alternatives for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd936895b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/5/A"><num value="A">(A)</num><content> restructuring of budgets to require the use of complete energy and environmental cost accounting;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936895c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/5/B"><num value="B">(B)</num><content> using operations expenditures in budget-related decisions while simultaneously incorporating productivity and health measures (as those measures can be quantified by the Office of Federal High-Performance Green Buildings, with the assistance of universities and national laboratories);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936895d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/5/C"><num value="C">(C)</num><content> streamlining measures for permitting Federal agencies to retain all identified savings accrued as a result of the use of life-cycle costing for future high-performance green building initiatives; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936895e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/5/D"><num value="D">(D)</num><content> identifying short-term and long-term cost savings that accrue from high-performance green buildings, including those relating to health and productivity;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd936895f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/6"><num value="6">(6)</num><content> identifies green, self-sustaining technologies to address the operational needs of Federal facilities in times of national security emergencies, natural disasters, or other dire emergencies;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368960-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/7"><num value="7">(7)</num><content> summarizes and highlights development, at the State and local level, of high-performance green building initiatives, including executive orders, policies, or laws adopted promoting high-performance green building (including the status of implementation of those initiatives); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9368961-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/f/8"><num value="8">(8)</num><content> includes, for the 2-year period covered by the report, recommendations to address each of the matters, and a plan for implementation of each recommendation, described in paragraphs (1) through (7).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368962-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/g"><num value="g" class="bold">(g)</num><heading class="bold"> Implementation</heading><content><p style="-uslm-lc:I11" class="indent0">The Office of Federal High-Performance Green Buildings shall carry out each plan for implementation of recommendations under subsection (f)(8).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9368963-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h"><num value="h" class="bold">(h)</num><heading class="bold"> Identification of certification system</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9368964-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">For the purpose of this section, not later than 60 days after <date date="2007-12-19">December 19, 2007</date>, the Federal Director shall identify and shall provide to the Secretary pursuant to <ref href="/us/usc/t42/s6834/a/3/D">section 6834(a)(3)(D) of this title</ref>, a certification system that the Director determines to be the most likely to encourage a comprehensive and environmentally-sound approach to certification of green buildings.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9368965-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Basis</heading><chapeau style="-uslm-lc:I12" class="indent1">The system identified under paragraph (1) shall be based on—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368966-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/A"><num value="A">(A)</num><content> a study completed every 5 years and provided to the Secretary pursuant to <ref href="/us/usc/t42/s6834/a/3/D">section 6834(a)(3)(D) of this title</ref>, which shall be carried out by the Federal Director to compare and evaluate standards;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368967-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/B"><num value="B">(B)</num><content> the ability and availability of assessors and auditors to independently verify the criteria and measurement of metrics at the scale necessary to implement this part;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368968-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/C"><num value="C">(C)</num><content> the ability of the applicable standard-setting organization to collect and reflect public comment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368969-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/D"><num value="D">(D)</num><content> the ability of the standard to be developed and revised through a consensus-based process;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd936896a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/E"><num value="E">(E)</num><chapeau> an evaluation of the robustness of the criteria for a high-performance green building, which shall give credit for promoting—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd936896b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/E/i"><num value="i">(i)</num><content> efficient and sustainable use of water, energy, and other natural resources;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd936896c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/E/ii"><num value="ii">(ii)</num><content> use of renewable energy sources;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd936896d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/E/iii"><num value="iii">(iii)</num><content> improved indoor environmental quality through enhanced indoor air quality, thermal comfort, acoustics, day lighting, pollutant source control, and use of low-emission materials and building system controls;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd936896e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/E/iv"><num value="iv">(iv)</num><content> reduced impacts from transportation through building location and site design that promote access by public transportation; and</content>

<clause style="-uslm-lc:I14" class="indent3" id="idd936896f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/E/v"><num value="v">(v)</num><content> such other criteria as the Federal Director determines to be appropriate; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9368970-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s17092/h/2/F"><num value="F">(F)</num><content> national recognition within the building industry.</content>
