value=\"1753\">§ 1753.</num><heading> Apportionments to States</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8c662b69-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/a\"><num value=\"a\">(a)</num><content> The sums appropriated for any fiscal year pursuant to the authorizations contained in <ref href=\"/us/usc/t42/s1752\">section 1752 of this title</ref> shall be available to the Secretary for supplying agricultural commodities and other food for the program in accordance with the provisions of this chapter.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8c662b6a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b\"><num value=\"b\">(b)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8c662b6b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/1\"><num value=\"1\">(1)</num><chapeau> The Secretary shall make food assistance payments to each State educational agency each fiscal year, at such times as the Secretary may determine, from the sums appropriated for such purpose, in a total amount equal to the product obtained by multiplying—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8c66527c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/1/A\"><num value=\"A\">(A)</num><content> the number of lunches (consisting of a combination of foods which meet the minimum nutritional requirements prescribed by the Secretary under <ref href=\"/us/usc/t42/s1758/a\">section 1758(a) of this title</ref>) served during such fiscal year in schools in such State which participate in the school lunch program under this chapter under agreements with such State educational agency; by</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8c66527d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/1/B\"><num value=\"B\">(B)</num><content> the national average lunch payment prescribed in paragraph (2) of this subsection.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8c66527e-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/2\"><num value=\"2\">(2)</num><content> The national average lunch payment for each lunch served shall be 10.5 cents (as adjusted pursuant to <ref href=\"/us/usc/t42/s1759a/a\">section 1759a(a) of this title</ref>) except that for each lunch served in school food authorities in which 60 percent or more of the lunches served in the school lunch program during the second preceding school year were served free or at a reduced price, the national average lunch payment shall be 2 cents more.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8c66527f-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Additional reimbursement.—</inline></heading><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8c665280-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">Regulations.—</inline></heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8c665281-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/A/i\"><num value=\"i\">(i)</num><heading> <inline class=\"small-caps\">Proposed regulations</inline>.—</heading><content>Notwithstanding <ref href=\"/us/usc/t42/s1758/f\">section 1758(f) of this title</ref>, not later than 18 months after <date date=\"2010-12-13\">December 13, 2010</date>, the Secretary shall promulgate proposed regulations to update the meal patterns and nutrition standards for the school lunch program authorized under this chapter and the school breakfast program established by <ref href=\"/us/usc/t42/s1773\">section 1773 of this title</ref> based on recommendations made by the Food and Nutrition Board of the National Research Council of the National Academy of Sciences.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8c665282-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/A/ii\"><num value=\"ii\">(ii)</num><heading> <inline class=\"small-caps\">Interim or final regulations.—</inline></heading><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8c665283-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/A/ii/I\"><num value=\"I\">(I)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Not later than 18 months after promulgation of the proposed regulations under clause (i), the Secretary shall promulgate interim or final regulations.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8c665284-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/A/ii/II\"><num value=\"II\">(II)</num><heading> <inline class=\"small-caps\">Date of required compliance</inline>.—</heading><content>The Secretary shall establish in the interim or final regulations a date by which all school food authorities participating in the school lunch program authorized under this Act and the school breakfast program established by <ref href=\"/us/usc/t42/s1773\">section 1773 of this title</ref> are required to comply with the meal pattern and nutrition standards established in the interim or final regulations.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8c665285-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/A/iii\"><num value=\"iii\">(iii)</num><heading> <inline class=\"small-caps\">Report to congress</inline>.—</heading><content>Not later than 90 days after <date date=\"2010-12-13\">December 13, 2010</date>, and each 90 days thereafter until the Secretary has promulgated interim or final regulations under clause (ii), the Secretary shall submit to the Committee on Education and Labor of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a quarterly report on progress made toward promulgation of the regulations described in this subparagraph.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8c665286-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Performance-based reimbursement rate increase</inline>.—</heading><content>Beginning on the later of the date of promulgation of the implementing regulations described in subparagraph (A)(ii), <date date=\"2010-12-13\">December 13, 2010</date>, or <date date=\"2012-10-01\">October 1, 2012</date>, the Secretary shall provide additional reimbursement for each lunch served in school food authorities determined to be eligible under subparagraph (D).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8c665287-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/C\"><num value=\"C\">(C)</num><heading> <inline class=\"small-caps\">Additional reimbursement.—</inline></heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8c665288-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/C/i\"><num value=\"i\">(i)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Each lunch served in school food authorities determined to be eligible under subparagraph (D) shall receive an additional 6 cents, adjusted in accordance with <ref href=\"/us/usc/t42/s1759a/a/3\">section 1759a(a)(3) of this title</ref>, to the national lunch average payment for each lunch served.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8c665289-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/C/ii\"><num value=\"ii\">(ii)</num><heading> <inline class=\"small-caps\">Disbursement</inline>.—</heading><content>The State agency shall disburse funds made available under this paragraph to school food authorities eligible to receive additional reimbursement.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8c66528a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/D\"><num value=\"D\">(D)</num><heading> <inline class=\"small-caps\">Eligible school food authority</inline>.—</heading><content>To be eligible to receive an additional reimbursement described in this paragraph, a school food authority shall be certified by the State to be in compliance with the interim or final regulations described in subparagraph (A)(ii).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8c66528b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/E\"><num value=\"E\">(E)</num><heading> <inline class=\"small-caps\">Failure to comply</inline>.—</heading><content>Beginning on the later of the date described in subparagraph (A)(ii)(II), <date date=\"2010-12-13\">December 13, 2010</date>, or <date date=\"2012-10-01\">October 1, 2012</date>, school food authorities found to be out of compliance with the meal patterns or nutrition standards established by the implementing regulations shall not receive the additional reimbursement for each lunch served described in this paragraph.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8c66799c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/F\"><num value=\"F\">(F)</num><heading> <inline class=\"small-caps\">Administrative costs.—</inline></heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8c66799d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/F/i\"><num value=\"i\">(i)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Subject to clauses (ii) and (iii), the Secretary shall make funds available to States for State activities related to training, technical assistance, certification, and oversight activities of this paragraph.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8c66799e-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/F/ii\"><num value=\"ii\">(ii)</num><heading> <inline class=\"small-caps\">Provision of funds</inline>.—</heading><content>The Secretary shall provide funds described in clause (i) to States administering a school lunch program in a manner proportional to the administrative expense allocation of each State during the preceding fiscal year.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8c66799f-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/F/iii\"><num value=\"iii\">(iii)</num><heading> <inline class=\"small-caps\">Funding.—</inline></heading><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8c6679a0-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/F/iii/I\"><num value=\"I\">(I)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>In the later of the fiscal year in which the implementing regulations described in subparagraph (A)(ii) are promulgated or the fiscal year in which this paragraph is enacted, and in the subsequent fiscal year, the Secretary shall use not more than $50,000,000 of funds made available under <ref href=\"/us/usc/t42/s1752\">section 1752 of this title</ref> to make payments to States described in clause (i).</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8c6679a1-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s1753/b/3/F/iii/II\"><num value=\"II\">(II)</num><heading> <inline class=\"small-caps\">Reservation</inline>.—</heading><content>In providing funds to States under clause (i), the Secretary may reserve not more than $3,000,000 per fiscal year to support Federal administrative activities to carry out this L. 87–823</ref> amended section generally, and, among other changes, substituted as factors for apportionment of funds among the States “(1) the participation rate for the State, and (2) the assistance need rate for the State” for “(1) the number of school children in the State and (2) the need for assistance in the State as indicated by the relation of the per capita income of the United States to the per capita income in the State”; inserted, in provision for determination of amount of apportionment in clause designated “second”, “(exclusive of American Samoa for periods ending before <date date=\"1967-07-01\">July 1, 1967</date>)”; inserted provisions for use of transitional formulas in apportionment of funds for fiscal years beginning in 1962, 1963, and 1964 and apportioning to American Samoa $25,000 annually for five fiscal years in period beginning <date date=\"1962-07-01\">July 1, 1962</date> and ending <date date=\"1967-06-30\">June 30, 1967</date>; and struck out apportionment formula for Puerto Rico, Guam, American Samoa, and the Virgin Islands, which limited apportionments to 3 per centum of the total fund to be apportioned but required the apportionment to each to be not less than an amount which would result in an allotment per child of school age equal to that for the State with the lowest per capita income, definition of school (incorporated in <ref href=\"/us/usc/t42/s1760/d/7\">section 1760(d)(7) of this title</ref>), provision for use of latest per capita income figures certified by the Department of Commerce (incorporated in <ref href=\"/us/usc/t42/s1760/d/6/ii\">section 1760(d)(6)(ii) of this title</ref>), and definition of school children which provided that the number of school children should be the number between ages of five and seventeen.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><ref href=\"/us/pl/87/688\">Pub. L. 97–35, title VIII, § 820(a)</ref>, <date date=\"1981-08-13\">Aug. 13, 1981</date>, <ref href=\"/us/stat/95/534\">95 Stat. 534</ref>, provided that: <quotedContent origin=\"/us/pl/97/35/tVIII/s820/a\">\n<inline>“The provisions of this title shall take effect as follows:</inline>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"1\">“(1)</num><chapeau> The amendments made by the following sections shall take effect on the first day of the month following the date of the enactment of this Act [<date date=\"1981-08-13\">Aug. 13, 1981</date>] or on <date date=\"1981-09-01\">September 1, 1981</date>, whichever is earlier:</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> section 801 [amending this section and sections 1759a and 1773 of this title];</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> that portion of the amendment made by section 810(c) [amending <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>] pertaining to the reimbursement rate for supplements;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><content> that portion of the amendment made by section 810(d)(1) [amending <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>] pertaining to the limitation on the number of meals for which reimbursement may be made under the child care food program;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"D\">“(D)</num><content> that portion of the amendment made by section 810(d)(3) [amending <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>] which reduces the meal reimbursement factor by 10 percent; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"E\">“(E)</num><content> section 811 [amending <ref href=\"/us/usc/t42/s1758\">section 1758 of this title</ref>].</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><content> The amendments made by sections 802 and 804 [amending sections 1755 and 1756 of this title] shall take effect on <date date=\"1981-07-01\">July 1, 1981</date>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><content> The amendments made by sections 807 [amending <ref href=\"/us/usc/t42/s1772\">section 1772 of this title</ref>], 808 [amending sections 1760 and 1784 of this title], and 810(a)(2) [amending <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>] shall take effect on the first day of the second month following the date of the enactment of this Act [<date date=\"1981-08-13\">Aug. 13, 1981</date>].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"4\">“(4)</num><content> The amendments made by the following sections shall take effect <date date=\"1981-10-01\">October 1, 1981</date>: sections 805 [repealing sections 1754 and 1774 of this title], 806 [amending <ref href=\"/us/usc/t42/s1788\">section 1788 of this title</ref>], 809 [amending <ref href=\"/us/usc/t42/s1761\">section 1761 of this title</ref>], 810(a)(1) [amending <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>], 810(f) [amending <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>], 810(g) [amending <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>], 812 [amending <ref href=\"/us/usc/t42/s1759a\">section 1759a of this title</ref>], 814 [amending <ref href=\"/us/usc/t42/s1776\">section 1776 of this title</ref>], 817 [enacting <ref href=\"/us/usc/t42/s1774\">section 1774 of this title</ref> and amending sections 1759, 1761, 1766, 1773, and 1788 of this title], and 819 [amending this section and sections 1755, 1757, 1759a, 1760, 1762a, 1763, 1766, 1773, 1776, and 1780 of this title].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"5\">“(5)</num><content> The amendments made by section 813 [amending sections 1759a, 1760, 1762a, and 1772 of this title] shall take effect 90 days after the date of the enactment of this Act [<date date=\"1981-08-13\">Aug. 13, 1981</date>].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"6\">“(6)</num><chapeau> The amendments made by the following provisions shall take effect <date date=\"1982-01-01\">January 1, 1982</date>: subsections (b), (c), (d), and (e) of section 810 [amending <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>], except that—</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> the amendment made by section 810(c) pertaining to the reimbursement rate for supplements shall take effect as provided under paragraph (1) of this subsection;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> the amendment made by section 810(d)(1) pertaining to the limitation on the number of meals for which reimbursement may be made shall take effect as provided under paragraph (1) of this subsection; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><content> the amendment made by section 810(d)(3) which reduces the meal reimbursement factor by 10 percent shall take effect as provided under paragraph (1) of this subsection.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"7\">“(7)</num><chapeau> The following provisions shall take effect on the date of the enactment of this Act [<date date=\"1981-08-13\">Aug. 13, 1981</date>]:</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> the amendments made by subsections (a) and (b) [amending <ref href=\"/us/usc/t42/s1758\">section 1758 of this title</ref>] of section 803 and the provisions of subsections (c) and (d) [amending provisions set out as notes under <ref href=\"/us/usc/t42/s1758\">section 1758 of this title</ref>] of section 803;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> the amendment made by section 815 [amending <ref href=\"/us/usc/t42/s1786\">section 1786 of this title</ref>];</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><content> the amendment made by section 816 [amending <ref href=\"/us/usc/t42/s1785\">section 1785 of this title</ref>];
