L. 111–296, title II, § 204(a), Dec. 13, 2010, 124 Stat. 3216.)","seq_in_title":2373,"parent_identifier":"/us/usc/t42/ch13","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch13","level":"chapter","num":"CHAPTER 13—","heading":"SCHOOL LUNCH PROGRAMS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida9c21ba5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b\"><num value=\"1758b\">§ 1758b.</num><heading> Local school wellness policy</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c21ba6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each local educational agency participating in a program authorized by this chapter or the Child Nutrition Act of 1966 (<ref href=\"/us/usc/t42/s1771\">42 U.S.C. 1771</ref> et seq.) shall establish a local school wellness policy for all schools under the jurisdiction of the local educational agency.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c21ba7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Guidelines</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall promulgate regulations that provide the framework and guidelines for local educational agencies to establish local school wellness policies, including, at a minimum,—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c21ba8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/1\"><num value=\"1\">(1)</num><content> goals for nutrition promotion and education, physical activity, and other school-based activities that promote student wellness;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c21ba9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/2\"><num value=\"2\">(2)</num><chapeau> for all foods available on each school campus under the jurisdiction of the local educational agency during the school day, nutrition guidelines that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9c21baa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/2/A\"><num value=\"A\">(A)</num><content> are consistent with sections 1758 and 1766 of this title, and sections 4 and 10 of the Child Nutrition Act of 1966 (<ref href=\"/us/usc/t42/s1773\">42 U.S.C. 1773</ref>, 1779); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9c21bab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/2/B\"><num value=\"B\">(B)</num><content> promote student health and reduce childhood obesity;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c21bac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/3\"><num value=\"3\">(3)</num><content> a requirement that the local educational agency permit parents, students, representatives of the school food authority, teachers of physical education, school health professionals, the school board, school administrators, and the general public to participate in the development, implementation, and periodic review and update of the local school wellness policy;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c21bad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/4\"><num value=\"4\">(4)</num><content> a requirement that the local educational agency inform and update the public (including parents, students, and others in the community) about the content and implementation of the local school wellness policy; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c21bae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/5\"><num value=\"5\">(5)</num><chapeau> a requirement that the local educational agency—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9c21baf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/5/A\"><num value=\"A\">(A)</num><chapeau> periodically measure and make available to the public an assessment on the implementation of the local school wellness policy, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9c21bb0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/5/A/i\"><num value=\"i\">(i)</num><content> the extent to which schools under the jurisdiction of the local educational agency are in compliance with the local school wellness policy;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9c21bb1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/5/A/ii\"><num value=\"ii\">(ii)</num><content> the extent to which the local school wellness policy of the local educational agency compares to model local school wellness policies; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9c21bb2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/5/A/iii\"><num value=\"iii\">(iii)</num><content> a description of the progress made in attaining the goals of the local school wellness policy; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9c21bb3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/b/5/B\"><num value=\"B\">(B)</num><content> designate 1 or more local educational agency officials or school officials, as appropriate, to ensure that each school complies with the local school wellness policy.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c21bb4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Local discretion</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The local educational agency shall use the guidelines promulgated by the Secretary under subsection (b) to determine specific policies appropriate for the schools under the jurisdiction of the local educational agency.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c21bb5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Technical assistance and best practices</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9c21bb6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary, in consultation with the Secretary of Education and the Secretary of Health and Human Services, acting through the Centers for Disease Control and Prevention, shall provide information and technical assistance to local educational agencies, school food authorities, and State educational agencies for use in establishing healthy school environments that are intended to promote student health and wellness.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9c21bb7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Content</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall provide technical assistance that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9c21bb8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/2/A\"><num value=\"A\">(A)</num><content> includes resources and training on designing, implementing, promoting, disseminating, and evaluating local school wellness policies and overcoming barriers to the adoption of local school wellness policies;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9c21bb9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/2/B\"><num value=\"B\">(B)</num><content> includes model local school wellness policies and best practices recommended by Federal agencies, State agencies, and nongovernmental organizations;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9c242ca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/2/C\"><num value=\"C\">(C)</num><content> includes such other technical assistance as is required to promote sound nutrition and establish healthy school nutrition environments; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9c242cb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/2/D\"><num value=\"D\">(D)</num><content> is consistent with the specific needs and requirements of local educational agencies.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9c242cc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Study and report</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9c242cd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Subject to the availability of appropriations, the Secretary, in conjunction with the Director of the Centers for Disease Control and Prevention, shall prepare a report on the implementation, strength, and effectiveness of the local school wellness policies carried out in accordance with this section.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9c242ce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Study of local school wellness policies</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The study described in subparagraph (A) shall include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9c242cf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/3/B/i\"><num value=\"i\">(i)</num><content> an analysis of the strength and weaknesses of local school wellness policies and how the policies compare with model local wellness policies recommended under paragraph (2)(B); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9c242d0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/3/B/ii\"><num value=\"ii\">(ii)</num><content> an assessment of the impact of the local school wellness policies in addressing the requirements of subsection (b).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9c242d1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Not later than <date date=\"2014-01-01\">January 1, 2014</date>, the Secretary shall submit to the Committee on Education and Labor of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that describes the findings of the study.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9c242d2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1758b/d/3/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">There are authorized to be appropriated to carry out this paragraph $3,000,000 for fiscal year 2011, to remain available until expended.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"ida9c242d3-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1946-06-04/ch281/s9A\">June 4, 1946, ch. 281, § 9A</ref>, as added <ref href=\"/us/pl/111/296/tII/s204/a\">Pub.
