<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida9c4665f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760"><num value="1760">§ 1760.</num><heading> Miscellaneous provisions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c46660-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/a"><num value="a" class="bold">(a)</num><heading class="bold"> Accounts and records</heading><content><p style="-uslm-lc:I11" class="indent0">States, State educational agencies, and schools participating in the school lunch program under this chapter shall keep such accounts and records as may be necessary to enable the Secretary to determine whether the provisions of this chapter are being complied with. Such accounts and records shall be available at any reasonable time for inspection and audit by representatives of the Secretary and shall be preserved for such period of time, not in excess of five years, as the Secretary determines is necessary.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c46661-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/b"><num value="b" class="bold">(b)</num><heading class="bold"> Agreements</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c46662-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall incorporate, in the agreement of the Secretary with the State agencies administering programs authorized under this chapter or the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.), the express requirements with respect to the operation of the programs to the extent applicable and such other provisions as in the opinion of the Secretary are reasonably necessary or appropriate to effectuate the purposes of this chapter and the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c46663-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Expectations for use of funds</heading><chapeau style="-uslm-lc:I12" class="indent1">Agreements described in paragraph (1) shall include a provision that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9c46664-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/b/2/A"><num value="A">(A)</num><content> supports full use of Federal funds provided to State agencies for the administration of programs authorized under this chapter or the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9c46665-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/b/2/B"><num value="B">(B)</num><chapeau> excludes the Federal funds from State budget restrictions or limitations including, at a minimum—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9c46666-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/b/2/B/i"><num value="i">(i)</num><content> hiring freezes;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9c46667-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/b/2/B/ii"><num value="ii">(ii)</num><content> work furloughs; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9c46668-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/b/2/B/iii"><num value="iii">(iii)</num><content> travel restrictions.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c46669-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/c"><num value="c" class="bold">(c)</num><heading class="bold"> Requirements with respect to teaching personnel, curriculum, instruction, etc.</heading><content><p style="-uslm-lc:I11" class="indent0">In carrying out the provisions of this chapter, the Secretary shall not impose any requirement with respect to teaching personnel, curriculum, instruction, methods of instruction, and materials of instruction in any school.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c4666a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d"><num value="d" class="bold">(d)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida9c4666b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Child.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9c4666c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/1/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The term “child” includes an individual, regardless of age, who—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9c4666d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/1/A/i"><num value="i">(i)</num><content> is determined by a State educational agency, in accordance with regulations prescribed by the Secretary, to have one or more disabilities; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9c4666e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/1/A/ii"><num value="ii">(ii)</num><content> is attending any institution, as defined in <ref href="/us/usc/t42/s1766/a">section 1766(a) of this title</ref>, or any nonresidential public or nonprofit private school of high school grade or under, for the purpose of participating in a school program established for individuals with disabilities.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9c4666f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/1/B"><num value="B">(B)</num><heading> <inline class="small-caps">Relationship to child and adult care food program</inline>.—</heading><content>No institution that is not otherwise eligible to participate in the program under <ref href="/us/usc/t42/s1766">section 1766 of this title</ref> shall be considered eligible because of this paragraph.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9c46670-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/2"><num value="2">(2)</num><content> “Commodity only schools” means schools that do not participate in the school lunch program under this chapter, but which receive commodities made available by the Secretary for use by such schools in nonprofit lunch programs.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9c46671-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/3"><num value="3">(3)</num><heading> <inline class="small-caps">Disability</inline>.—</heading><content>The term “disability” has the meaning given the term in the Rehabilitation Act of 1973 for purposes of title II of that Act (29 U.S.C 760 et seq.).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9c46672-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/4"><num value="4">(4)</num><heading> <inline class="small-caps">Local educational agency.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9c46673-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The term “local educational agency” has the meaning given the term in <ref href="/us/usc/t20/s7801">section 7801 of title 20</ref>.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9c46674-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Inclusion</inline>.—</heading><content>The term “local educational agency” includes, in the case of a private nonprofit school, an appropriate entity determined by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9c48d85-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/5"><num value="5">(5)</num><content> “School” means (A) any public or nonprofit private school of high school grade or under, and (B) any public or licensed nonprofit private residential child care institution (including, but not limited to, orphanages and homes for the mentally retarded, but excluding Job Corps Centers funded by the Department of Labor). For purposes of this paragraph, the term “nonprofit”, when applied to any such private school or institution, means any such school or institution which is exempt from tax under <ref href="/us/usc/t26/s501/c/3">section 501(c)(3) of title 26</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9c48d86-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/6"><num value="6">(6)</num><content> “School year” means the annual period from July 1 through June 30.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9c48d87-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/7"><num value="7">(7)</num><content> “Secretary” means the Secretary of Agriculture.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9c48d88-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/8"><num value="8">(8)</num><content> “State” means any of the fifty States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, or the Commonwealth of the Northern Mariana Islands.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9c48d89-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/d/9"><num value="9">(9)</num><content> “State educational agency” means, as the State legislature may determine, (A) the chief State school officer (such as the State superintendent of public instruction, commissioner of education, or similar officer), or (B) a board of education controlling the State department of education.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c48d8a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/e"><num value="e" class="bold">(e)</num><heading class="bold"> Value of assistance as income or resources under Federal or State laws</heading><content><p style="-uslm-lc:I11" class="indent0">The value of assistance to children under this chapter shall not be considered to be income or resources for any purposes under any Federal or State laws, including laws relating to taxation and welfare and public assistance programs.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c48d8b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/f"><num value="f" class="bold">(f)</num><heading class="bold"> Adjustment of national average payment rate for Alaska, Hawaii, territories and possessions, etc.</heading><content><p style="-uslm-lc:I11" class="indent0">In providing assistance for breakfasts, lunches, suppers, and supplements served in Alaska, Hawaii, Guam, American Samoa, Puerto Rico, the Virgin Islands of the United States, and the Commonwealth of the Northern Mariana Islands, the Secretary may establish appropriate adjustments for each such State to the national average payment rates prescribed under sections 1753, 1759a, 1761, and 1766 of this title and section 4 of the Child Nutrition Act of 1966 [<ref href="/us/usc/t42/s1773">42 U.S.C. 1773</ref>], to reflect the differences between the costs of providing meals and supplements in those States and the costs of providing meals and supplements in all other States.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c48d8c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/g"><num value="g" class="bold">(g)</num><heading class="bold"> Criminal penalties</heading><content><p style="-uslm-lc:I11" class="indent0">Whoever embezzles, willfully misapplies, steals, or obtains by fraud any funds, assets, or property that are the subject of a grant or other form of assistance under this chapter or the Child Nutrition Act of 1966 [<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.], whether received directly or indirectly from the United States Department of Agriculture, or whoever receives, conceals, or retains such funds, assets, or property to personal use or gain, knowing such funds, assets, or property have been embezzled, willfully misapplied, stolen, or obtained by fraud shall, if such funds, assets, or property are of the value of $100 or more, be fined not more than $25,000 or imprisoned not more than five years, or both, or, if such funds, assets, or property are of a value of less than $100, shall be fined not more than $1,000 or imprisoned for not more than one year, or both.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c48d8d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/h"><num value="h" class="bold">(h)</num><heading class="bold"> Combined allocation for breakfast and lunch</heading><content><p style="-uslm-lc:I11" class="indent0">No provision of this chapter or of the Child Nutrition Act of 1966 [<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.] shall require any school receiving funds under this chapter and the Child Nutrition Act of 1966 to account separately for the cost incurred in the school lunch and school breakfast programs.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c48d8e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/i"><num value="i" class="bold">(i)</num><heading class="bold"> Use of school lunch facilities for elderly programs</heading><content><p style="-uslm-lc:I11" class="indent0">Facilities, equipment, and personnel provided to a school food authority for a program authorized under this chapter or the Child Nutrition Act of 1966 [<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.] may be used, as determined by a local educational agency, to support a nonprofit nutrition program for the elderly, including a program funded under the Older Americans Act of 1965 [<ref href="/us/usc/t42/s3001">42 U.S.C. 3001</ref> et seq.].</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c48d8f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/j"><num value="j" class="bold">(j)</num><heading class="bold"> Reimbursement for final claims</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida9c48d90-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/j/1"><num value="1">(1)</num><chapeau> Except as provided in paragraph (2), the Secretary may provide reimbursements for final claims for service of meals, supplements, and milk submitted to State agencies by eligible schools, summer camps, family day care homes, institutions, and service institutions only if—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4a1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/j/1/A"><num value="A">(A)</num><content> the claims have been submitted to the State agencies not later than 60 days after the last day of the month for which the reimbursement is claimed; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4a2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/j/1/B"><num value="B">(B)</num><content> the final program operations report for the month is submitted to the Secretary not later than 90 days after the last day of the month.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida9c4b4a3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/j/2"><num value="2">(2)</num><content> The Secretary may waive the requirements of paragraph (1) at the discretion of the Secretary.</content>
</paragraph>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c4b4a5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l"><num value="l" class="bold">(l)</num><heading class="bold"> Waiver of statutory and regulatory requirements</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida9c4b4a6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="ida9c4b4a7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/1/A"><num value="A">(A)</num><chapeau> Except as provided in paragraph (4), the Secretary may waive any requirement under this chapter or the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.), or any regulation issued under either this chapter or such Act, for a State or eligible service provider that requests a waiver if—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="ida9c4b4a8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/1/A/i"><num value="i">(i)</num><content> the Secretary determines that the waiver of the requirement would facilitate the ability of the State or eligible service provider to carry out the purpose of the program;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida9c4b4a9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/1/A/ii"><num value="ii">(ii)</num><content> the State or eligible service provider has provided notice and information to the public regarding the proposed waiver; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida9c4b4aa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/1/A/iii"><num value="iii">(iii)</num><content> the State or eligible service provider demonstrates to the satisfaction of the Secretary that the waiver will not increase the overall cost of the program to the Federal Government, and, if the waiver does increase the overall cost to the Federal Government, the cost will be paid from non-Federal funds.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="ida9c4b4ab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/1/B"><num value="B">(B)</num><content> The notice and information referred to in subparagraph (A)(ii) shall be provided in the same manner in which the State or eligible service provider customarily provides similar notices and information to the public.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida9c4b4ac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="ida9c4b4ad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/2/A"><num value="A">(A)</num><chapeau> To request a waiver under paragraph (1), a State or eligible service provider (through the appropriate administering State agency) shall submit an application to the Secretary that—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="ida9c4b4ae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/2/A/i"><num value="i">(i)</num><content> identifies the statutory or regulatory requirements that are requested to be waived;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida9c4b4af-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/2/A/ii"><num value="ii">(ii)</num><content> in the case of a State requesting a waiver, describes actions, if any, that the State has undertaken to remove State statutory or regulatory barriers;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida9c4b4b0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/2/A/iii"><num value="iii">(iii)</num><content> describes the goal of the waiver to improve services under the program and the expected outcomes if the waiver is granted; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida9c4b4b1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/2/A/iv"><num value="iv">(iv)</num><content> includes a description of the impediments to the efficient operation and administration of the program.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="ida9c4b4b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/2/B"><num value="B">(B)</num><content> An application described in subparagraph (A) shall be developed by the State or eligible service provider and shall be submitted to the Secretary by the State.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida9c4b4b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/3"><num value="3">(3)</num><content> The Secretary shall act promptly on a waiver request contained in an application submitted under paragraph (2) and shall either grant or deny the request. The Secretary shall state in writing the reasons for granting or denying the request.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida9c4b4b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4"><num value="4">(4)</num><chapeau> The Secretary may not grant a waiver under this subsection that increases Federal costs or that relates to—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/A"><num value="A">(A)</num><content> the nutritional content of meals served;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/B"><num value="B">(B)</num><content> Federal reimbursement rates;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/C"><num value="C">(C)</num><content> the provision of free and reduced price meals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/D"><num value="D">(D)</num><content> limits on the price charged for a reduced price meal;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/E"><num value="E">(E)</num><content> maintenance of effort;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/F"><num value="F">(F)</num><content> equitable participation of children in private schools;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/G"><num value="G">(G)</num><content> distribution of funds to State and local school food service authorities and service institutions participating in a program under this chapter and the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/H"><num value="H">(H)</num><content> the disclosure of information relating to students receiving free or reduced price meals and other recipients of benefits;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4b4bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/I"><num value="I">(I)</num><content> prohibiting the operation of a profit producing program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dace-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/J"><num value="J">(J)</num><content> the sale of competitive foods;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dacf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/K"><num value="K">(K)</num><content> the commodity distribution program under <ref href="/us/usc/t42/s1762a">section 1762a of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dad0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/L"><num value="L">(L)</num><content> the special supplemental nutrition program authorized under section 17 of the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1786">42 U.S.C. 1786</ref>); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dad1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/M"><num value="M">(M)</num><chapeau> enforcement of any constitutional or statutory right of an individual, including any right under—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="ida9c4dad2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/M/i"><num value="i">(i)</num><content> title VI of the Civil Rights Act of 1964 (<ref href="/us/usc/t42/s2000d">42 U.S.C. 2000d</ref> et seq.);</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida9c4dad3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/M/ii"><num value="ii">(ii)</num><content> section 504 of the Rehabilitation Act of 1973 (<ref href="/us/usc/t29/s794">29 U.S.C. 794</ref>);</content>

<clause style="-uslm-lc:I13" class="indent2" id="ida9c4dad4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/M/iii"><num value="iii">(iii)</num><content> title IX of the Education Amendments of 1972 (<ref href="/us/usc/t20/s1681">20 U.S.C. 1681</ref> et seq.);</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida9c4dad5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/M/iv"><num value="iv">(iv)</num><content> the Age Discrimination Act of 1975 (<ref href="/us/usc/t42/s6101">42 U.S.C. 6101</ref> et seq.);</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida9c4dad6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/M/v"><num value="v">(v)</num><content> the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12101">42 U.S.C. 12101</ref> et seq.); and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida9c4dad7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/4/M/vi"><num value="vi">(vi)</num><content> the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1400">20 U.S.C. 1400</ref> et seq.).</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida9c4dad8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/5"><num value="5">(5)</num><content> The Secretary shall periodically review the performance of any State or eligible service provider for which the Secretary has granted a waiver under this subsection and shall terminate the waiver if the performance of the State or service provider has been inadequate to justify a continuation of the waiver. The Secretary shall terminate the waiver if, after periodic review, the Secretary determines that the waiver has resulted in an increase in the overall cost of the program to the Federal Government and the increase has not been paid for in accordance with paragraph (1)(A)(iii).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida9c4dad9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/6"><num value="6">(6)</num><chapeau> The Secretary shall annually submit to the Committee on Education and Labor of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate, a report—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dada-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/6/A"><num value="A">(A)</num><content> summarizing the use of waivers by the State and eligible service providers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dadb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/6/B"><num value="B">(B)</num><content> describing whether the waivers resulted in improved services to children;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dadc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/6/C"><num value="C">(C)</num><content> describing the impact of the waivers on providing nutritional meals to participants; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dadd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/6/D"><num value="D">(D)</num><content> describing how the waivers reduced the quantity of paperwork necessary to administer the program.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida9c4dade-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/7"><num value="7">(7)</num><chapeau> As used in this subsection, the term “eligible service provider” means—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dadf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/7/A"><num value="A">(A)</num><content> a local school food service authority;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dae0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/7/B"><num value="B">(B)</num><content> a service institution or private nonprofit organization described in <ref href="/us/usc/t42/s1761">section 1761 of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida9c4dae1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/l/7/C"><num value="C">(C)</num><content> a family or group day care home sponsoring organization described in <ref href="/us/usc/t42/s1766">section 1766 of this title</ref>.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c4dae2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/m"><num value="m" class="bold">(m)</num><heading class="bold"> Procurement training</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c4dae3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/m/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to the availability of funds made available under paragraph (4), the Secretary shall provide technical assistance and training to States, State agencies, schools, and school food authorities in the procurement of goods and services for programs under this chapter or the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.) (other than section 17 of that Act (<ref href="/us/usc/t42/s1786">42 U.S.C. 1786</ref>)).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c4dae4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/m/2"><num value="2" class="bold">(2)</num><heading class="bold"> Buy American training</heading><content><p style="-uslm-lc:I12" class="indent1">Activities carried out under paragraph (1) shall include technical assistance and training to ensure compliance with subsection (n).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c4dae5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/m/3"><num value="3" class="bold">(3)</num><heading class="bold"> Procuring safe foods</heading><content><p style="-uslm-lc:I12" class="indent1">Activities carried out under paragraph (1) shall include technical assistance and training on procuring safe foods, including the use of model specifications for procuring safe foods.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c4dae6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/m/4"><num value="4" class="bold">(4)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">There is authorized to be appropriated to carry out this subsection $1,000,000 for each of fiscal years 2010 through 2015, to remain available until expended.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c4dae7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n"><num value="n" class="bold">(n)</num><heading class="bold"> Buy American</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c4dae8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definition of domestic commodity or product</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection, the term “domestic commodity or product” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9c4dae9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/1/A"><num value="A">(A)</num><content> an agricultural commodity that is produced in the United States; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9c4daea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/1/B"><num value="B">(B)</num><content> a food product that is processed in the United States substantially using agricultural commodities that are produced in the United States.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c4daeb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirement</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9c4daec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to subparagraph (B), the Secretary shall require that a school food authority purchase, to the maximum extent practicable, domestic commodities or products.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9c501fd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Limitations</heading><chapeau style="-uslm-lc:I13" class="indent2">Subparagraph (A) shall apply only to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9c501fe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/2/B/i"><num value="i">(i)</num><content> a school food authority located in the contiguous United States; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9c501ff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/2/B/ii"><num value="ii">(ii)</num><content> a purchase of a domestic commodity or product for the school lunch program under this chapter or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1773">42 U.S.C. 1773</ref>).</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c50200-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/3"><num value="3" class="bold">(3)</num><heading class="bold"> Applicability to Hawaii</heading><content><p style="-uslm-lc:I12" class="indent1">Paragraph (2)(A) shall apply to a school food authority in Hawaii with respect to domestic commodities or products that are produced in Hawaii in sufficient quantities to meet the needs of meals provided under the school lunch program under this chapter or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1773">42 U.S.C. 1773</ref>).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c50201-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/n/4"><num value="4" class="bold">(4)</num><heading class="bold"> Applicability to Puerto Rico</heading><content><p style="-uslm-lc:I12" class="indent1">Paragraph (2)(A) shall apply to a school food authority in the Commonwealth of Puerto Rico with respect to domestic commodities or products that are produced in the Commonwealth of Puerto Rico in sufficient quantities to meet the needs of meals provided under the school lunch program under this chapter or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1773">42 U.S.C. 1773</ref>).</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c50202-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/o"><num value="o" class="bold">(o)</num><heading class="bold"> Procurement contracts</heading><content><p style="-uslm-lc:I11" class="indent0">In acquiring a good or service for programs under this chapter or the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.) (other than section 17 of that Act (<ref href="/us/usc/t42/s1786">42 U.S.C. 1786</ref>)), a State, State agency, school, or school food authority may enter into a contract with a person that has provided specification information to the State, State agency, school, or school food authority for use in developing contract specifications for acquiring such good or service.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9c50203-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p"><num value="p" class="bold">(p)</num><heading class="bold"> Price for a paid lunch</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c50204-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definition of paid lunch</heading><content><p style="-uslm-lc:I12" class="indent1">In this subsection, the term “paid lunch” means a reimbursable lunch served to students who are not certified to receive free or reduced price meals.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9c50205-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirement</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9c50206-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">For each school year beginning <date date="2011-07-01">July 1, 2011</date>, each school food authority shall establish a price for paid lunches in accordance with this subsection.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9c50207-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Lower price</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida9c50208-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I14" class="indent3">In the case of a school food authority that established a price for a paid lunch in the previous school year that was less than the difference between the total Federal reimbursement for a free lunch and the total Federal reimbursement for a paid lunch, the school food authority shall establish an average price for a paid lunch that is not less than the price charged in the previous school year, as adjusted by a percentage equal to the sum obtained by adding—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida9c50209-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/2/B/i/I"><num value="I">(I)</num><content> 2 percent; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida9c5020a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/2/B/i/II"><num value="II">(II)</num><content> the percentage change in the Consumer Price Index for All Urban Consumers (food away from home index) used to increase the Federal reimbursement rate under <ref href="/us/usc/t42/s1759a">section 1759a of this title</ref> for the most recent school year for which data are available, as published in the Federal Register.</content>
</subclause>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida9c5020b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Rounding</heading><content><p style="-uslm-lc:I14" class="indent3">A school food authority may round the adjusted price for a paid lunch under clause (i) down to the nearest 5 cents.</p>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida9c5020c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/2/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Maximum required price increase</heading><subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="ida9c5020d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1760/p/2/B/iii/I"><num value="I" class="bold">(I)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I16" class="indent4">The maximum annual average price increase required to meet the requirements of this subparagraph shall not exceed 10 cents for any school food authority.</p>

Russell National School Lunch Act (<ref href="/us/usc/t42/s1760">42 U.S.C. 1760</ref>(<i>l</i>)(5)) shall not apply to a qualified COVID–19 waiver.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> to waive any requirement under such Act (<ref href="/us/usc/t42/s1751">42 U.S.C. 1751</ref> et seq.) or the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.), or any regulation issued under either such Act, for purposes of providing meals and meal supplements under such Acts during a school closure due to COVID–19.”</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">State election</inline>.—</heading><chapeau>A waiver established under paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> notwithstanding paragraph (2) of section 12(<i>l</i>) of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1760">42 U.S.C. 1760</ref>(<i>l</i>)), apply automatically to any State that elects to be subject to the waiver without further application; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> not be subject to the requirements under paragraph (3) of such section.</content>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Child and Adult Care Food Program Waiver</inline>.—</heading><chapeau>Notwithstanding any other provision of law, the Secretary may grant a waiver under section 12(<i>l</i>) of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1760">42 U.S.C. 1760</ref>(<i>l</i>)) to allow non-congregate feeding under a child and adult care food program under section 17 of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1766">42 U.S.C. 1766</ref>) if such waiver is for the purposes of—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> providing meals and meal supplements under such child and adult care food program; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> carrying out paragraph (1) with appropriate safety measures with respect to COVID–19, as determined by the Secretary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Meal Pattern Waiver</inline>.—</heading><chapeau>Notwithstanding paragraph (4)(A) of section 12(<i>l</i>) of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1760">42 U.S.C. 1760</ref>(<i>l</i>)) the Secretary may grant a waiver under such section that relates to the nutritional content of meals served if the Secretary determines that—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> such waiver is necessary to provide meals and meal supplements under a qualified program; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> there is a supply chain disruption with respect to foods served under such a qualified program and such disruption is due to COVID–19.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Reports</inline>.—</heading><chapeau>Each State that receives a waiver under subsection (a), (b), or (c), shall, not later than 1 year after the date such State received such waiver, submit a report to the Secretary that includes the following:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> A summary of the use of such waiver by the State and eligible service providers.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> A description of whether such waiver resulted in improved services to children.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Sunset</inline>.—</heading><content>The authority of the Secretary to establish or grant a waiver under this section shall expire on <date date="2021-09-30">September 30, 2021</date>.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Qualified program</inline>.—</heading><chapeau>The term ‘qualified program’ means the following:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> The school lunch program under the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1751">42 U.S.C. 1751</ref> et seq.).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> The school breakfast program under section 4 of the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1773">42 U.S.C. 1773</ref>).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> The child and adult care food program under section 17 of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1766">42 U.S.C. 1766</ref>).</content>
</subparagraph>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Requirement</inline>.—</heading><chapeau>The products of the agricultural commodities described in subsection (a)(1) shall be processed in the United States and substantially contain—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><chapeau> meats, vegetables, fruits, and other agricultural commodities produced in—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> a State,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> the District of Columbia,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> the Commonwealth of Puerto Rico, or</content>
</subparagraph>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to Congress a report on the actions the Secretary has taken, and plans to take, to comply with this section.”</content>
