L. 111–296, title IV, § 441(a)(6), Dec. 13, 2010, 124 Stat. 3264.)","seq_in_title":2379,"parent_identifier":"/us/usc/t42/ch13","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch13","level":"chapter","num":"CHAPTER 13—","heading":"SCHOOL LUNCH PROGRAMS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida9c9bcff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a\"><num value=\"1762a\">§ 1762a.</num><heading> Commodity distribution program</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c9bd00-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Use of funds for purchase of agricultural commodities and products for donation</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any other provision of law, the Secretary shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c9bd01-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/a/1\"><num value=\"1\">(1)</num><content> use funds available to carry out the provisions of <ref href=\"/us/usc/t7/s612c\">section 612c of title 7</ref> which are not expended or needed to carry out such provisions, to purchase (without regard to the provisions of existing law governing the expenditure of public funds) agricultural commodities and their products of the types customarily purchased under such section (which may include domestic seafood commodities and their products), for donation to maintain the annually programmed level of assistance for programs carried on under this chapter, the Child Nutrition Act of 1966 [<ref href=\"/us/usc/t42/s1771\">42 U.S.C. 1771</ref> et seq.], and title III of the Older Americans Act of 1965 [<ref href=\"/us/usc/t42/s3021\">42 U.S.C. 3021</ref> et seq.]; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c9bd02-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/a/2\"><num value=\"2\">(2)</num><content> if stocks of the Commodity Credit Corporation are not available, use the funds of such Corporation to purchase agricultural commodities and their products of the types customarily available under <ref href=\"/us/usc/t7/s1431\">section 1431 of title 7</ref>, for such donation.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c9bd03-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Nutrition quality and content information</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9c9bd04-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/b/1\"><num value=\"1\">(1)</num><content> The Secretary shall maintain and continue to improve the overall nutritional quality of entitlement commodities provided to schools to assist the schools in improving the nutritional content of meals.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9c9bd05-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/b/2\"><num value=\"2\">(2)</num><chapeau> The Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c9e416-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/b/2/A\"><num value=\"A\">(A)</num><content> require that nutritional content information labels be placed on packages or shipments of entitlement commodities provided to the schools; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c9e417-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/b/2/B\"><num value=\"B\">(B)</num><content> otherwise provide nutritional content information regarding the commodities provided to the schools.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c9e418-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Authorization of appropriations for purchase of products or for cash payments in lieu of donations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may use funds appropriated from the general fund of the Treasury to purchase agricultural commodities and their products of the types customarily purchased for donation under section 311(a)(4) <ref class=\"footnoteRef\" idref=\"fn003130\">1</ref><note type=\"footnote\" id=\"fn003130\"><num>1</num> See References in Text note below.</note> of the Older Americans Act of 1965 or for cash payments in lieu of such donations under section 311(b)(1) <ref class=\"footnoteRef\" idref=\"fn003130\">1</ref> of such Act. There are hereby authorized to be appropriated such sums as are necessary to carry out the purposes of this subsection.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c9e419-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Assistance procedures; cost and benefits, review; technical assistance; report to Congress; food quality standards contracting procedures</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In providing assistance under this chapter and the Child Nutrition Act of 1966 [<ref href=\"/us/usc/t42/s1771\">42 U.S.C. 1771</ref> et seq.] for school lunch and breakfast programs, the Secretary shall establish procedures which will—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c9e41a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/d/1\"><num value=\"1\">(1)</num><content> ensure that the views of local school districts and private nonprofit schools with respect to the type of commodity assistance needed in schools are fully and accurately reflected in reports to the Secretary by the State with respect to State commodity preferences and that such views are considered by the Secretary in the purchase and distribution of commodities and by the States in the allocation of such commodities among schools within the States;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c9e41b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/d/2\"><num value=\"2\">(2)</num><content> solicit the views of States with respect to the acceptability of commodities;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c9e41c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/d/3\"><num value=\"3\">(3)</num><content> ensure that the timing of commodity deliveries to States is consistent with State school year calendars and that such deliveries occur with sufficient advance notice;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c9e41d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/d/4\"><num value=\"4\">(4)</num><content> provide for systematic review of the costs and benefits of providing commodities of the kind and quantity that are suitable to the needs of local school districts and private nonprofit schools; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9c9e41e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/d/5\"><num value=\"5\">(5)</num><content> make available technical assistance on the use of commodities available under this chapter and the Child Nutrition Act of 1966 [<ref href=\"/us/usc/t42/s1771\">42 U.S.C. 1771</ref> et seq.].</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c9e41f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Consultation with school representatives</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each State agency that receives food assistance payments under this section for any school year shall consult with representatives of schools in the State that participate in the school lunch program with respect to the needs of such schools relating to the manner of selection and distribution of commodity assistance for such program.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c9e420-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Commodity only schools</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Commodity only schools shall be eligible to receive donated commodities equal in value to the sum of the national average value of donated foods established under <ref href=\"/us/usc/t42/s1755/c\">section 1755(c) of this title</ref> and the national average payment established under <ref href=\"/us/usc/t42/s1753\">section 1753 of this title</ref>. Such schools shall be eligible to receive up to 5 cents per meal of such value in cash for processing and handling expenses related to the use of such commodities. Lunches served in such schools shall consist of a combination of foods which meet the minimum nutritional requirements prescribed by the Secretary under <ref href=\"/us/usc/t42/s1758/a\">section 1758(a) of this title</ref>, and shall represent the four basic food groups, including a serving of fluid milk.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c9e421-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Extension of alternative means of assistance</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9c9e422-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/g/1\"><num value=\"1\">(1)</num><content> As used in this subsection, the term “eligible school district” has the same meaning given such term in section 1581(a) of the Food Security Act of 1985.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9c9e423-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/g/2\"><num value=\"2\">(2)</num><content> In accordance with the terms and conditions of section 1581 of such Act, the Secretary shall permit an eligible school district to continue to receive assistance in the form of cash or commodity letters of credit assistance, in lieu of commodities, to carry out the school lunch program operated in the district.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9c9e424-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Notice of irradiated food products</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9c9e425-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall develop a policy and establish procedures for the purchase and distribution of irradiated food products in school meals programs under this chapter and the Child Nutrition Act of 1966 (<ref href=\"/us/usc/t42/s1771\">42 U.S.C. 1771</ref> et seq.).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9ca0b36-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Minimum requirements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The policy and procedures shall ensure, at a minimum, that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9ca0b37-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/A\"><num value=\"A\">(A)</num><content> irradiated food products are made available only at the request of States and school food authorities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9ca0b38-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/B\"><num value=\"B\">(B)</num><content> reimbursements to schools for irradiated food products are equal to reimbursements to schools for food products that are not irradiated;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9ca0b39-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/C\"><num value=\"C\">(C)</num><chapeau> States and school food authorities are provided factual information on the science and evidence regarding irradiation technology, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9ca0b3a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/C/i\"><num value=\"i\">(i)</num><content> notice that irradiation is not a substitute for safe food handling techniques; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9ca0b3b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/C/ii\"><num value=\"ii\">(ii)</num><content> any other similar information determined by the Secretary to be necessary to promote food safety in school meals programs;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9ca0b3c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/D\"><num value=\"D\">(D)</num><chapeau> States and school food authorities are provided model procedures for providing to school food authorities, parents, and students—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9ca0b3d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/D/i\"><num value=\"i\">(i)</num><content> factual information on the science and evidence regarding irradiation technology; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9ca0b3e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/D/ii\"><num value=\"ii\">(ii)</num><content> any other similar information determined by the Secretary to be necessary to promote food safety in school meals;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9ca0b3f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/E\"><num value=\"E\">(E)</num><chapeau> irradiated food products distributed to the Federal school meals program under this chapter and the Child Nutrition Act of 1966 (<ref href=\"/us/usc/t42/s1771\">42 U.S.C. 1771</ref> et seq.) are labeled with a symbol or other printed notice that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9ca0b40-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/E/i\"><num value=\"i\">(i)</num><content> indicates that the product was irradiated; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9ca0b41-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/E/ii\"><num value=\"ii\">(ii)</num><content> is prominently displayed in a clear and understandable format on the container;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9ca0b42-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/F\"><num value=\"F\">(F)</num><content> irradiated food products are not commingled in containers with food products that are not irradiated; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9ca0b43-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1762a/h/2/G\"><num value=\"G\">(G)</num><content> schools that offer irradiated food products are encouraged to offer alternatives to irradiated food products as part of the meal plan used by the schools.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"ida9ca0b44-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1946-06-04/ch281/s14\">June 4, 1946, ch. 281, § 14</ref>, as added <ref href=\"/us/pl/93/326/s2\">Pub.
