<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida9cf8a1c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a"><num value="1766a">§ 1766a.</num><heading> Meal supplements for children in afterschool care</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9cf8a1d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/a"><num value="a" class="bold">(a)</num><heading class="bold"> General authority</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9cf8a1e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Grants to States</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall carry out a program to assist States through grants-in-aid and other means to provide meal supplements under a program organized primarily to provide care for children in afterschool care in eligible elementary and secondary schools.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9cf8a1f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Eligible schools</heading><chapeau style="-uslm-lc:I12" class="indent1">For the purposes of this section, the term “eligible elementary and secondary schools” means schools that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9cf8a20-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/a/2/A"><num value="A">(A)</num><content> operate school lunch programs under this chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9cf8a21-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/a/2/B"><num value="B">(B)</num><content> sponsor afterschool care programs; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9cf8a22-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/a/2/C"><num value="C">(C)</num><content> operate afterschool programs with an educational or enrichment purpose.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9cf8a23-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligible children</heading><content><p style="-uslm-lc:I11" class="indent0">Reimbursement may be provided under this section only for supplements served to school children who are not more than 18 years of age, except that the age limitation provided by this subsection shall not apply to a child described in <ref href="/us/usc/t42/s1760/d/1/A">section 1760(d)(1)(A) of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9cf8a24-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Reimbursement</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9cf8a25-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> At-risk school children</heading><chapeau style="-uslm-lc:I12" class="indent1">In the case of an eligible child who is participating in a program authorized under this section operated at a site located in a geographical area served by a school in which at least 50 percent of the children enrolled are certified as eligible to receive free or reduced price school meals under this chapter or the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.), a supplement provided under this section to the child shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9cf8a26-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/c/1/A"><num value="A">(A)</num><content> reimbursed at the rate at which free supplements are reimbursed under <ref href="/us/usc/t42/s1766/c/3">section 1766(c)(3) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9cf8a27-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/c/1/B"><num value="B">(B)</num><content> served without charge.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9cf8a28-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Other school children</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of an eligible child who is participating in a program authorized under this section at a site that is not described in paragraph (1), for the purposes of this section, the national average payment rate for supplements shall be equal to those established under <ref href="/us/usc/t42/s1766/c/3">section 1766(c)(3) of this title</ref> (as adjusted pursuant to <ref href="/us/usc/t42/s1759a/a/3">section 1759a(a)(3) of this title</ref>).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9cf8a29-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1766a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Contents of supplements</heading><content><p style="-uslm-lc:I11" class="indent0">The requirements that apply to the content of meal supplements served under child care food programs operated with assistance under this chapter shall apply to the content of meal supplements served under programs operated with assistance under this section.</p>
