<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabea8cdc-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/b"><num value="b" class="bold">(b)</num><heading class="bold"> Extension of eligibility of certain school districts to receive cash or commodity letters of credit assistance for school lunch programs</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idabea8cdd-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/b/1"><num value="1">(1)</num><content> Upon request to the Secretary, any school district that on <date date="1987-01-01">January 1, 1987</date>, was receiving all cash payments or all commodity letters of credit in lieu of entitlement commodities for its school lunch program shall receive all cash payments or all commodity letters of credit in lieu of entitlement commodities for its school lunch program beginning <date date="1987-07-01">July 1, 1987</date>. The Secretary, directly or through contract, shall administer the project under this subsection.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idabea8cde-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/b/2"><num value="2">(2)</num><content> Any school district that elects under paragraph (1) to receive all cash payments or all commodity letters of credit in lieu of entitlement commodities for its school lunch program shall receive bonus commodities in the same manner as if such school district was receiving all entitlement commodities for its school lunch program.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabeab3ef-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/c"><num value="c" class="bold">(c)</num><heading class="bold"> Alternative counting and claiming procedures</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idabeab3f0-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/c/1"><num value="1">(1)</num><content> The Secretary may conduct pilot projects to test alternative counting and claiming procedures.</content>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabeab3f5-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Program</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall carry out a program to assist eligible schools, State and local agencies, Indian tribal organizations, agricultural producers or groups of agricultural producers, and nonprofit entities through grants and technical assistance to implement farm to school programs that improve access to local foods in eligible schools.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabeadb06-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Grants</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeadb07-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The Secretary shall award competitive grants under this subsection to be used for—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idabeadb08-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/A/i"><num value="i">(i)</num><content> training;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeadb09-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/A/ii"><num value="ii">(ii)</num><content> supporting operations;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeadb0a-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/A/iii"><num value="iii">(iii)</num><content> planning;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeadb0b-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/A/iv"><num value="iv">(iv)</num><content> purchasing equipment;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeadb0c-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/A/v"><num value="v">(v)</num><content> developing school gardens;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeadb0d-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/A/vi"><num value="vi">(vi)</num><content> developing partnerships; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeadb0e-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/A/vii"><num value="vii">(vii)</num><content> implementing farm to school programs.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeadb0f-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Regional balance</heading><chapeau>In making awards under this subsection, the Secretary shall, to the maximum extent practicable, ensure—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idabeadb10-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/B/i"><num value="i">(i)</num><content> geographical diversity; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeadb11-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/B/ii"><num value="ii">(ii)</num><content> equitable treatment of urban, rural, and tribal communities.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeadb12-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Maximum amount</heading><content><p style="-uslm-lc:I13" class="indent2">The total amount provided to a grant recipient under this subsection shall not exceed $100,000.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabeb0123-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/4"><num value="4" class="bold">(4)</num><heading class="bold"> Federal share</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeb0124-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Federal share of costs for a project funded through a grant awarded under this subsection shall not exceed 75 percent of the total cost of the project.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeb0125-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Federal matching</heading><content><p style="-uslm-lc:I13" class="indent2">As a condition of receiving a grant under this subsection, a grant recipient shall provide matching support in the form of cash or in-kind contributions, including facilities, equipment, or services provided by State and local governments, nonprofit organizations, and private sources.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabeb0126-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/5"><num value="5" class="bold">(5)</num><heading class="bold"> Criteria for selection</heading><chapeau>To the maximum extent practicable, in providing assistance under this subsection, the Secretary shall give the highest priority to funding projects that, as determined by the Secretary—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb0127-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/5/A"><num value="A">(A)</num><content> make local food products available on the menu of the eligible school;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb0128-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/5/B"><num value="B">(B)</num><content> serve a high proportion of children who are eligible for free or reduced price lunches;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb0129-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/5/C"><num value="C">(C)</num><content> incorporate experiential nutrition education activities in curriculum planning that encourage the participation of school children in farm and garden-based agricultural education activities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb283a-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/5/D"><num value="D">(D)</num><content> demonstrate collaboration between eligible schools, nongovernmental and community-based organizations, agricultural producer groups, and other community partners;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb283b-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/5/E"><num value="E">(E)</num><content> include adequate and participatory evaluation plans;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb283c-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/5/F"><num value="F">(F)</num><content> demonstrate the potential for long-term program sustainability; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb283d-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/5/G"><num value="G">(G)</num><content> meet any other criteria that the Secretary determines appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabeb283e-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/6"><num value="6" class="bold">(6)</num><heading class="bold"> Evaluation</heading><content><p style="-uslm-lc:I12" class="indent1">As a condition of receiving a grant under this subsection, each grant recipient shall agree to cooperate in an evaluation by the Secretary of the program carried out using grant funds.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabeb283f-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/7"><num value="7" class="bold">(7)</num><heading class="bold"> Technical assistance</heading><chapeau>The Secretary shall provide technical assistance and information to assist eligible schools, State and local agencies, Indian tribal organizations, and nonprofit entities—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb2840-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/7/A"><num value="A">(A)</num><content> to facilitate the coordination and sharing of information and resources in the Department that may be applicable to the farm to school program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb4f51-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/7/B"><num value="B">(B)</num><content> to collect and share information on best practices; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabeb4f52-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/7/C"><num value="C">(C)</num><content> to disseminate research and data on existing farm to school programs and the potential for programs in underserved areas.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabeb4f53-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/8"><num value="8" class="bold">(8)</num><heading class="bold"> Funding</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeb4f54-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/8/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">On <date date="2012-10-01">October 1, 2012</date>, and each October 1 thereafter, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary to carry out this subsection $5,000,000, to remain available until expended.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeb4f55-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/8/B"><num value="B" class="bold">(B)</num><heading class="bold"> Receipt and acceptance</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall be entitled to receive, shall accept, and shall use to carry out this subsection the funds transferred under subparagraph (A), without further appropriation.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabeb4f56-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/g/9"><num value="9" class="bold">(9)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">In addition to the amounts made available under paragraph (8), there are authorized to be appropriated to carry out this subsection such sums as are necessary for each of fiscal years 2011 through 2015.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabeb7667-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h"><num value="h" class="bold">(h)</num><heading class="bold"> Pilot program for high-poverty schools</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabeb7668-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeb7669-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Definitions</heading><chapeau>In this paragraph:</chapeau><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idabeb766a-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> Eligible program</heading><chapeau>The term “eligible program” means—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idabeb766b-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/A/i/I"><num value="I">(I)</num><content> a school-based program with hands-on vegetable gardening and nutrition education that is incorporated into the curriculum for 1 or more grades at 2 or more eligible schools; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idabeb766c-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/A/i/II"><num value="II">(II)</num><content> a community-based summer program with hands-on vegetable gardening and nutrition education that is part of, or coordinated with, a summer enrichment program at 2 or more eligible schools.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idabeb766d-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Eligible school</heading><content><p style="-uslm-lc:I14" class="indent3">The term “eligible school” means a public school, at least 50 percent of the students of which are eligible for free or reduced price meals under this chapter.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeb766e-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Establishment</heading><chapeau>The Secretary shall carry out a pilot program under which the Secretary shall provide to nonprofit organizations or public entities in not more than 5 States grants to develop and run, through eligible programs, community gardens at eligible schools in the States that would—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idabeb9d7f-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/B/i"><num value="i">(i)</num><content> be planted, cared for, and harvested by students at the eligible schools; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeb9d80-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/B/ii"><num value="ii">(ii)</num><content> teach the students participating in the community gardens about agriculture production practices and diet.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeb9d81-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Priority States</heading><chapeau>Of the States in which grantees under this paragraph are located—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idabeb9d82-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/C/i"><num value="i">(i)</num><content> at least 1 State shall be among the 15 largest States, as determined by the Secretary;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeb9d83-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/C/ii"><num value="ii">(ii)</num><content> at least 1 State shall be among the 16th to 30th largest States, as determined by the Secretary; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeb9d84-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/C/iii"><num value="iii">(iii)</num><content> at least 1 State shall be a State that is not described in clause (i) or (ii).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeb9d85-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Use of produce</heading><chapeau>Produce from a community garden provided a grant under this paragraph may be—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idabeb9d86-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/D/i"><num value="i">(i)</num><content> used to supplement food provided at the eligible school;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeb9d87-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/D/ii"><num value="ii">(ii)</num><content> distributed to students to bring home to the families of the students; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabeb9d88-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/D/iii"><num value="iii">(iii)</num><content> donated to a local food bank or senior center nutrition program.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabeb9d89-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/E"><num value="E" class="bold">(E)</num><heading class="bold"> No cost-sharing requirement</heading><content><p style="-uslm-lc:I13" class="indent2">A nonprofit organization or public entity that receives a grant under this paragraph shall not be required to share the cost of carrying out the activities assisted under this paragraph.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabebc49a-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/h/1/F"><num value="F" class="bold">(F)</num><heading class="bold"> Evaluation</heading><content><p style="-uslm-lc:I13" class="indent2">A nonprofit organization or public entity that receives a grant under this paragraph shall be required to cooperate in an evaluation carried out by the Secretary.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabebc49c-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i"><num value="i" class="bold">(i)</num><heading class="bold"> Year-round services for eligible entities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabebc49d-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>A service institution that is described in <ref href="/us/usc/t42/s1761/a/6">section 1761(a)(6) of this title</ref> (excluding a public school), or a private nonprofit organization described in <ref href="/us/usc/t42/s1761/a/7">section 1761(a)(7) of this title</ref>, and that is located in the State of California may be reimbursed—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idabebc49e-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/1/A"><num value="A">(A)</num><chapeau> for up to 2 meals during each day of operation served—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idabebc49f-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/1/A/i"><num value="i">(i)</num><content> during the months of May through September;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabebc4a0-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/1/A/ii"><num value="ii">(ii)</num><content> in the case of a service institution that operates a food service program for children on school vacation, at anytime under a continuous school calendar; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabebebb1-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/1/A/iii"><num value="iii">(iii)</num><content> in the case of a service institution that provides meal service at a nonschool site to children who are not in school for a period during the school year due to a natural disaster, building repair, court order, or similar case, at anytime during such a period; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabebebb2-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/1/B"><num value="B">(B)</num><content> for a snack served during each day of operation after school hours, weekends, and school holidays during the regular school calendar.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabebebb3-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> Payments</heading><content><p style="-uslm-lc:I12" class="indent1">The service institution shall be reimbursed consistent with <ref href="/us/usc/t42/s1761/b/1">section 1761(b)(1) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabebebb4-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/3"><num value="3" class="bold">(3)</num><heading class="bold"> Administration</heading><content><p style="-uslm-lc:I12" class="indent1">To receive reimbursement under this subsection, a service institution shall comply with <ref href="/us/usc/t42/s1761">section 1761 of this title</ref>, other than subsections (b)(2) and (c)(1) of that section.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabebebb5-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/4"><num value="4" class="bold">(4)</num><heading class="bold"> Evaluation</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than <date date="2007-09-30">September 30, 2007</date>, the State agency shall submit to the Secretary a report on the effect of this subsection on participation in the summer food service program for children established under <ref href="/us/usc/t42/s1761">section 1761 of this title</ref>.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabec12c6-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/i/5"><num value="5" class="bold">(5)</num><heading class="bold"> Funding</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall provide to the State of California such sums as are necessary to carry out this subsection for each of fiscal years 2011 through 2015.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabec12c7-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j"><num value="j" class="bold">(j)</num><heading class="bold"> Free lunch and breakfast eligibility</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabec12c8-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to the availability of funds under paragraph (4), the Secretary shall expand the service of free lunches and breakfasts provided at schools participating in the school lunch program under this chapter or the school breakfast program under <ref href="/us/usc/t42/s1773">section 1773 of this title</ref> in all or part of 5 States selected by the Secretary (of which at least 1 shall be a largely rural State with a significant Native American population).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabec12c9-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/2"><num value="2" class="bold">(2)</num><heading class="bold"> Income eligibility</heading><content><p style="-uslm-lc:I12" class="indent1">The income guidelines for determining eligibility for free lunches or breakfasts under this subsection shall be 185 percent of the applicable family size income levels contained in the nonfarm income poverty guidelines prescribed by the Office of Management and Budget, as adjusted annually in accordance with <ref href="/us/usc/t42/s1758/b/1/B">section 1758(b)(1)(B) of this title</ref>.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabec39da-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3"><num value="3" class="bold">(3)</num><heading class="bold"> Evaluation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabec39db-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 3 years after the implementation of this subsection, the Secretary shall conduct an evaluation to assess the impact of the changed income eligibility guidelines by comparing the school food authorities operating under this subsection to school food authorities not operating under this subsection.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabec39dc-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Impact assessment</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idabec39dd-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Children</heading><chapeau>The evaluation shall assess the impact of this subsection separately on—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idabec39de-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B/i/I"><num value="I">(I)</num><content> children in households with incomes less than 130 percent of the applicable family income levels contained in the nonfarm poverty income guidelines prescribed by the Office of Management and Budget, as adjusted annually in accordance with <ref href="/us/usc/t42/s1758/b/1/B">section 1758(b)(1)(B) of this title</ref>; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idabec39df-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B/i/II"><num value="II">(II)</num><content> children in households with incomes greater than 130 percent and not greater than 185 percent of the applicable family income levels contained in the nonfarm poverty income guidelines prescribed by the Office of Management and Budget, as adjusted annually in accordance with <ref href="/us/usc/t42/s1758/b/1/B">section 1758(b)(1)(B) of this title</ref>.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idabec60f0-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Factors</heading><chapeau>The evaluation shall assess the impact of this subsection on—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idabec60f1-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B/ii/I"><num value="I">(I)</num><content> certification and participation rates in the school lunch and breakfast programs;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idabec60f2-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B/ii/II"><num value="II">(II)</num><content> rates of lunch- and breakfast-skipping;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idabec60f3-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B/ii/III"><num value="III">(III)</num><content> academic achievement;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idabec60f4-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B/ii/IV"><num value="IV">(IV)</num><content> the allocation of funds authorized in title I of the Elementary and Secondary Education Act [<ref href="/us/usc/t20/s6301">20 U.S.C. 6301</ref> et seq.] to local educational agencies and public schools; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idabec60f5-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/B/ii/V"><num value="V">(V)</num><content> other factors determined by the Secretary.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabec60f6-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Cost assessment</heading><content><p style="-uslm-lc:I13" class="indent2">The evaluation shall assess the increased costs associated with providing additional free, reduced price, or paid meals in the school food authorities operating under this subsection.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabec60f7-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I13" class="indent2">On completion of the evaluation, the Secretary shall submit to the Committee on Education and the Workforce of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report describing the results of the evaluation under this paragraph.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabec8808-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/j/4"><num value="4" class="bold">(4)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">There are authorized to be appropriated such sums as are necessary to carry out this subsection, to remain available until expended.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabec8809-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k"><num value="k" class="bold">(k)</num><heading class="bold"> Organic food pilot program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabec880a-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish an organic food pilot program (referred to in this subsection as the “pilot program”) under which the Secretary shall provide grants on a competitive basis to school food authorities selected under paragraph (3).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabec880b-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/2"><num value="2" class="bold">(2)</num><heading class="bold"> Use of funds</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabec880c-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The Secretary shall use funds provided under this section—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idabec880d-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/2/A/i"><num value="i">(i)</num><content> to enter into competitively awarded contracts or cooperative agreements with school food authorities selected under paragraph (3); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabec880e-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/2/A/ii"><num value="ii">(ii)</num><content> to make grants to school food authority applicants selected under paragraph (3).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabec880f-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> School food authority uses of funds</heading><content><p style="-uslm-lc:I13" class="indent2">A school food authority that receives a grant under this section shall use the grant funds to establish a pilot program that increases the quantity of organic foods provided to schoolchildren under the school lunch program established under this chapter.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabecaf20-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/3"><num value="3" class="bold">(3)</num><heading class="bold"> Application</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabecaf21-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">A school food authority seeking a contract, grant, or cooperative agreement under this subsection shall submit to the Secretary an application in such form, containing such information, and at such time as the Secretary shall prescribe.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idabecaf22-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Criteria</heading><chapeau>In selecting contract, grant, or cooperative agreement recipients, the Secretary shall consider—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idabecaf23-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/3/B/i"><num value="i">(i)</num><content> the poverty line (as defined in <ref href="/us/usc/t42/s9902/2">section 9902(2) of this title</ref>, including any revision required by that section)) <ref class="footnoteRef" idref="fn003132">1</ref><note type="footnote" id="fn003132"><num>1</num> So in original.</note> applicable to a family of the size involved of the households in the district served by the school food authority, giving preference to school food authority applicants in which not less than 50 percent of the households in the district are at or below the Federal poverty line;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabecaf24-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/3/B/ii"><num value="ii">(ii)</num><chapeau> the commitment of each school food authority applicant—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idabecd635-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/3/B/ii/I"><num value="I">(I)</num><content> to improve the nutritional value of school meals;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idabecd636-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/3/B/ii/II"><num value="II">(II)</num><content> to carry out innovative programs that improve the health and wellness of schoolchildren; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idabecd637-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/3/B/ii/III"><num value="III">(III)</num><content> to evaluate the outcome of the pilot program; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idabecd638-c149-11ea-9926-d3ea3d33fdd4" identifier="/us/usc/t42/s1769/k/3/B/iii"><num value="iii">(iii)</num><content> any other criteria the Secretary determines to be appropriate.</content>
