<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id521b7512-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a"><num value="1769a">§ 1769a.</num><heading> Fresh fruit and vegetable program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id521b7513-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">For the school year beginning July 2008 and each subsequent school year, the Secretary shall provide grants to States to carry out a program to make free fresh fruits and vegetables available in elementary schools (referred to in this section as the “program”).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id521b7514-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Program</heading><content><p style="-uslm-lc:I11" class="indent0">A school participating in the program shall make free fresh fruits and vegetables available to students throughout the school day (or at such other times as are considered appropriate by the Secretary) in 1 or more areas designated by the school.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id521b7515-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Funding to States</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7516-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Minimum grant</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in subsection (i)(2), the Secretary shall provide to each of the 50 States and the District of Columbia an annual grant in an amount equal to 1 percent of the funds made available for a year to carry out the program.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7517-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Additional funding</heading><chapeau style="-uslm-lc:I12" class="indent1">Of the funds remaining after grants are made under paragraph (1), the Secretary shall allocate additional funds to each State that is operating a school lunch program under <ref href="/us/usc/t42/s1753">section 1753 of this title</ref> based on the proportion that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id521b7518-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/c/2/A"><num value="A">(A)</num><content> the population of the State; bears to</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id521b7519-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/c/2/B"><num value="B">(B)</num><content> the population of the United States.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id521b751a-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Selection of schools</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b751b-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (2) of this subsection and section 4304(a)(2) of the Food, Conservation, and Energy Act of 2008, each year, in selecting schools to participate in the program, each State shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id521b751c-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/A"><num value="A">(A)</num><chapeau> ensure that each school chosen to participate in the program is a school—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id521b751d-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/A/i"><num value="i">(i)</num><content> in which not less than 50 percent of the students are eligible for free or reduced price meals under this chapter; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id521b751e-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/A/ii"><num value="ii">(ii)</num><content> that submits an application in accordance with subparagraph (D);</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id521b751f-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/B"><num value="B">(B)</num><content> to the maximum extent practicable, give the highest priority to schools with the highest proportion of children who are eligible for free or reduced price meals under this chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id521b7520-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/C"><num value="C">(C)</num><content> ensure that each school selected is an elementary school (as defined in section 7801 <ref class="footnoteRef" idref="fn003196">1</ref><note type="footnote" id="fn003196"><num>1</num> See References in Text note below.</note> of title 20);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id521b7521-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/D"><num value="D">(D)</num><chapeau> solicit applications from interested schools that include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id521b7522-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/D/i"><num value="i">(i)</num><content> information pertaining to the percentage of students enrolled in the school submitting the application who are eligible for free or reduced price school lunches under this chapter;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id521b7523-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/D/ii"><num value="ii">(ii)</num><content> a certification of support for participation in the program signed by the school food manager, the school principal, and the district superintendent (or equivalent positions, as determined by the school);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id521b7524-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/D/iii"><num value="iii">(iii)</num><content> a plan for implementation of the program, including efforts to integrate activities carried out under this section with other efforts to promote sound health and nutrition, reduce overweight and obesity, or promote physical activity; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id521b7525-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/D/iv"><num value="iv">(iv)</num><content> such other information as may be requested by the Secretary; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id521b7526-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/1/E"><num value="E">(E)</num><content> encourage applicants to submit a plan for implementation of the program that includes a partnership with 1 or more entities that will provide non-Federal resources (including entities representing the fruit and vegetable industry).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7527-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exception</heading><content><p style="-uslm-lc:I12" class="indent1">Clause (i) of paragraph (1)(A) shall not apply to a State if all schools that meet the requirements of that clause have been selected and the State does not have a sufficient number of additional schools that meet the requirement of that clause.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7528-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Outreach to low-income schools</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id521b7529-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Prior to making decisions regarding school participation in the program, a State agency shall inform the schools within the State with the highest proportion of free and reduced price meal eligibility, including Native American schools, of the eligibility of the schools for the program with respect to priority granted to schools with the highest proportion of free and reduced price eligibility under paragraph (1)(B).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id521b752a-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Requirement</heading><content><p style="-uslm-lc:I13" class="indent2">In providing information to schools in accordance with subparagraph (A), a State agency shall inform the schools that would likely be chosen to participate in the program under paragraph (1)(B).</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id521b752b-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Notice of availability</heading><content><p style="-uslm-lc:I11" class="indent0">If selected to participate in the program, a school shall widely publicize within the school the availability of free fresh fruits and vegetables under the program.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id521b752c-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/f"><num value="f" class="bold">(f)</num><heading class="bold"> Per-student grant</heading><chapeau style="-uslm-lc:I11" class="indent0">The per-student grant provided to a school under this section shall be—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id521b752d-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/f/1"><num value="1">(1)</num><content> determined by a State agency; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id521b752e-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/f/2"><num value="2">(2)</num><content> not less than $50, nor more than $75.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id521b752f-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/g"><num value="g" class="bold">(g)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I11" class="indent0">To the maximum extent practicable, each State agency shall ensure that in making the fruits and vegetables provided under this section available to students, schools offer the fruits and vegetables separately from meals otherwise provided at the school under this chapter or the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id521b7530-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/h"><num value="h" class="bold">(h)</num><heading class="bold"> Evaluation and reports</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7531-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall conduct an evaluation of the program, including a determination as to whether children experienced, as a result of participating in the program—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id521b7532-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/h/1/A"><num value="A">(A)</num><content> increased consumption of fruits and vegetables;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id521b7533-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/h/1/B"><num value="B">(B)</num><content> other dietary changes, such as decreased consumption of less nutritious foods; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id521b7534-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/h/1/C"><num value="C">(C)</num><content> such other outcomes as are considered appropriate by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7535-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than <date date="2011-09-30">September 30, 2011</date>, the Secretary shall submit to the Committee on Education and Labor of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that describes the results of the evaluation under paragraph (1).</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id521b7536-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i"><num value="i" class="bold">(i)</num><heading class="bold"> Funding</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7537-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Out of the funds made available under subsection (b)(2)(A) of <ref href="/us/usc/t7/s612c–6">section 612c–6 of title 7</ref>, the Secretary shall use the following amounts to carry out this section:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id521b7538-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/1/A"><num value="A">(A)</num><content> On <date date="2008-10-01">October 1, 2008</date>, $40,000,000.</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id521b753c-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/1/E"><num value="E">(E)</num><content> On <date date="2012-07-01">July 1, 2012</date>, and each July 1 thereafter, the amount made available for the preceding fiscal year, as adjusted to reflect changes for the 12-month period ending the preceding April 30 in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor, for items other than food.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b753d-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> Maintenance of existing funding</heading><content><p style="-uslm-lc:I12" class="indent1">In allocating funding made available under paragraph (1) among the States in accordance with subsection (c), the Secretary shall ensure that each State that received funding under <ref href="/us/usc/t42/s1769/f">section 1769(f) of this title</ref> on the day before the date of enactment of the Food, Conservation, and Energy Act of 2008 shall continue to receive sufficient funding under this section to maintain the caseload level of the State under that section as in effect on that date.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b753e-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/3"><num value="3" class="bold">(3)</num><heading class="bold"> Evaluation funding</heading><content><p style="-uslm-lc:I12" class="indent1">On <date date="2008-10-01">October 1, 2008</date>, out of any funds made available under subsection (b)(2)(A) of <ref href="/us/usc/t7/s612c–6">section 612c–6 of title 7</ref>, the Secretary shall use to carry out the evaluation required under subsection (h), $3,000,000, to remain available for obligation until <date date="2010-09-30">September 30, 2010</date>.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b753f-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/4"><num value="4" class="bold">(4)</num><heading class="bold"> Receipt and acceptance</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall be entitled to receive, shall accept, and shall use to carry out this section any funds transferred for that purpose, without further appropriation.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7540-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/5"><num value="5" class="bold">(5)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I12" class="indent1">In addition to any other amounts made available to carry out this section, there are authorized to be appropriated such sums as are necessary to expand the program established under this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7541-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/6"><num value="6" class="bold">(6)</num><heading class="bold"> Administrative costs</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id521b7542-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Of funds made available to carry out this section for a fiscal year, the Secretary may use not more than $500,000 for the administrative costs of carrying out the program.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id521b7543-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Reservation of funds</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall allow each State to reserve such funding as the Secretary determines to be necessary to administer the program in the State (with adjustments for the size of the State and the grant amount), but not to exceed the amount required to pay the costs of 1 full-time coordinator for the program in the State.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id521b7544-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/7"><num value="7" class="bold">(7)</num><heading class="bold"> Reallocation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id521b7545-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s1769a/i/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> Among States</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may reallocate any amounts made available to carry out this section that are not obligated or expended by a date determined by the Secretary.</p>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>Subject to subsection (b), in the 2014–2015 school year, the Secretary [of Agriculture] shall carry out a pilot project in schools participating in the Fresh Fruit and Vegetable Program under section 19 of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1769a">42 U.S.C. 1769a</ref>) (referred to in this section as the “Program”), in not less than 5 States, to evaluate the impact of allowing schools to offer canned, frozen, or dried fruits and vegetables as part of the Program.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Requirements</inline>.—</heading><content>Not later than 60 days after the date of enactment of this Act [<date date="2014-02-14">Feb. 14, 2014</date>], the Secretary shall establish criteria for the conditions under which canned, frozen, or dried fruits and vegetables may be offered, which shall be in accordance with the most recent Dietary Guidelines for Americans published under section 301 of the National Nutrition Monitoring and Related Research Act of 1990 (<ref href="/us/usc/t7/s5341">7 U.S.C. 5341</ref>).</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Evaluation</inline>.—</heading><chapeau>With respect to the pilot project, the Secretary shall evaluate—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the impacts on fruit and vegetable consumption at the schools participating in the pilot project;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the impacts of the pilot project on school participation in the Program and operation of the Program;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the implementation strategies used by the schools participating in the pilot project;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> the acceptance of the pilot project by key stakeholders; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> such other outcomes as are determined by the Secretary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Reports.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Interim report</inline>.—</heading><content>Not later than <date date="2015-01-01">January 1, 2015</date>, the Secretary shall submit to the Committee on Education and [the] Workforce of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that describes the results of the evaluation under subsection (c).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Final report</inline>.—</heading><content>On completion of the pilot project, the Secretary shall submit to the Committee on Education and [the] Workforce of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that describes the results of the evaluation under subsection (c).</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Notice of Availability</inline>.—</heading><content>As soon as practicable after the date on which the Secretary establishes the criteria for the pilot project under subsection (b), the Secretary shall notify potentially eligible schools of the potential eligibility of the schools for participation in the pilot project.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Relationship to Fresh Fruit and Vegetable Program</inline>.—</heading><content>Nothing in this section permits a school that is not a part of the pilot project to offer anything other than fresh fruits and vegetables through the Program.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> <inline class="small-caps">Funding</inline>.—</heading><content>The Secretary shall use $5,000,000 of amounts otherwise made available to the Secretary to carry out this section.”</content>

Russell National School Lunch Act (<ref href="/us/usc/t42/s1769/f">42 U.S.C. 1769(f)</ref>) (as in effect on the day before the date of enactment of this Act [<date date="2008-06-18">June 18, 2008</date>]) to the program established under section 19 of that Act [<ref href="/us/usc/t42/s1769a">42 U.S.C. 1769a</ref>] (as amended by paragraph (1))—</chapeau><clause style="-uslm-lc:I22" class="indent1"><num value="i">“(i)</num><content> for the school year beginning <date date="2008-07-01">July 1, 2008</date>, the Secretary [of Agriculture] may permit any school selected for participation under section 18(f) of that Act (<ref href="/us/usc/t42/s1769/f">42 U.S.C. 1769(f)</ref>) for that school year to continue to participate under section 19 of that Act [<ref href="/us/usc/t42/s1769a">42 U.S.C. 1769a</ref>] until the end of that school year; and</content>
