and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9d8ff20-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/a/2\"><num value=\"2\">(2)</num><content> providing training, technical advice, and guidance in identifying and preventing the activities.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9d8ff21-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As used in this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d8ff22-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Child nutrition program</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “child nutrition program” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d8ff23-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/1/A\"><num value=\"A\">(A)</num><content> the school lunch program established under this chapter;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d8ff24-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/1/B\"><num value=\"B\">(B)</num><content> the summer food service program for children established under <ref href=\"/us/usc/t42/s1761\">section 1761 of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d8ff25-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/1/C\"><num value=\"C\">(C)</num><content> the child and adult care food program established under <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d8ff26-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/1/D\"><num value=\"D\">(D)</num><content> the special milk program established under <ref href=\"/us/usc/t42/s1772\">section 1772 of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d8ff27-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/1/E\"><num value=\"E\">(E)</num><content> the school breakfast program established under <ref href=\"/us/usc/t42/s1773\">section 1773 of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d8ff28-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/1/F\"><num value=\"F\">(F)</num><content> the special supplemental nutrition program for women, infants, and children authorized under <ref href=\"/us/usc/t42/s1786\">section 1786 of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d92639-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contractor</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “contractor” means a person that contracts with a State, an agency of a State, or a local agency to provide goods or services in relation to the participation of a local agency in a child nutrition program.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d9263a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Local agency</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “local agency” means a school, school food authority, child care center, sponsoring organization, or other entity authorized to operate a child nutrition program at the local level.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d9263b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Nonprocurement debarment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “nonprocurement debarment” means an action to bar a person from programs and activities involving Federal financial and nonfinancial assistance, but not including Federal procurement programs and activities.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d9263c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/b/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Person</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “person” means any individual, corporation, partnership, association, cooperative, or other legal entity, however organized.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9d9263d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Assistance to identify and prevent fraud and anticompetitive activities</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9d9263e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/c/1\"><num value=\"1\">(1)</num><content> in cooperation with any other appropriate individual, organization, or agency, provide advice, training, technical assistance, and guidance (which may include awareness training, training films, and troubleshooting advice) to representatives of States and local agencies regarding means of identifying and preventing fraud and anticompetitive activities relating to the provision of goods or services in conjunction with the participation of a local agency in a child nutrition program; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9d94d4f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/c/2\"><num value=\"2\">(2)</num><content> provide information to, and fully cooperate with, the Attorney General and State attorneys general regarding investigations of fraud and anticompetitive activities relating to the provision of goods or services in conjunction with the participation of a local agency in a child nutrition program.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9d94d50-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Nonprocurement debarment</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d94d51-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as provided in paragraph (3) and subsection (e), not later than 180 days after notification of the occurrence of a cause for debarment described in paragraph (2), the Secretary shall initiate nonprocurement debarment proceedings against the contractor who has committed the cause for debarment.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d97462-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Causes for debarment</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Actions requiring initiation of nonprocurement debarment pursuant to paragraph (1) shall include a situation in which a contractor is found guilty in any criminal proceeding, or found liable in any civil or administrative proceeding, in connection with the supplying, providing, or selling of goods or services to any local agency in connection with a child nutrition program, of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d97463-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/2/A\"><num value=\"A\">(A)</num><content> an anticompetitive activity, including bid-rigging, price-fixing, the allocation of customers between competitors, or other violation of Federal or State antitrust laws;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d97464-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/2/B\"><num value=\"B\">(B)</num><content> fraud, bribery, theft, forgery, or embezzlement;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d97465-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/2/C\"><num value=\"C\">(C)</num><content> knowingly receiving stolen property;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d97466-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/2/D\"><num value=\"D\">(D)</num><content> making a false claim or statement; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9d97467-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/2/E\"><num value=\"E\">(E)</num><content> any other obstruction of justice.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d97468-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If the Secretary determines that a decision on initiating nonprocurement debarment proceedings cannot be made within 180 days after notification of the occurrence of a cause for debarment described in paragraph (2) because of the need to further investigate matters relating to the possible debarment, the Secretary may have such additional time as the Secretary considers necessary to make a decision, but not to exceed an additional 180 days.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d99b79-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Mandatory child nutrition program debarment periods</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9d99b7a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Subject to the other provisions of this paragraph and notwithstanding any other provision of law except subsection (e), if, after deciding to initiate nonprocurement debarment proceedings pursuant to paragraph (1), the Secretary decides to debar a contractor, the debarment shall be for a period of not less than 3 years.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9d99b7b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Previous debarment</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If the contractor has been previously debarred pursuant to nonprocurement debarment proceedings initiated pursuant to paragraph (1), and the cause for debarment is described in paragraph (2) based on activities that occurred subsequent to the initial debarment, the debarment shall be for a period of not less than 5 years.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9d99b7c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/4/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Scope</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">At a minimum, a debarment under this subsection shall serve to bar the contractor for the specified period from contracting to provide goods or services in conjunction with the participation of a local agency in a child nutrition program.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9d9c28d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/4/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Reversal, reduction, or exception</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Nothing in this section shall restrict the ability of the Secretary to—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9d9c28e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/4/D/i\"><num value=\"i\">(i)</num><content> reverse a debarment decision;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9d9c28f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/4/D/ii\"><num value=\"ii\">(ii)</num><content> reduce the period or scope of a debarment;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9d9c290-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/4/D/iii\"><num value=\"iii\">(iii)</num><content> grant an exception permitting a debarred contractor to participate in a particular contract to provide goods or services; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9d9c291-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/4/D/iv\"><num value=\"iv\">(iv)</num><content> otherwise settle a debarment action at any time;</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I32\" class=\"indent2 firstIndent0\">in conjunction with the participation of a local agency in a child nutrition program, if the Secretary determines there is good cause for the action, after taking into account factors set forth in paragraphs (1) through (6) of subsection (e).</continuation>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d9c292-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Information</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">On request, the Secretary shall present to the Committee on Education and Labor, and the Committee on Agriculture, of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate information regarding the decisions required by this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d9e9a3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Relationship to other authorities</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A debarment imposed under this section shall not reduce or diminish the authority of a Federal, State, or local government agency or court to penalize, imprison, fine, suspend, debar, or take other adverse action against a person in a civil, criminal, or administrative proceeding.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9d9e9a4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/d/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Regulations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall issue such regulations as are necessary to carry out this subsection.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9d9e9a5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Mandatory debarment</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any other provision of this section, the Secretary shall initiate nonprocurement debarment proceedings against the contractor (including any cooperative) who has committed the cause for debarment (as determined under subsection (d)(2)), unless the action—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9d9e9a6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/e/1\"><num value=\"1\">(1)</num><content> is likely to have a significant adverse effect on competition or prices in the relevant market or nationally;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9d9e9a7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/e/2\"><num value=\"2\">(2)</num><content> will interfere with the ability of a local agency to procure a needed product for a child nutrition program;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9da10b8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/e/3\"><num value=\"3\">(3)</num><content> is unfair to a person, subsidiary corporation, affiliate, parent company, or local division of a corporation that is not involved in the improper activity that would otherwise result in the debarment;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9da10b9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/e/4\"><num value=\"4\">(4)</num><content> is likely to have significant adverse economic impacts on the local economy in a manner that is unfair to innocent parties;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9da10ba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/e/5\"><num value=\"5\">(5)</num><content> is not justified in light of the penalties already imposed on the contractor for violations relevant to the proposed debarment, including any suspension or debarment arising out of the same matter that is imposed by any Federal or State agency; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9da10bb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/e/6\"><num value=\"6\">(6)</num><content> is not in the public interest, or otherwise is not in the interests of justice, as determined by the Secretary.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9da10bc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Exhaustion of administrative remedies</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Prior to seeking judicial review in a court of competent jurisdiction, a contractor against whom a nonprocurement debarment proceeding has been initiated shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9da10bd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1769f/f/1\"><num value=\"1\">(1)</num><content> exhaust all administrative procedures prescribed by the Secretary;
