<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida9dbe5b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1769j"><num value="1769j">§ 1769j.</num><heading> Ensuring safety of school meals</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9dbe5b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1769j/a"><num value="a" class="bold">(a)</num><heading class="bold"> Food and Nutrition Service</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 1 year after <date date="2010-12-13">December 13, 2010</date>, the Secretary, acting through the Administrator of the Food and Nutrition Service, shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida9dbe5b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1769j/a/1"><num value="1">(1)</num><content> in consultation with the Administrator of the Agricultural Marketing Service and the Administrator of the Farm Service Agency, develop guidelines to determine the circumstances under which it is appropriate for the Secretary to institute an administrative hold on suspect foods purchased by the Secretary that are being used in school meal programs under this chapter and the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.);</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="ida9dc0cca-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1769j/a/2"><num value="2">(2)</num><content> work with States to explore ways for the States to increase the timeliness of notification of food recalls to schools and school food authorities;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="ida9dc0ccb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1769j/a/3"><num value="3">(3)</num><content> improve the timeliness and completeness of direct communication between the Food and Nutrition Service and States about holds and recalls, such as through the commodity alert system of the Food and Nutrition Service; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="ida9dc0ccc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1769j/a/4"><num value="4">(4)</num><content> establish a timeframe to improve the commodity hold and recall procedures of the Department of Agriculture to address the role of processors and determine the involvement of distributors with processed products that may contain recalled ingredients, to facilitate the provision of more timely and complete information to schools.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9dc0ccd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1769j/b"><num value="b" class="bold">(b)</num><heading class="bold"> Food Safety and Inspection Service</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 1 year after <date date="2010-12-13">December 13, 2010</date>, the Secretary, acting through the Administrator of the Food Safety and Inspection Service, shall revise the procedures of the Food Safety and Inspection Service to ensure that schools are included in effectiveness checks.</p>
