Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1753\">42 U.S.C. 1753</ref>, 1759a, 1766] and 1772 and 1773 of this title during the second preceding fiscal year.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e29ce3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Allocation</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall allocate the funds so provided in accordance with paragraphs (2), (3), and (4) of this subsection.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e29ce4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Expense grants</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e29ce5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Subject to subparagraph (B), the Secretary shall allocate to each State for administrative costs incurred in any fiscal year in connection with the programs authorized under the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.] or under this chapter, except for the programs authorized under section 13 or 17 of the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1761\">42 U.S.C. 1761</ref>, 1766] or under <ref href=\"/us/usc/t42/s1786\">section 1786 of this title</ref>, an amount equal to not less than 1 percent and not more than 1½ percent of the funds expended by each State under sections 4 and 11 of the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1753\">42 U.S.C. 1753</ref>, 1759a] and sections 1772 and 1773 of this title during the second preceding fiscal year.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e2c3f6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Minimum amount</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e2c3f7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/2/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">In no case shall the grant available to any State under this paragraph be less than the amount such State was allocated in the fiscal year ending <date date=\"1981-09-30\">September 30, 1981</date>, or $200,000 (as adjusted under clause (ii),<ref class=\"footnoteRef\" idref=\"fn003138\">1</ref><note type=\"footnote\" id=\"fn003138\"><num>1</num> So in original. Probably should be preceded by an additional closing parenthesis.</note> whichever is larger.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e2c3f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/2/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Adjustment</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">On <date date=\"2008-10-01\">October 1, 2008</date>, and each October 1 thereafter, the minimum dollar amount for a fiscal year specified in clause (i) shall be adjusted to reflect the percentage change between—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e2c3f9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/2/B/ii/I\"><num value=\"I\">(I)</num><content> the value of the index for State and local government purchases, as published by the Bureau of Economic Analysis of the Department of Commerce, for the 12-month period ending June 30 of the second preceding fiscal year; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e2eb0a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/2/B/ii/II\"><num value=\"II\">(II)</num><content> the value of that index for the 12-month period ending June 30 of the preceding fiscal year.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e2eb0b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/3\"><num value=\"3\">(3)</num><content> The Secretary shall allocate to each State for its administrative costs incurred under the program authorized by section 17 of the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1766\">42 U.S.C. 1766</ref>] in any fiscal year an amount, based upon funds expended under that program in the second preceding fiscal year, equal to (A) 20 percent of the first $50,000, (B) 10 percent of the next $100,000, (C) 5 percent of the next $250,000, and (D) 2½ percent of any remaining funds. If an agency in the State other than the State educational agency administers such program, the State shall ensure that an amount equal to no less than the funds due the State under this paragraph is provided to such agency for costs incurred by such agency in administering the program, except as provided in paragraph (5). The Secretary may adjust any State’s allocation to reflect changes in the size of its program.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e2eb0c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/4\"><num value=\"4\">(4)</num><content> The remaining funds appropriated under this section shall be allocated among the States by the Secretary in amounts the Secretary determines necessary for the improvement in the States of the administration of the programs authorized under the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.] and this chapter, except for <ref href=\"/us/usc/t42/s1786\">section 1786 of this title</ref>, including, but not limited to, improved program integrity and the quality of meals served to children.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e3121d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/5\"><num value=\"5\">(5)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e3121e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/5/A\"><num value=\"A\">(A)</num><content> Not more than 25 percent of the amounts made available to each State under this section for the fiscal year 1991 and 20 percent of the amounts made available to each State under this section for the fiscal year 1992 and for each succeeding fiscal year may remain available for obligation or expenditure in the fiscal year succeeding the fiscal year for which such amounts were appropriated.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e3121f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/5/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Reallocation of funds.—</inline></heading><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9e31220-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/5/B/i\"><num value=\"i\">(i)</num><heading> <inline class=\"small-caps\">Return to secretary</inline>.—</heading><content>For each fiscal year, any amounts appropriated that are not obligated or expended during the fiscal year and are not carried over for the succeeding fiscal year under subparagraph (A) shall be returned to the Secretary.</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9e31221-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/5/B/ii\"><num value=\"ii\">(ii)</num><heading> <inline class=\"small-caps\">Reallocation by secretary</inline>.—</heading><content>The Secretary shall allocate, for purposes of administrative costs, any remaining amounts among States that demonstrate a need for the amounts.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e31222-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/6\"><num value=\"6\">(6)</num><heading> <inline class=\"small-caps\">Use of administrative funds</inline>.—</heading><content>Funds available to a State under this subsection and under section 13(k)(1) of the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1761/k/1\">42 U.S.C. 1761(k)(1)</ref>) may be used by the State for the costs of administration of the programs authorized under this chapter (except for the programs authorized under sections 1786 and 1790 of this title) and the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.) without regard to the basis on which the funds were earned and allocated.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e33833-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/7\"><num value=\"7\">(7)</num><content> Where the Secretary is responsible for the administration of programs under this chapter or the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.], the amount of funds that would be allocated to the State agency under this section and under section 13(k)(1) of the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1761/k/1\">42 U.S.C. 1761(k)(1)</ref>] shall be retained by the Secretary for the Secretary’s use in the administration of such programs.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e33834-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/8\"><num value=\"8\">(8)</num><content> In the fiscal year 1991 and each succeeding fiscal year, in accordance with regulations issued by the Secretary, each State shall ensure that the State agency administering the distribution of commodities under programs authorized under this chapter and under the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.] is provided, from funds made available to the State under this subsection, an appropriate amount of funds for administrative costs incurred in distributing such commodities. In developing such regulations, the Secretary may consider the value of commodities provided to the State under this chapter and under the Richard B. Russell National School Lunch Act.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e35f45-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/9\"><num value=\"9\">(9)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e35f46-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/9/A\"><num value=\"A\">(A)</num><content> If the Secretary determines that the administration of any program by a State under this chapter (other than <ref href=\"/us/usc/t42/s1786\">section 1786 of this title</ref>) or under the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.) (including any requirement to provide sufficient training, technical assistance, and monitoring of the child and adult care food program under section 17 of that Act (<ref href=\"/us/usc/t42/s1766\">42 U.S.C. 1766</ref>)), or compliance with a regulation issued pursuant to either this chapter or such Act, is seriously deficient, and the State fails to correct the deficiency within a specified period of time, the Secretary may withhold from the State some or all of the funds allocated to the State under this section or under section 13(k)(1) or 17 of the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1761/k/1\">42 U.S.C. 1761(k)(1)</ref> or 1766).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida9e35f47-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/a/9/B\"><num value=\"B\">(B)</num><content> On a subsequent determination by the Secretary that the administration of any program referred to in subparagraph (A), or compliance with the regulations issued to carry out the program, is no longer seriously deficient and is operated in an acceptable manner, the Secretary may allocate some or all of the funds withheld under such subparagraph.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9e38658-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Funds, usage: compensation, benefits, and travel expenses of personnel; support services; office equipment; staff development</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Funds paid to a State under subsection (a) of this section may be used to pay salaries, including employee benefits and travel expenses, for administrative and supervisory personnel; for support services; for office equipment; and for staff development.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9e38659-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Fund adjustment; State administered programs</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">If any State agency agrees to assume responsibility for the administration of food service programs in nonprofit private schools or child care institutions that were previously administered by the Secretary, an appropriate adjustment shall be made in the administrative funds paid under this section to the State not later than the succeeding fiscal year.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9e3865a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Unused funds; availability for obligation and expenditure, and reallocation to other States</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any other provision of law, funds made available to each State under this section shall remain available for obligation and expenditure by that State during the fiscal year immediately following the fiscal year for which such funds were made available. For each fiscal year the Secretary shall establish a date by which each State shall submit to the Secretary a plan for the disbursement of funds provided under this section for each such year, and the Secretary shall reallocate any unused funds, as evidenced by such plans, to other States as the Secretary considers appropriate.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9e3ad6b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Plans for use of administrative expense funds</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e3ad6c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each State shall submit to the Secretary for approval by October 1 of the initial fiscal year a plan for the use of State administrative expense funds, including a staff formula for State personnel, system level supervisory and operating personnel, and school level personnel.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e3ad6d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Updates and information management systems</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e3ad6e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/e/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">After submitting the initial plan, a State shall be required to submit to the Secretary for approval only a substantive change in the plan.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e3ad6f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/e/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Plan contents</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Each State plan shall, at a minimum, include a description of how technology and information management systems will be used to improve program integrity by—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e3d480-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/e/2/B/i\"><num value=\"i\">(i)</num><content> monitoring the nutrient content of meals served;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e3d481-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/e/2/B/ii\"><num value=\"ii\">(ii)</num><content> training local educational agencies, school food authorities, and schools in how to use technology and information management systems (including verifying eligibility for free or reduced price meals using program participation or income data gathered by State or local agencies); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e3d482-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/e/2/B/iii\"><num value=\"iii\">(iii)</num><content> using electronic data to establish benchmarks to compare and monitor program integrity, program participation, and financial data.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e3d483-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/e/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Training and technical assistance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each State shall submit to the Secretary for approval a plan describing the manner in which the State intends to implement subsection (g) and section 22(b)(3) of the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1769c/b/3\">42 U.S.C. 1769c(b)(3)</ref>].</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9e3d484-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> State funding requirement</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Payments of funds under this section shall be made only to States that agree to maintain a level of funding out of State revenues, for administrative costs in connection with programs under this chapter (except <ref href=\"/us/usc/t42/s1786\">section 1786 of this title</ref>) and the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.] (except section 13 of that Act [<ref href=\"/us/usc/t42/s1761\">42 U.S.C. 1761</ref>]), not less than the amount expended or obligated in fiscal year 1977, and that agree to participate fully in any studies authorized by the Secretary.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9e3fb95-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Professional standards for school food service</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e3fb96-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Criteria for school food service and State agency directors</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e3fb97-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> School food service directors</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e3fb98-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/A/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall establish a program of required education, training, and certification for all school food service directors responsible for the management of a school food authority.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e3fb99-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/A/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Requirements</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The program shall include—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e3fb9a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/A/ii/I\"><num value=\"I\">(I)</num><content> minimum educational requirements necessary to successfully manage the school lunch program established under the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.) and the school breakfast program established by <ref href=\"/us/usc/t42/s1773\">section 1773 of this title</ref>;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e3fb9b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/A/ii/II\"><num value=\"II\">(II)</num><content> minimum program training and certification criteria for school food service directors; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e3fb9c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/A/ii/III\"><num value=\"III\">(III)</num><content> minimum periodic training criteria to maintain school food service director certification.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e3fb9d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> School nutrition State agency directors</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall establish criteria and standards for States to use in the selection of State agency directors with responsibility for the school lunch program established under the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.) and the school breakfast program established by <ref href=\"/us/usc/t42/s1773\">section 1773 of this title</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e422ae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Training program partnership</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary may provide financial and other assistance to 1 or more professional food service management organizations—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e422af-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/C/i\"><num value=\"i\">(i)</num><content> to establish and manage the program under this paragraph; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e422b0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/C/ii\"><num value=\"ii\">(ii)</num><content> to develop voluntary training and certification programs for other school food service workers.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e422b1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Required date of compliance</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e422b2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/D/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> School food service directors</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall establish a date by which all school food service directors whose local educational agencies are participating in the school lunch program established under the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.) and the school breakfast program established by <ref href=\"/us/usc/t42/s1773\">section 1773 of this title</ref> shall be required to comply with the education, training, and certification criteria established in accordance with subparagraph (A).</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e422b3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/1/D/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> School nutrition State agency directors</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall establish a date by which all State agencies shall be required to comply with criteria and standards established in accordance with subparagraph (B) for the selection of State agency directors with responsibility for the school lunch program established under the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.) and the school breakfast program established by <ref href=\"/us/usc/t42/s1773\">section 1773 of this title</ref>.</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e449c4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Training and certification of food service personnel</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e449c5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Training for individuals conducting or overseeing administrative procedures</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e449c6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/A/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">At least annually, each State shall provide training in administrative practices (including training in application, certification, verification, meal counting, and meal claiming procedures) to local educational agency and school food authority personnel and other appropriate personnel.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e449c7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/A/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Federal role</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e449c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/A/ii/I\"><num value=\"I\">(I)</num><content> provide training and technical assistance described in clause (i) to the State; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e449c9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/A/ii/II\"><num value=\"II\">(II)</num><content> at the option of the Secretary, directly provide training and technical assistance described in clause (i).</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e449ca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/A/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Required participation</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">In accordance with procedures established by the Secretary, each local educational agency or school food authority shall ensure that an individual conducting or overseeing administrative procedures described in clause (i) receives training at least annually, unless determined otherwise by the Secretary.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e449cb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Training and certification of all local food service personnel</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e470dc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall provide training designed to improve—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e470dd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/i/I\"><num value=\"I\">(I)</num><content> the accuracy of approvals for free and reduced price meals; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e470de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/i/II\"><num value=\"II\">(II)</num><content> the identification of reimbursable meals at the point of service.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e470df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Certification of local personnel</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">In accordance with criteria established by the Secretary, local food service personnel shall complete annual training and receive annual certification—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e470e0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/ii/I\"><num value=\"I\">(I)</num><content> to ensure program compliance and integrity; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e470e1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/ii/II\"><num value=\"II\">(II)</num><content> to demonstrate competence in the training provided under clause (i).</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida9e470e2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Training modules</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">In addition to the topics described in clause (i), a training program carried out under this subparagraph shall include training modules on—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e470e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/iii/I\"><num value=\"I\">(I)</num><content> nutrition;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e470e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/iii/II\"><num value=\"II\">(II)</num><content> health and food safety standards and methodologies; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida9e470e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/2/B/iii/III\"><num value=\"III\">(III)</num><content> any other appropriate topics, as determined by the Secretary.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e470e6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Funding</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e470e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary to carry out this subsection, to remain available until expended—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e470e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/g/3/A/i\"><num value=\"i\">(i)</num><content> on <date date=\"2010-10-01\">October 1, 2010</date>, $5,000,000; Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1769c\">42 U.S.C. 1769c</ref>).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e49801-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/h/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary may retain a portion of the amount provided to cover costs of activities carried out by the Secretary in lieu of the State.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e4bf12-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/h/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Allocation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall allocate funds provided under this subsection to States based on the number of local educational agencies that have demonstrated a high level of, or a high risk for, administrative error, as determined by the Secretary, taking into account the requirements established by the Child Nutrition and WIC Reauthorization Act of 2004 and the amendments made by that Act.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e4bf13-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/h/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Reallocation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may reallocate, to carry out this section, any amounts made available to carry out this subsection that are not obligated or expended, as determined by the Secretary.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9e4bf14-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Technology infrastructure improvement</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e4bf15-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each State shall submit to the Secretary, for approval by the Secretary, an amendment to the plan required by subsection (e) that describes the manner in which funds provided under this section will be used for technology and information management systems.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e4bf16-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Requirements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The amendment shall, at a minimum, describe the manner in which the State will improve program integrity by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9e4bf17-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/2/A\"><num value=\"A\">(A)</num><content> monitoring the nutrient content of meals served;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9e4e628-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/2/B\"><num value=\"B\">(B)</num><chapeau> providing training to local educational agencies, school food authorities, and schools on the use of technology and information management systems for activities including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e4e629-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/2/B/i\"><num value=\"i\">(i)</num><content> menu planning;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e4e62a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/2/B/ii\"><num value=\"ii\">(ii)</num><content> collection of point-of-sale data; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e4e62b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/2/B/iii\"><num value=\"iii\">(iii)</num><content> the processing of applications for free and reduced price meals; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9e4e62c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/2/C\"><num value=\"C\">(C)</num><content> using electronic data to establish benchmarks to compare and monitor program integrity, program participation, and financial data across schools and school food authorities.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e4e62d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Technology infrastructure grants</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e4e62e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Subject to the availability of funds made available under paragraph (4) to carry out this paragraph, the Secretary shall, on a competitive basis, provide funds to States to be used to provide grants to local educational agencies, school food authorities, and schools to defray the cost of purchasing or upgrading technology and information management systems for use in programs authorized by this chapter (other than <ref href=\"/us/usc/t42/s1786\">section 1786 of this title</ref>) and the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida9e4e62f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Infrastructure development plan</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">To be eligible to receive a grant under this paragraph, a school or school food authority shall submit to the State a plan to purchase or upgrade technology and information management systems that addresses potential cost savings and methods to improve program integrity, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e50d40-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/3/B/i\"><num value=\"i\">(i)</num><content> processing and verification of applications for free and reduced price meals;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e50d41-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/3/B/ii\"><num value=\"ii\">(ii)</num><content> integration of menu planning, production, and serving data to monitor compliance with section 9(f)(1) of the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1758/f/1\">42 U.S.C. 1758(f)(1)</ref>); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9e50d42-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/3/B/iii\"><num value=\"iii\">(iii)</num><content> compatibility with statewide reporting systems.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9e50d43-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/i/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There are authorized to be appropriated to carry out this subsection such sums as are necessary for each of fiscal years 2010 through 2015, to remain available until expended.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9e50d44-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1776/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For the fiscal year beginning <date date=\"1977-10-01\">October 1, 1977</date>, and each succeeding fiscal year ending before <date date=\"2015-10-01\">October 1, 2015</date>, there are hereby authorized to be appropriated such sums as may be necessary for the purposes of this section.</p>\n</content>\n</subsection>\n<sourceCredit id=\"ida9e50d45-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/89/642/s7\">Pub.
