<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida9e73039-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779"><num value="1779">§ 1779.</num><heading> Regulations</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9e7303a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall prescribe such regulations as the Secretary may deem necessary to carry out this chapter and the Richard B. Russell National School Lunch Act [<ref href="/us/usc/t42/s1751">42 U.S.C. 1751</ref> et seq.], including regulations relating to the service of food in participating schools and service institutions in competition with the programs authorized under this chapter and the Richard B. Russell National School Lunch Act.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9e7303b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b"><num value="b" class="bold">(b)</num><heading class="bold"> National school nutrition standards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9e7303c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Proposed regulations</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9e7303d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9e7303e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/A/i"><num value="i">(i)</num><content> establish science-based nutrition standards for foods sold in schools other than foods provided under this chapter and the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1751">42 U.S.C. 1751</ref> et seq.); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9e7303f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/A/ii"><num value="ii">(ii)</num><content> not later than 1 year after <date date="2010-12-13">December 13, 2010</date>, promulgate proposed regulations to carry out clause (i).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9e73040-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Application</heading><chapeau style="-uslm-lc:I13" class="indent2">The nutrition standards shall apply to all foods sold—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9e73041-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/B/i"><num value="i">(i)</num><content> outside the school meal programs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9e73042-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/B/ii"><num value="ii">(ii)</num><content> on the school campus; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9e73043-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/B/iii"><num value="iii">(iii)</num><content> at any time during the school day.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9e75754-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I13" class="indent2">In establishing nutrition standards under this paragraph, the Secretary shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9e75755-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/C/i"><num value="i">(i)</num><content> establish standards that are consistent with the most recent Dietary Guidelines for Americans published under <ref href="/us/usc/t7/s5341">section 5341 of title 7</ref>, including the food groups to encourage and nutrients of concern identified in the Dietary Guidelines; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9e75756-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/C/ii"><num value="ii">(ii)</num><chapeau> consider—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida9e75757-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/C/ii/I"><num value="I">(I)</num><content> authoritative scientific recommendations for nutrition standards;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida9e75758-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/C/ii/II"><num value="II">(II)</num><content> existing school nutrition standards, including voluntary standards for beverages and snack foods and State and local standards;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida9e75759-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/C/ii/III"><num value="III">(III)</num><content> the practical application of the nutrition standards; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida9e7575a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/C/ii/IV"><num value="IV">(IV)</num><content> special exemptions for school-sponsored fundraisers (other than fundraising through vending machines, school stores, snack bars, a la carte sales, and any other exclusions determined by the Secretary), if the fundraisers are approved by the school and are infrequent within the school.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9e7575b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Updating standards</heading><content><p style="-uslm-lc:I13" class="indent2">As soon as practicable after the date of publication by the Department of Agriculture and the Department of Health and Human Services of a new edition of the Dietary Guidelines for Americans under <ref href="/us/usc/t7/s5341">section 5341 of title 7</ref>, the Secretary shall review and update as necessary the school nutrition standards and requirements established under this subsection.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9e77e6c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Implementation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9e77e6d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Effective date</heading><content><p style="-uslm-lc:I13" class="indent2">The interim or final regulations under this subsection shall take effect at the beginning of the school year that is not earlier than 1 year and not later than 2 years following the date on which the regulations are finalized.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9e77e6e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Reporting</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Education and Labor of the House of Representatives a quarterly report that describes progress made toward promulgating final regulations under this subsection.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9e77e6f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1779/c"><num value="c" class="bold">(c)</num><heading class="bold"> Transfer of funds; reserve for special projects</heading><content><p style="-uslm-lc:I11" class="indent0">In such regulations the Secretary may provide for the transfer of funds by any State between the programs authorized under this chapter and the Richard B. Russell National School Lunch Act [<ref href="/us/usc/t42/s1751">42 U.S.C. 1751</ref> et seq.] on the basis of an approved State plan of operation for the use of the funds and may provide for the reserve of up to 1 per centum of the funds available for apportionment to any State to carry out special developmental projects.</p>
