L. 102–342, title II, § 201, Aug. 14, 1992, 106 Stat. 912.)","seq_in_title":2419,"parent_identifier":"/us/usc/t42/ch13A","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch13A","level":"chapter","num":"CHAPTER 13A—","heading":"CHILD NUTRITION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idaa0343ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790\"><num value=\"1790\">§ 1790.</num><heading> Breastfeeding promotion program</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa0343ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary, from amounts received under subsection (d), shall establish a breastfeeding promotion program to promote breastfeeding as the best method of infant nutrition, foster wider public acceptance of breastfeeding in the United States, and assist in the distribution of breastfeeding equipment to breastfeeding women.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa0343ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Conduct of program</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out the program described in subsection (a), the Secretary may—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaa036b00-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/b/1\"><num value=\"1\">(1)</num><content> develop or assist others to develop appropriate educational materials, including public service announcements, promotional publications, and press kits for the purpose of promoting breastfeeding;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaa036b01-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/b/2\"><num value=\"2\">(2)</num><content> distribute or assist others to distribute such materials to appropriate public and private individuals and entities; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaa036b02-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/b/3\"><num value=\"3\">(3)</num><content> provide funds to public and private individuals and entities, including physicians, health professional organizations, hospitals, community based health organizations, and employers, for the purpose of assisting such entities in the distribution of breastpumps and similar equipment to breastfeeding women.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa036b03-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Cooperative agreements</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized to enter into cooperative agreements with Federal agencies, State and local governments, and other entities to carry out the program described in subsection (a).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa036b04-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Gifts, bequests, and devises</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa036b05-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary is authorized to solicit, accept, use, and dispose of gifts, bequests, or devises of services or property, both real and personal, for the purpose of establishing and carrying out the program described in subsection (a). Gifts, bequests, or devises of money and proceeds from the sales of other property received as gifts, bequests, or devises shall be deposited in the Treasury and shall be available for disbursement upon order of the Secretary.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa036b06-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Criteria for acceptance</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall establish criteria for determining whether to solicit and accept gifts, bequests, or devises under paragraph (1), including criteria that ensure that the acceptance of any gifts, bequests, or devises would not—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaa036b07-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/d/2/A\"><num value=\"A\">(A)</num><content> reflect unfavorably on the ability of the Secretary to carry out the Secretary’s responsibilities in a fair and objective manner; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaa039218-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1790/d/2/B\"><num value=\"B\">(B)</num><content> compromise, or appear to compromise, the integrity of any governmental program or any officer or employee involved in the program.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idaa039219-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/89/642/s21\">Pub.
