<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1bb2ee4a-ec39-11e5-ab56-982532b839a4" identifier="/us/usc/t42/s1792"><num value="1792">§ 1792.</num><heading> Promoting Federal food donation</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1bb2ee4b-ec39-11e5-ab56-982532b839a4" identifier="/us/usc/t42/s1792/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau>Not later than 180 days after <date date="2008-06-20">June 20, 2008</date>, the Federal Acquisition Regulation issued in accordance with <ref href="/us/usc/t41/s1303">section 1303 of title 41</ref> shall be revised to provide that all contracts above $25,000 for the provision, service, or sale of food in the United States, or for the lease or rental of Federal property to a private entity for events at which food is provided in the United States, shall include a clause that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1bb2ee4c-ec39-11e5-ab56-982532b839a4" identifier="/us/usc/t42/s1792/a/1"><num value="1">(1)</num><content> encourages the donation of excess, apparently wholesome food to nonprofit organizations that provide assistance to food-insecure people in the United States; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id1bb2ee4d-ec39-11e5-ab56-982532b839a4" identifier="/us/usc/t42/s1792/a/2"><num value="2">(2)</num><content> states the terms and conditions described in subsection (b).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1bb2ee4e-ec39-11e5-ab56-982532b839a4" identifier="/us/usc/t42/s1792/b"><num value="b" class="bold">(b)</num><heading class="bold"> Terms and conditions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1bb2ee4f-ec39-11e5-ab56-982532b839a4" identifier="/us/usc/t42/s1792/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Costs</heading><content><p style="-uslm-lc:I12" class="indent1">In any case in which a contractor enters into a contract with an executive agency under which apparently wholesome food is donated to food-insecure people in the United States, the head of the executive agency shall not assume responsibility for the costs and logistics of collecting, transporting, maintaining the safety of, or distributing excess, apparently wholesome food to food-insecure people in the United States under this section.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1bb2ee50-ec39-11e5-ab56-982532b839a4" identifier="/us/usc/t42/s1792/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Liability</heading><content><p style="-uslm-lc:I12" class="indent1">An executive agency (including an executive agency that enters into a contract with a contractor) and any contractor making donations pursuant to this section shall be exempt from civil and criminal liability to the extent provided under <ref href="/us/usc/t42/s1791">section 1791 of this title</ref>.</p>
