<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaa047ca4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793"><num value="1793">§ 1793.</num><heading> Grants for expansion of school breakfast programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa047ca5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definition of qualifying school</heading><content><p style="-uslm-lc:I11" class="indent0">In this section, the term “qualifying school” means a school in severe need, as described in <ref href="/us/usc/t42/s1773/d/1">section 1773(d)(1) of this title</ref>.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa047ca6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/b"><num value="b" class="bold">(b)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">Subject to the availability of appropriations provided in advance in an appropriations Act specifically for the purpose of carrying out this section, the Secretary shall establish a program under which the Secretary shall provide grants, on a competitive basis, to State educational agencies for the purpose of providing subgrants to local educational agencies for qualifying schools to establish, maintain, or expand the school breakfast program in accordance with this section.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa047ca7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c"><num value="c" class="bold">(c)</num><heading class="bold"> Grants to State educational agencies</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa047ca8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Application</heading><content><p style="-uslm-lc:I12" class="indent1">To be eligible to receive a grant under this section, a State educational agency shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa047ca9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Administration</heading><chapeau style="-uslm-lc:I12" class="indent1">In carrying out this section, the Secretary shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa04a3ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c/2/A"><num value="A">(A)</num><content> develop an appropriate competitive application process; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa04a3bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c/2/B"><num value="B">(B)</num><content> make information available to State educational agencies concerning the availability of funds under this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa04a3bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Allocation</heading><chapeau style="-uslm-lc:I12" class="indent1">The amount of grants provided by the Secretary to State educational agencies for a fiscal year under this section shall not exceed the lesser of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa04a3bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c/3/A"><num value="A">(A)</num><chapeau> the product obtained by multiplying—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaa04a3be-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c/3/A/i"><num value="i">(i)</num><content> the number of qualifying schools receiving subgrants or other benefits under subsection (d) for the fiscal year; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaa04a3bf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c/3/A/ii"><num value="ii">(ii)</num><content> the maximum amount of a subgrant provided to a qualifying school under subsection (d)(4)(B); or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa04a3c0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/c/3/B"><num value="B">(B)</num><content> $2,000,000.</content>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa04a3c1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/d"><num value="d" class="bold">(d)</num><heading class="bold"> Subgrants to qualifying schools</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa04a3c2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A State educational agency receiving a grant under this section shall use funds made available under the grant to award subgrants to local educational agencies for a qualifying school or groups of qualifying schools to carry out activities in accordance with this section.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa04a3c3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Priority</heading><content><p style="-uslm-lc:I12" class="indent1">In awarding subgrants under this subsection, a State educational agency shall give priority to local educational agencies with qualifying schools in which at least 75 percent of the students are eligible for free or reduced price school lunches under the school lunch program established under the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1751">42 U.S.C. 1751</ref> et seq.).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa04a3c4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> State and district training and technical support</heading><content><p style="-uslm-lc:I12" class="indent1">A local educational agency or State educational agency may allocate a portion of each subgrant to provide training and technical assistance to the staff of qualifying schools to carry out the purposes of this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa04a3c5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Amount; term</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaa04a3c6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/d/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as otherwise provided in this paragraph, a subgrant provided by a State educational agency to a local educational agency or qualifying school under this section shall be in such amount, and shall be provided for such term, as the State educational agency determines appropriate.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaa04cad7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/d/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Maximum amount</heading><content><p style="-uslm-lc:I13" class="indent2">The amount of a subgrant provided by a State educational agency to a local educational agency for a qualifying school or a group of qualifying schools under this subsection shall not exceed $10,000 for each school year.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaa04cad8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/d/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Maximum grant term</heading><content><p style="-uslm-lc:I13" class="indent2">A local educational agency or State educational agency shall not provide subgrants to a qualifying school under this subsection for more than 2 fiscal years.</p>

</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa04cad9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/e"><num value="e" class="bold">(e)</num><heading class="bold"> Best practices</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa04cada-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Prior to awarding grants under this section, the Secretary shall make available to State educational agencies information regarding the most effective mechanisms by which to increase school breakfast participation among eligible children at qualifying schools.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa04cadb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Preference</heading><content><p style="-uslm-lc:I12" class="indent1">In awarding subgrants under this section, a State educational agency shall give preference to local educational agencies for qualifying schools or groups of qualifying schools that have adopted, or provide assurances that the subgrant funds will be used to adopt, the most effective mechanisms identified by the Secretary under paragraph (1).</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa04cadc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/f"><num value="f" class="bold">(f)</num><heading class="bold"> Use of funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa04cadd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">A qualifying school may use a grant provided under this section—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa04cade-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/f/1/A"><num value="A">(A)</num><content> to establish, promote, or expand a school breakfast program of the qualifying school under this section, which shall include a nutritional education component;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa04cadf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/f/1/B"><num value="B">(B)</num><content> to extend the period during which school breakfast is available at the qualifying school;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa04cae0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/f/1/C"><num value="C">(C)</num><content> to provide school breakfast to students of the qualifying school during the school day; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa04f1f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/f/1/D"><num value="D">(D)</num><content> for other appropriate purposes, as determined by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa04f1f2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirement</heading><content><p style="-uslm-lc:I12" class="indent1">Each activity of a qualifying school under this subsection shall be carried out in accordance with applicable nutritional guidelines and regulations issued by the Secretary.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa04f1f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/g"><num value="g" class="bold">(g)</num><heading class="bold"> Maintenance of effort</heading><content><p style="-uslm-lc:I11" class="indent0">Grants made available under this section shall not diminish or otherwise affect the expenditure of funds from State and local sources for the maintenance of the school breakfast program.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa04f1f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/h"><num value="h" class="bold">(h)</num><heading class="bold"> Reports</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 18 months following the end of a school year during which subgrants are awarded under this section, the Secretary shall submit to Congress a report describing the activities of the qualifying schools awarded subgrants.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa04f1f5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/i"><num value="i" class="bold">(i)</num><heading class="bold"> Evaluation</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 180 days before the end of a grant term under this section, a local educational agency that receives a subgrant under this section shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaa04f1f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/i/1"><num value="1">(1)</num><content> evaluate whether electing to provide universal free breakfasts under the school breakfast program in accordance with Provision 2 as established under subsections (b) through (k) of section 245.9 of title 7, Code of Federal Regulations (or successor regulations), would be cost-effective for the qualified schools based on estimated administrative savings and economies of scale; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa04f1f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/i/2"><num value="2">(2)</num><content> submit the results of the evaluation to the State educational agency.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa04f1f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1793/j"><num value="j" class="bold">(j)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated to carry out this section such sums as are necessary for each of fiscal years 2010 through 2015.</p>
