market</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “group market” means the health insurance market under which individuals obtain health insurance coverage (directly or through any arrangement) on behalf of themselves (and their dependents) through a group health plan maintained by an employer.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9499c0f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Individual market</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “individual market” means the market for health insurance coverage offered to individuals other than in connection with a group health plan.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9499c10-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Large and small group markets</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The terms “large group market” and “small group market” mean the health insurance market under which individuals obtain health insurance coverage (directly or through any arrangement) on behalf of themselves (and their dependents) through a group health plan maintained by a large employer (as defined in subsection (b)(1)) or by a small employer (as defined in subsection (b)(2)), respectively.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd9499c11-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Employers</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this title: <sup>1</sup></chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9499c12-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Large employer</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “large employer” means, in connection with a group health plan with respect to a calendar year and a plan year, an employer who employed an average of at least 51 employees on business days during the preceding calendar year and who employs at least 1 employee on the first day of the plan year.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9499c13-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Small employer</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “small employer” means, in connection with a group health plan with respect to a calendar year and a plan year, an employer who employed an average of at least 1 but not more than 50 employees on business days during the preceding calendar year and who employs at least 1 employee on the first day of the plan year.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9499c14-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> State option to extend definition of small employer</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding paragraphs (1) and (2), nothing in this section shall prevent a State from applying this subsection by treating as a small employer, with respect to a calendar year and a plan year, an employer who employed an average of at least 1 but not more than 100 employees on business days during the preceding calendar year and who employs at least 1 employee on the first day of the plan year.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd9499c15-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Rules for determining employer size</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this subsection—</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9499c16-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Application of aggregation rule for employers</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">All persons treated as a single employer under subsection (b), (c), (m), or (<i>o</i>) of <ref href=\"/us/usc/t26/s414\">section 414 of title 26</ref> shall be treated as 1 employer.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9499c17-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Employers not in existence in preceding year</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In the case of an employer which was not in existence throughout the preceding calendar year, the determination of whether such employer is a small or large employer shall be based on the average number of employees that it is reasonably expected such employer will employ on business days in the current calendar year.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9499c18-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/4/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Predecessors</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Any reference in this subsection to an employer shall include a reference to any predecessor of such employer.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd9499c19-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/4/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Continuation of participation for growing small employers</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">If—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9499c1a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/4/D/i\"><num value=\"i\">(i)</num><content> a qualified employer that is a small employer makes enrollment in qualified health plans offered in the small group market available to its employees through an Exchange; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd9499c1b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/b/4/D/ii\"><num value=\"ii\">(ii)</num><content> the employer ceases to be a small employer by reason of an increase in the number of employees of such employer;</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I32\" class=\"indent2 firstIndent0\">the employer shall continue to be treated as a small employer for purposes of this subchapter for the period beginning with the increase and ending with the first day on which the employer does not make such enrollment available to its employees.</continuation>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd9499c1c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Secretary</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In this title,<sup>1</sup> the term “Secretary” means the Secretary of Health and Human Services.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd9499c1d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> State</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In this title,<sup>1</sup> the term “State” means each of the 50 States and the District of Columbia.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd9499c1e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s18024/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Educated health care consumers</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The term “educated health care consumer” means an individual who is knowledgeable about the health care system, and has background or experience in making informed decisions regarding health, medical, and
