<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd94c0d02-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033"><num value="18033">§ 18033.</num><heading> Financial integrity</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd94c0d03-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a"><num value="a" class="bold">(a)</num><heading class="bold"> Accounting for expenditures</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd94c0d04-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">An Exchange shall keep an accurate accounting of all activities, receipts, and expenditures and shall annually submit to the Secretary a report concerning such accountings.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd94c0d05-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Investigations</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary, in coordination with the Inspector General of the Department of Health and Human Services, may investigate the affairs of an Exchange, may examine the properties and records of an Exchange, and may require periodic reports in relation to activities undertaken by an Exchange. An Exchange shall fully cooperate in any investigation conducted under this paragraph.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd94c0d06-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Audits</heading><content><p style="-uslm-lc:I12" class="indent1">An Exchange shall be subject to annual audits by the Secretary.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd94c0d07-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Pattern of abuse</heading><content><p style="-uslm-lc:I12" class="indent1">If the Secretary determines that an Exchange or a State has engaged in serious misconduct with respect to compliance with the requirements of, or carrying out of activities required under, this title,<ref class="footnoteRef" idref="fn004218">1</ref><note type="footnote" id="fn004218"><num>1</num> See References in Text note below.</note> the Secretary may rescind from payments otherwise due to such State involved under this or any other Act administered by the Secretary an amount not to exceed 1 percent of such payments per year until corrective actions are taken by the State that are determined to be adequate by the Secretary.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd94c0d08-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Protections against fraud and abuse</heading><chapeau style="-uslm-lc:I12" class="indent1">With respect to activities carried out under this title,<sup>1</sup> the Secretary shall provide for the efficient and non-discriminatory administration of Exchange activities and implement any measure or procedure that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd94c0d09-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/5/A"><num value="A">(A)</num><content> the Secretary determines is appropriate to reduce fraud and abuse in the administration of this title; <sup>1</sup> and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd94c0d0a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/5/B"><num value="B">(B)</num><content> the Secretary has authority to implement under this title <sup>1</sup> or any other Act.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd94c0d0b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Application of the False Claims Act</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd94c0d0c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Payments made by, through, or in connection with an Exchange are subject to the False Claims Act (<ref href="/us/usc/t31/s3729">31 U.S.C. 3729</ref> et seq.) if those payments include any Federal funds. Compliance with the requirements of this Act concerning eligibility for a health insurance issuer to participate in the Exchange shall be a material condition of an issuer’s entitlement to receive payments, including payments of premium tax credits and cost-sharing reductions, through the Exchange.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd94c0d0d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/a/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> <ref class="footnoteRef" idref="fn004219">2</ref><note type="footnote" id="fn004219"><num>2</num> See Termination of Provision note below.</note> Damages</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding paragraph (1) of <ref href="/us/usc/t31/s3729/a">section 3729(a) of title 31</ref>, and subject to paragraph (2) of such section, the civil penalty assessed under the False Claims Act on any person found liable under such Act as described in subparagraph (A) shall be increased by not less than 3 times and not more than 6 times the amount of damages which the Government sustains because of the act of that person.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd94c0d0e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/b"><num value="b" class="bold">(b)</num><heading class="bold"> GAO oversight</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 5 years after the first date on which Exchanges are required to be operational under this title,<sup>1</sup> the Comptroller General shall conduct an ongoing study of Exchange activities and the enrollees in qualified health plans offered through Exchanges. Such study shall review—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd94c0d0f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/b/1"><num value="1">(1)</num><content> the operations and administration of Exchanges, including surveys and reports of qualified health plans offered through Exchanges and on the experience of such plans (including data on enrollees in Exchanges and individuals purchasing health insurance coverage outside of Exchanges), the expenses of Exchanges, claims statistics relating to qualified health plans, complaints data relating to such plans, and the manner in which Exchanges meet their goals;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd94c0d10-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/b/2"><num value="2">(2)</num><content> any significant observations regarding the utilization and adoption of Exchanges;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd94c0d11-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/b/3"><num value="3">(3)</num><content> where appropriate, recommendations for improvements in the operations or policies of Exchanges;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd94c0d12-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/b/4"><num value="4">(4)</num><content> a survey of the cost and affordability of health care insurance provided under the Exchanges for owners and employees of small business concerns (as defined under <ref href="/us/usc/t15/s632">section 632 of title 15</ref>), including data on enrollees in Exchanges and individuals purchasing health insurance coverage outside of Exchanges; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd94c0d13-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18033/b/5"><num value="5">(5)</num><content> how many physicians, by area and specialty, are not taking or accepting new patients enrolled in Federal Government health care programs, and the adequacy of provider networks of Federal Government health care programs.</content>
