L. 111–148, title I, § 1322, title X, § 10104(l), Mar. 23, 2010, 124 Stat. 187, 902.)","seq_in_title":7961,"parent_identifier":"/us/usc/t42/ch157/schIII/ptC","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch157","level":"chapter","num":"CHAPTER 157—","heading":"QUALITY, AFFORDABLE HEALTH CARE FOR ALL AMERICANS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch157/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"AVAILABLE COVERAGE CHOICES FOR ALL AMERICANS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch157/schIII/ptC","level":"part","num":"Part C—","heading":"State Flexibility Relating To Exchanges","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idadaaa125-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042\"><num value=\"18042\">§ 18042.</num><heading> Federal program to assist establishment and operation of nonprofit, member-run health insurance issuers</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadaaa126-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Establishment of program</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaa127-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall establish a program to carry out the purposes of this section to be known as the Consumer Operated and Oriented Plan (CO–OP) program.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaa128-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Purpose</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">It is the purpose of the CO–OP program to foster the creation of qualified nonprofit health insurance issuers to offer qualified health plans in the individual and small group markets in the States in which the issuers are licensed to offer such plans.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadaaa129-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Loans and grants under the CO–OP program</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaa12a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall provide through the CO–OP program for the awarding to persons applying to become qualified nonprofit health insurance issuers of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaa12b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/1/A\"><num value=\"A\">(A)</num><content> loans to provide assistance to such person in meeting its start-up costs; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaa12c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/1/B\"><num value=\"B\">(B)</num><content> grants to provide assistance to such person in meeting any solvency requirements of States in which the person seeks to be licensed to issue qualified health plans.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaa12d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Requirements for awarding loans and grants</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaaa12e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In awarding loans and grants under the CO–OP program, the Secretary shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idadaaa12f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/A/i\"><num value=\"i\">(i)</num><content> take into account the recommendations of the advisory board established under paragraph (3);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idadaaa130-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/A/ii\"><num value=\"ii\">(ii)</num><content> give priority to applicants that will offer qualified health plans on a Statewide basis, will utilize integrated care models, and have significant private support; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idadaaa131-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/A/iii\"><num value=\"iii\">(iii)</num><content> ensure that there is sufficient funding to establish at least 1 qualified nonprofit health insurance issuer in each State, except that nothing in this clause shall prohibit the Secretary from funding the establishment of multiple qualified nonprofit health insurance issuers in any State if the funding is sufficient to do so.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaaa132-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> States without issuers in program</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If no health insurance issuer applies to be a qualified nonprofit health insurance issuer within a State, the Secretary may use amounts appropriated under this section for the awarding of grants to encourage the establishment of a qualified nonprofit health insurance issuer within the State or the expansion of a qualified nonprofit health insurance issuer from another State to the State.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaaa133-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Agreement</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idadaaa134-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall require any person receiving a loan or grant under the CO–OP program to enter into an agreement with the Secretary which requires such person to meet (and to continue to meet)—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idadaaa135-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C/i/I\"><num value=\"I\">(I)</num><content> any requirement under this section for such person to be treated as a qualified nonprofit health insurance issuer; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idadaac846-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C/i/II\"><num value=\"II\">(II)</num><content> any requirements contained in the agreement for such person to receive such loan or grant.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idadaac847-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Restrictions on use of Federal funds</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The agreement shall include a requirement that no portion of the funds made available by any loan or grant under this section may be used—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idadaac848-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C/ii/I\"><num value=\"I\">(I)</num><content> for carrying on propaganda, or otherwise attempting, to influence legislation; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idadaac849-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C/ii/II\"><num value=\"II\">(II)</num><content> for marketing.</content>\n</subclause>\n</clause>\n\n<continuation style=\"-uslm-lc:I66\" class=\"indent3 firstIndent-1\"> Nothing in this clause shall be construed to allow a person to take any action prohibited by <ref href=\"/us/usc/t26/s501/c/29\">section 501(c)(29) of title 26</ref>.</continuation>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idadaac84a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Failure to meet requirements</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">If the Secretary determines that a person has failed to meet any requirement described in clause (i) or (ii) and has failed to correct such failure within a reasonable period of time of when the person first knows (or reasonably should have known) of such failure, such person shall repay to the Secretary an amount equal to the sum of—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idadaac84b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C/iii/I\"><num value=\"I\">(I)</num><content> 110 percent of the aggregate amount of loans and grants received under this section; plus</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idadaac84c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/C/iii/II\"><num value=\"II\">(II)</num><content> interest on the aggregate amount of loans and grants received under this section for the period the loans or grants were outstanding.</content>\n</subclause>\n</clause>\n\n<continuation style=\"-uslm-lc:I66\" class=\"indent3 firstIndent-1\"> The Secretary shall notify the Secretary of the Treasury of any determination under this section of a failure that results in the termination of an issuer’s tax-exempt status under section 501(c)(29) of such title.</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaac84d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/2/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Time for awarding loans and grants</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall not later than <date date=\"2013-07-01\">July 1, 2013</date>, award the loans and grants under the CO–OP program and begin the distribution of amounts awarded under such loans and grants.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaac84e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Repayment of loans and grants</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than <date date=\"2013-07-01\">July 1, 2013</date>, and prior to awarding loans and grants under the CO–OP program, the Secretary shall promulgate regulations with respect to the repayment of such loans and grants in a manner that is consistent with State solvency regulations and other similar State laws that may apply. In promulgating such regulations, the Secretary shall provide that such loans shall be repaid within 5 years and such grants shall be repaid within 15 years, taking into consideration any appropriate State reserve requirements, solvency regulations, and requisite surplus note arrangements that must be constructed in a State to provide for such repayment prior to awarding such loans and grants.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaac84f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Advisory board</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaac850-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The advisory board under this paragraph shall consist of 15 members appointed by the Comptroller General of the United States from among individuals with qualifications described in <ref href=\"/us/usc/t42/s1395b–6/c/2\">section 1395b–6(c)(2) of this title</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaac851-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Rules relating to appointments</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idadaac852-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Standards</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Any individual appointed under subparagraph (A) shall meet ethics and conflict of interest standards protecting against insurance industry involvement and interference.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idadaac853-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Original appointments</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The original appointment of board members under subparagraph (A)(ii) shall be made no later than 3 months after <date date=\"2010-03-23\">March 23, 2010</date>.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaac854-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Vacancy</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Any vacancy on the advisory board shall be filled in the same manner as the original appointment.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaac855-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Pay and reimbursement</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idadaac856-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/D/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> No compensation for members of advisory board</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Except as provided in clause (ii), a member of the advisory board may not receive pay, allowances, or benefits by reason of their service on the board.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idadaac857-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/D/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Travel expenses</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Each member shall receive travel expenses, including per diem in lieu of subsistence under subchapter I of chapter 57 of title 5.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaac858-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Application of FACA</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the advisory board, except that section 14 of such Act shall not apply.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaac859-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/b/4/F\"><num value=\"F\" class=\"bold\">(F)</num><heading class=\"bold\"> Termination</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The advisory board shall terminate on the earlier of the date that it completes its duties under this section or <date date=\"2015-12-31\">December 31, 2015</date>.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadaac85a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Qualified nonprofit health insurance issuer</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section—</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaac85b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “qualified nonprofit health insurance issuer” means a health insurance issuer that is an organization—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaef6c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/1/A\"><num value=\"A\">(A)</num><content> that is organized under State law as a nonprofit, member corporation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaef6d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/1/B\"><num value=\"B\">(B)</num><content> substantially all of the activities of which consist of the issuance of qualified health plans in the individual and small group markets in each State in which it is licensed to issue such plans; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaef6e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/1/C\"><num value=\"C\">(C)</num><content> that meets the other requirements of this subsection.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaef6f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Certain organizations prohibited</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">An organization shall not be treated as a qualified nonprofit health insurance issuer if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaef70-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/2/A\"><num value=\"A\">(A)</num><content> the organization or a related entity (or any predecessor of either) was a health insurance issuer on <date date=\"2009-07-16\">July 16, 2009</date>; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaef71-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/2/B\"><num value=\"B\">(B)</num><content> the organization is sponsored by a State or local government, any political subdivision thereof, or any instrumentality of such government or political subdivision.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaef72-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Governance requirements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">An organization shall not be treated as a qualified nonprofit health insurance issuer unless—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaef73-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/3/A\"><num value=\"A\">(A)</num><content> the governance of the organization is subject to a majority vote of its members;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaef74-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/3/B\"><num value=\"B\">(B)</num><content> its governing documents incorporate ethics and conflict of interest standards protecting against insurance industry involvement and interference; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadaaef75-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/3/C\"><num value=\"C\">(C)</num><content> as provided in regulations promulgated by the Secretary, the organization is required to operate with a strong consumer focus, including timeliness, responsiveness, and accountability to members.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaef76-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Profits inure to benefit of members</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An organization shall not be treated as a qualified nonprofit health insurance issuer unless any profits made by the organization are required to be used to lower premiums, to improve benefits, or for other programs intended to improve the quality of health care delivered to its members.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaef77-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Compliance with State insurance laws</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An organization shall not be treated as a qualified nonprofit health insurance issuer unless the organization meets all the requirements that other issuers of qualified health plans are required to meet in any State where the issuer offers a qualified health plan, including solvency and licensure requirements, rules on payments to providers, and compliance with network adequacy rules, rate and form filing rules, any applicable State premium assessments and any other State law described in <ref href=\"/us/usc/t42/s18044/b\">section 18044(b) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaef78-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/c/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Coordination with State insurance reforms</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An organization shall not be treated as a qualified nonprofit health insurance issuer unless the organization does not offer a health plan in a State until that State has in effect (or the Secretary has implemented for the State) the market reforms required by part A of title XXVII of the Public Health Service Act [<ref href=\"/us/usc/t42/s300gg\">42 U.S.C. 300gg</ref> et seq.] (as amended by subtitles A and C of this Act).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadaaef79-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Establishment of private purchasing council</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaef7a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Qualified nonprofit health insurance issuers participating in the CO–OP program under this section may establish a private purchasing council to enter into collective purchasing arrangements for items and services that increase administrative and other cost efficiencies, including claims administration, administrative services, health information technology, and actuarial services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaef7b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Council may not set payment rates</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The private purchasing council established under paragraph (1) shall not set payment rates for health care facilities or providers participating in health insurance coverage provided by qualified nonprofit health insurance issuers.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadaaef7c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Continued application of antitrust laws</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaaef7d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/d/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Nothing in this section shall be construed to limit the application of the antitrust laws to any private purchasing council (whether or not established under this subsection) or to any qualified nonprofit health insurance issuer participating in such a council.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadaaef7e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/d/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Antitrust laws</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of this subparagraph, the term “antitrust laws” has the meaning given the term in subsection (a) of <ref href=\"/us/usc/t15/s12\">section 12 of title 15</ref>. Such term also includes <ref href=\"/us/usc/t15/s45\">section 45 of title 15</ref> to the extent that such section 45 applies to unfair methods of competition.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadab168f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Limitation on participation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No representative of any Federal, State, or local government (or of any political subdivision or instrumentality thereof), and no representative of a person described in subsection (c)(2)(A), may serve on the board of directors of a qualified nonprofit health insurance issuer or with a private purchasing council established under subsection (d).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadab1690-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Limitations on Secretary</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadab1691-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall not—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadab1692-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/f/1/A\"><num value=\"A\">(A)</num><content> participate in any negotiations between 1 or more qualified nonprofit health insurance issuers (or a private purchasing council established under subsection (d)) and any health care facilities or providers, including any drug manufacturer, pharmacy, or hospital; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadab1693-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/f/1/B\"><num value=\"B\">(B)</num><content> establish or maintain a price structure for reimbursement of any health benefits covered by such issuers.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadab1694-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Competition</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this section shall be construed as authorizing the Secretary to interfere with the competitive nature of providing health benefits through qualified nonprofit health insurance issuers.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadab1695-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There are hereby appropriated, out of any funds in the Treasury not otherwise appropriated, $6,000,000,000 to carry out this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadab1696-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Omitted</heading><content/>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadab1697-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> GAO study and report</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadab1698-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18042/i/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Study</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Comptroller General of the General Accountability Office shall conduct an ongoing study on competition and market concentration in the health insurance market in the United States after the implementation of the reforms in such market under the provisions of, and the amendments made by, this Act.
