<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idadafd0bf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18113"><num value="18113">§ 18113.</num><heading> Prohibition against discrimination on assisted suicide</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadafd0c0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18113/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Federal Government, and any State or local government or health care provider that receives Federal financial assistance under this Act (or under an amendment made by this Act) or any health plan created under this Act (or under an amendment made by this Act), may not subject an individual or institutional health care entity to discrimination on the basis that the entity does not provide any health care item or service furnished for the purpose of causing, or for the purpose of assisting in causing, the death of any individual, such as by assisted suicide, euthanasia, or mercy killing.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadafd0c1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18113/b"><num value="b" class="bold">(b)</num><heading class="bold"> Definition</heading><content><p style="-uslm-lc:I11" class="indent0">In this section, the term “health care entity” includes an individual physician or other health care professional, a hospital, a provider-sponsored organization, a health maintenance organization, a health insurance plan, or any other kind of health care facility, organization, or plan.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadafd0c2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18113/c"><num value="c" class="bold">(c)</num><heading class="bold"> Construction and treatment of certain services</heading><chapeau style="-uslm-lc:I11" class="indent0">Nothing in subsection (a) shall be construed to apply to, or to affect, any limitation relating to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idadafd0c3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18113/c/1"><num value="1">(1)</num><content> the withholding or withdrawing of medical treatment or medical care;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idadafd0c4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18113/c/2"><num value="2">(2)</num><content> the withholding or withdrawing of nutrition or hydration;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idadafd0c5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18113/c/3"><num value="3">(3)</num><content> abortion; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idadafd0c6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18113/c/4"><num value="4">(4)</num><content> the use of an item, good, benefit, or service furnished for the purpose of alleviating pain or discomfort, even if such use may increase the risk of death, so long as such item, good, benefit, or service is not also furnished for the purpose of causing, or the purpose of assisting in causing, death, for any reason.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadafd0c7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18113/d"><num value="d" class="bold">(d)</num><heading class="bold"> Administration</heading><content><p style="-uslm-lc:I11" class="indent0">The Office for Civil Rights of the Department of Health and Human Services is designated to receive complaints of discrimination based on this section.</p>
