<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idadb0462f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122"><num value="18122">§ 18122.</num><heading> Rule of construction regarding health care providers</heading><paragraph style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadb04630-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">Subject to paragraph (3), the development, recognition, or implementation of any guideline or other standard under any Federal health care provision shall not be construed to establish the standard of care or duty of care owed by a health care provider to a patient in any medical malpractice or medical product liability action or claim.</p>

<paragraph style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadb04631-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122/2"><num value="2" class="bold">(2)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this section:</chapeau><subparagraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idadb04632-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Federal health care provision</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Federal health care provision” means any provision of the Patient Protection and Affordable Care Act (<ref href="/us/pl/111/148">Public Law 111–148</ref>), title I or subtitle B of title II of the Health Care and Education Reconciliation Act of 2010 (<ref href="/us/pl/111/152">Public Law 111–152</ref>), or title XVIII or XIX of the Social Security Act (<ref href="/us/usc/t42/s1395">42 U.S.C. 1395</ref> et seq., <ref href="/us/usc/t42/s1396">42 U.S.C. 1396</ref> et seq.).</p>

<subparagraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idadb04633-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Health care provider</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “health care provider” means any individual, group practice, corporation of health care professionals, or hospital—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="idadb04634-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122/2/B/i"><num value="i">(i)</num><content> licensed, registered, or certified under Federal or State laws or regulations to provide health care services; or</content>

<clause style="-uslm-lc:I13" class="indent2" id="idadb06d45-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122/2/B/ii"><num value="ii">(ii)</num><content> required to be so licensed, registered, or certified but that is exempted by other statute or regulation.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idadb06d46-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Medical malpractice or medical product liability action or claim</heading><content><p style="-uslm-lc:I12" class="indent1">The term “medical malpractice or medical product liability action or claim” means a medical malpractice action or claim (as defined in <ref href="/us/usc/t42/s11151/7">section 11151(7) of this title</ref>) and includes a liability action or claim relating to a health care provider’s prescription or provision of a drug, device, or biological product (as such terms are defined in <ref href="/us/usc/t21/s321">section 321 of title 21</ref> or <ref href="/us/usc/t42/s262">section 262 of this title</ref>).</p>

<subparagraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idadb06d47-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I12" class="indent1">The term “State” includes the District of Columbia, Puerto Rico, and any other commonwealth, possession, or territory of the United States.</p>

<paragraph style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadb06d48-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18122/3"><num value="3" class="bold">(3)</num><heading class="bold"> No preemption</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in paragraph (1) or any provision of the Patient Protection and Affordable Care Act (<ref href="/us/pl/111/148">Public Law 111–148</ref>), title I or subtitle B of title II of the Health Care and Education Reconciliation Act of 2010 (<ref href="/us/pl/111/152">Public Law 111–152</ref>), or title XVIII or XIX of the Social Security Act (<ref href="/us/usc/t42/s1395">42 U.S.C. 1395</ref> et seq., <ref href="/us/usc/t42/s1396">42 U.S.C. 1396</ref> et seq.) shall be construed to preempt any State or common law governing medical professional or medical product liability actions or claims.</p>
