<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd95a63ef-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203"><num value="18203">§ 18203.</num><heading> Permissible uses of Fund</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd95a63f0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">A State shall use amounts received under a grant under <ref href="/us/usc/t42/s18202">section 18202 of this title</ref> for the purposes described in this section to assist pregnant and parenting teens and women.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd95a63f1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b"><num value="b" class="bold">(b)</num><heading class="bold"> Institutions of higher education</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd95a63f2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A State may use amounts received under a grant under <ref href="/us/usc/t42/s18202">section 18202 of this title</ref> to make funding available to eligible institutions of higher education to enable the eligible institutions to establish, maintain, or operate pregnant and parenting student services. Such funding shall be used to supplement, not supplant, existing funding for such services.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd95a63f3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Application</heading><content><p style="-uslm-lc:I12" class="indent1">An eligible institution of higher education that desires to receive funding under this subsection shall submit an application to the designated State agency at such time, in such manner, and containing such information as the State agency may require.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd95cade4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Matching requirement</heading><content><p style="-uslm-lc:I12" class="indent1">An eligible institution of higher education that receives funding under this subsection shall contribute to the conduct of the pregnant and parenting student services office supported by the funding an amount from non-Federal funds equal to 25 percent of the amount of the funding provided. The non-Federal share may be in cash or in-kind, fairly evaluated, including services, facilities, supplies, or equipment.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd95cade5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Use of funds for assisting pregnant and parenting college students</heading><chapeau style="-uslm-lc:I12" class="indent1">An eligible institution of higher education that receives funding under this subsection shall use such funds to establish, maintain or operate pregnant and parenting student services and may use such funding for the following programs and activities:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cade6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/A"><num value="A">(A)</num><chapeau> Conduct a needs assessment on campus and within the local community—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd95cade7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/A/i"><num value="i">(i)</num><content> to assess pregnancy and parenting resources, located on the campus or within the local community, that are available to meet the needs described in subparagraph (B); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cade8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/A/ii"><num value="ii">(ii)</num><chapeau> to set goals for—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd95cade9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/A/ii/I"><num value="I">(I)</num><content> improving such resources for pregnant, parenting, and prospective parenting students; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd95cadea-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/A/ii/II"><num value="II">(II)</num><content> improving access to such resources.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cadeb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/B"><num value="B">(B)</num><chapeau> Annually assess the performance of the eligible institution in meeting the following needs of students enrolled in the eligible institution who are pregnant or are parents:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd95cadec-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/B/i"><num value="i">(i)</num><content> The inclusion of maternity coverage and the availability of riders for additional family members in student health care.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95caded-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/B/ii"><num value="ii">(ii)</num><content> Family housing.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cadee-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/B/iii"><num value="iii">(iii)</num><content> Child care.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cadef-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/B/iv"><num value="iv">(iv)</num><content> Flexible or alternative academic scheduling, such as telecommuting programs, to enable pregnant or parenting students to continue their education or stay in school.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cadf0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/B/v"><num value="v">(v)</num><content> Education to improve parenting skills for mothers and fathers and to strengthen marriages.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cadf1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/B/vi"><num value="vi">(vi)</num><content> Maternity and baby clothing, baby food (including formula), baby furniture, and similar items to assist parents and prospective parents in meeting the material needs of their children.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cadf2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/B/vii"><num value="vii">(vii)</num><content> Post-partum counseling.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cadf3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/C"><num value="C">(C)</num><content> Identify public and private service providers, located on the campus of the eligible institution or within the local community, that are qualified to meet the needs described in subparagraph (B), and establishes <ref class="footnoteRef" idref="fn004253">1</ref><note type="footnote" id="fn004253"><num>1</num> So in original. Probably should be “establish”.</note> programs with qualified providers to meet such needs.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cadf4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/D"><num value="D">(D)</num><content> Assist pregnant and parenting students, fathers or spouses in locating and obtaining services that meet the needs described in subparagraph (B).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cadf5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/E"><num value="E">(E)</num><chapeau> If appropriate, provide referrals for prenatal care and delivery, infant or foster care, or adoption, to a student who requests such information. An office shall make such referrals only to service providers that serve the following types of individuals:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd95cadf6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/E/i"><num value="i">(i)</num><content> Parents.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cadf7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/E/ii"><num value="ii">(ii)</num><content> Prospective parents awaiting adoption.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cadf8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/E/iii"><num value="iii">(iii)</num><content> Women who are pregnant and plan on parenting or placing the child for adoption.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cadf9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/4/E/iv"><num value="iv">(iv)</num><content> Parenting or prospective parenting couples.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd95cadfa-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Reporting</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd95cadfb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> Annual report by institutions</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd95cadfc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I14" class="indent3">For each fiscal year that an eligible institution of higher education receives funds under this subsection, the eligible institution shall prepare and submit to the State, by the date determined by the State, a report that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd95cadfd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5/A/i/I"><num value="I">(I)</num><content> itemizes the pregnant and parenting student services office’s expenditures for the fiscal year;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd95cadfe-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5/A/i/II"><num value="II">(II)</num><content> contains a review and evaluation of the performance of the office in fulfilling the requirements of this section, using the specific performance criteria or standards established under subparagraph (B)(i); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd95cadff-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5/A/i/III"><num value="III">(III)</num><content> describes the achievement of the office in meeting the needs listed in paragraph (4)(B) of the students served by the eligible institution, and the frequency of use of the office by such students.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd95cae00-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Performance criteria</heading><chapeau style="-uslm-lc:I14" class="indent3">Not later than 180 days before the date the annual report described in clause (i) is submitted, the State—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd95cae01-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5/A/ii/I"><num value="I">(I)</num><content> shall identify the specific performance criteria or standards that shall be used to prepare the report; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd95cae02-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5/A/ii/II"><num value="II">(II)</num><content> may establish the form or format of the report.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd95cae03-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/b/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Report by State</heading><content><p style="-uslm-lc:I13" class="indent2">The State shall annually prepare and submit a report on the findings under this subsection, including the number of eligible institutions of higher education that were awarded funds and the number of students served by each pregnant and parenting student services office receiving funds under this section, to the Secretary.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd95cae04-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/c"><num value="c" class="bold">(c)</num><heading class="bold"> Support for pregnant and parenting teens</heading><content><p style="-uslm-lc:I11" class="indent0">A State may use amounts received under a grant under <ref href="/us/usc/t42/s18202">section 18202 of this title</ref> to make funding available to eligible high schools and community service centers to establish, maintain or operate pregnant and parenting services in the same general manner and in accordance with all conditions and requirements described in subsection (b), except that paragraph (3) of such subsection shall not apply for purposes of this subsection.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd95cae05-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d"><num value="d" class="bold">(d)</num><heading class="bold"> Improving services for pregnant women who are victims of domestic violence, sexual violence, sexual assault, and stalking</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd95cae06-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">A State may use amounts received under a grant under <ref href="/us/usc/t42/s18202">section 18202 of this title</ref> to make funding available tp <ref class="footnoteRef" idref="fn004254">2</ref><note type="footnote" id="fn004254"><num>2</num> So in original. <subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cae08-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/1/B"><num value="B">(B)</num><chapeau> technical assistance and training (as described in subsection (c)) relating to violence against eligible pregnant women to be made available to the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd95cae09-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/1/B/i"><num value="i">(i)</num><content> Federal, State, tribal, territorial, and local governments, law enforcement agencies, and courts.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cae0a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/1/B/ii"><num value="ii">(ii)</num><content> Professionals working in legal, social service, and health care settings.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cae0b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/1/B/iii"><num value="iii">(iii)</num><content> Nonprofit organizations.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd95cae0c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/1/B/iv"><num value="iv">(iv)</num><content> Faith-based organizations.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd95cae0d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Eligibility</heading><content><p style="-uslm-lc:I12" class="indent1">To be eligible for a grant under paragraph (1), a State Attorney General shall submit an application to the designated State agency at such time, in such manner, and containing such information, as specified by the State.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd95cae0e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Technical assistance and training described</heading><chapeau style="-uslm-lc:I12" class="indent1">For purposes of paragraph (1)(B), technical assistance and training is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cae0f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/3/A"><num value="A">(A)</num><content> the identification of eligible pregnant women experiencing domestic violence, sexual violence, sexual assault, or stalking;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cae10-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/3/B"><num value="B">(B)</num><content> the assessment of the immediate and short-term safety of such a pregnant woman, the evaluation of the impact of the violence or stalking on the pregnant woman’s health, and the assistance of the pregnant woman in developing a plan aimed at preventing further domestic violence, sexual violence, sexual assault, or stalking, as appropriate;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cae11-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/3/C"><num value="C">(C)</num><content> the maintenance of complete medical or forensic records that include the documentation of any examination, treatment given, and referrals made, recording the location and nature of the pregnant woman’s injuries, and the establishment of mechanisms to ensure the privacy and confidentiality of those medical records; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd95cae12-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/3/D"><num value="D">(D)</num><content> the identification and referral of the pregnant woman to appropriate public and private nonprofit entities that provide intervention services, accompaniment, and supportive social services.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd95cae13-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Eligible pregnant woman</heading><content><p style="-uslm-lc:I12" class="indent1">In this subsection, the term “eligible pregnant woman” means any woman who is pregnant on the date on which such woman becomes a victim of domestic violence, sexual violence, sexual assault, or stalking or who was pregnant during the one-year period before such date.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd95cae14-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18203/e"><num value="e" class="bold">(e)</num><heading class="bold"> Public awareness and education</heading><content><p style="-uslm-lc:I11" class="indent0">A State may use amounts received under a grant under <ref href="/us/usc/t42/s18202">section 18202 of this title</ref> to make funding available to increase public awareness and education concerning any services available to pregnant and parenting teens and women under this chapter, or any other resources available to pregnant and parenting women in keeping with the intent and purposes of this chapter. The State shall be responsible for setting guidelines or limits as to how much of funding may be utilized for public awareness and education in any funding award.</p>
