and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idadb17f32-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18311/a/1/C\"><num value=\"C\">(C)</num><content> it is a qualified foreign entity.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadb17f33-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18311/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In this subsection:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadb17f34-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18311/a/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Commercial provider</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “commercial provider” means any person providing human space flight transportation services, primary control of which is held by persons other than the Federal Government, a State or local government, or a foreign government.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadb17f35-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18311/a/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Qualified foreign entity</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “qualified foreign entity” means a foreign entity that is in compliance with all applicable safety standards and is not prohibited from providing space transportation services under other law.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idadb17f36-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18311/a/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> United States commercial provider</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “United States commercial provider” means a commercial provider, organized under the laws of the United States or of a State, that is more than 50 percent owned by United States nationals.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idadb17f37-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18311/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Arrangements with foreign entities</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this subsection shall prevent the Administrator from negotiating or entering into human space flight transportation arrangements with foreign entities to ensure safety of flight and continued ISS operations.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idadb17f38-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s18311/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> United States human space flight capabilities</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Congress reaffirms the policy stated in <ref href=\"/us/usc/t51/s70501/a\">section 70501(a) of title 51</ref>, that the United States shall maintain an uninterrupted capability for human space flight and operations in low-Earth orbit, and beyond, as an essential instrument of national security and of the capacity to ensure continued United States participation and leadership in the exploration and utilization of space.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idadb17f39-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/111/267/tII/s201\">Pub.
