<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idadb17f2d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311"><num value="18311">§ 18311.</num><heading> United States human space flight policy</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadb17f2e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a"><num value="a" class="bold">(a)</num><heading class="bold"> Use of non-United States human space flight transportation services</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idadb17f2f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Federal Government may not acquire human space flight transportation services from a foreign entity unless—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idadb17f30-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a/1/A"><num value="A">(A)</num><content> no United States Government-operated human space flight capability is available;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb17f31-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a/1/B"><num value="B">(B)</num><content> no United States commercial provider is available; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb17f32-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a/1/C"><num value="C">(C)</num><content> it is a qualified foreign entity.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idadb17f33-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idadb17f34-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Commercial provider</heading><content><p style="-uslm-lc:I13" class="indent2">The term “commercial provider” means any person providing human space flight transportation services, primary control of which is held by persons other than the Federal Government, a State or local government, or a foreign government.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idadb17f35-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Qualified foreign entity</heading><content><p style="-uslm-lc:I13" class="indent2">The term “qualified foreign entity” means a foreign entity that is in compliance with all applicable safety standards and is not prohibited from providing space transportation services under other law.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idadb17f36-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> United States commercial provider</heading><content><p style="-uslm-lc:I13" class="indent2">The term “United States commercial provider” means a commercial provider, organized under the laws of the United States or of a State, that is more than 50 percent owned by United States nationals.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idadb17f37-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Arrangements with foreign entities</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this subsection shall prevent the Administrator from negotiating or entering into human space flight transportation arrangements with foreign entities to ensure safety of flight and continued ISS operations.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadb17f38-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18311/b"><num value="b" class="bold">(b)</num><heading class="bold"> United States human space flight capabilities</heading><content><p style="-uslm-lc:I11" class="indent0">Congress reaffirms the policy stated in <ref href="/us/usc/t51/s70501/a">section 70501(a) of title 51</ref>, that the United States shall maintain an uninterrupted capability for human space flight and operations in low-Earth orbit, and beyond, as an essential instrument of national security and of the capacity to ensure continued United States participation and leadership in the exploration and utilization of space.</p>
