<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd976ec79-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442"><num value="18442">§ 18442.</num><heading> Reports on program and cost assessment and control assessment</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd976ec7a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/a"><num value="a" class="bold">(a)</num><heading class="bold"> Findings</heading><chapeau style="-uslm-lc:I11" class="indent0">Congress makes the following findings:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd976ec7b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/a/1"><num value="1">(1)</num><content> The adherence of NASA to program cost and schedule targets and discipline across NASA programs remains a concern.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idd976ec7c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/a/2"><num value="2">(2)</num><content> The James Webb Space Telescope has exceeded its cost estimate.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idd976ec7d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/a/3"><num value="3">(3)</num><content> In 2007 the Government Accountability Office issued a report on NASA’s high risk acquisition performance.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idd976ec7e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/a/4"><num value="4">(4)</num><content> In response, NASA prepared a corrective action plan two years ago.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd976ec7f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/b"><num value="b" class="bold">(b)</num><heading class="bold"> Reports</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd976ec80-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Reports required</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 90 days after <date date="2010-10-11">October 11, 2010</date>, and not later than April 30 of each year thereafter, the Administrator shall submit to the appropriate committees of Congress a report on the implementation during the preceding year for the corrective action plan referred to in subsection (a)(4).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd976ec81-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Elements</heading><chapeau style="-uslm-lc:I12" class="indent1">Each report under this subsection shall set forth, for the year covered by such report, the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd976ec82-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/b/2/A"><num value="A">(A)</num><content> A description of each NASA program that has exceeded its cost baseline by 15 percent or more or is more than 2 years behind its projected development schedule.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd976ec83-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s18442/b/2/B"><num value="B">(B)</num><content> For each program specified under subparagraph (A), a plan for such decrease in scope or requirements, or other measures, to be undertaken to control cost and schedule, including any cost monitoring or corrective actions undertaken pursuant to the National Aeronautics and Space Administration Authorization Act of 2005 (<ref href="/us/pl/109/155">Public Law 109–155</ref>),<ref class="footnoteRef" idref="fn004265">1</ref><note type="footnote" id="fn004265"><num>1</num> See References in Text note below.</note> and the amendments made by that Act.</content>
