<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idadb5eb96-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444"><num value="18444">§ 18444.</num><heading> Counterfeit parts</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadb5eb97-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator shall plan, develop, and implement a program, in coordination with other Federal agencies, to detect, track, catalog, and reduce the number of counterfeit electronic parts in the NASA supply chain.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadb612a8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b"><num value="b" class="bold">(b)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I11" class="indent0">In carrying out the program, the Administrator shall establish—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idadb612a9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/1"><num value="1">(1)</num><chapeau> counterfeit part identification training for all employees that procure, process, distribute, and install electronic parts that will—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612aa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/1/A"><num value="A">(A)</num><content> teach employees how to identify counterfeit parts;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612ab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/1/B"><num value="B">(B)</num><content> educate employees on procedures to follow if they suspect a part is counterfeit;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612ac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/1/C"><num value="C">(C)</num><content> regularly update employees on new threats, identification techniques, and reporting requirements; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612ad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/1/D"><num value="D">(D)</num><content> integrate industry associations, manufacturers, suppliers, and other Federal agencies, as appropriate;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idadb612ae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/2"><num value="2">(2)</num><chapeau> an internal database to track all suspected and confirmed counterfeit electronic parts that will maintain, at a minimum—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612af-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/2/A"><num value="A">(A)</num><content> companies and individuals known and suspected of selling counterfeit parts;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612b0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/2/B"><num value="B">(B)</num><content> parts known and suspected of being counterfeit, including lot and date codes, part numbers, and part images;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612b1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/2/C"><num value="C">(C)</num><content> countries of origin;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/2/D"><num value="D">(D)</num><content> sources of reporting;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/2/E"><num value="E">(E)</num><content> United States Customs seizures; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/2/F"><num value="F">(F)</num><content> Government-Industry Data Exchange Program reports and other public or private sector database notifications; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idadb612b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/b/3"><num value="3">(3)</num><content> a mechanism to report all information on suspected and confirmed counterfeit electronic parts to law enforcement agencies, industry associations, and other databases, and to issue bulletins to industry on counterfeit electronic parts and related counterfeit activity.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadb612b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c"><num value="c" class="bold">(c)</num><heading class="bold"> Review of procurement and acquisition policy</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idadb612b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">In establishing the program, the Administrator shall amend existing acquisition and procurement policy to purchase electronic parts from trusted or approved manufacturers. To determine trusted or approved manufacturers, the Administrator shall establish a list, assessed and adjusted at least annually, and create criteria for manufacturers to meet in order to be placed onto the list.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idadb612b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Criteria</heading><chapeau style="-uslm-lc:I12" class="indent1">The criteria may include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/A"><num value="A">(A)</num><content> authentication or encryption codes;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/B"><num value="B">(B)</num><content> embedded security markings in parts;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/C"><num value="C">(C)</num><content> unique, harder to copy labels and markings;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/D"><num value="D">(D)</num><content> identifying distinct lot and serial codes on external packaging;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/E"><num value="E">(E)</num><content> radio frequency identification embedded into high-value parts;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612be-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/F"><num value="F">(F)</num><content> physical destruction of all defective, damaged, and sub-standard parts that are by-products of the manufacturing process;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612bf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/G"><num value="G">(G)</num><content> testing certifications;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612c0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/H"><num value="H">(H)</num><content> maintenance of procedures for handling any counterfeit parts that slip through;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612c1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/I"><num value="I">(I)</num><content> maintenance of secure facilities to prevent unauthorized access to proprietary information; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idadb612c2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/c/2/J"><num value="J">(J)</num><content> maintenance of product return, buy back, and inventory control practices that limit counterfeiting.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idadb612c3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s18444/d"><num value="d" class="bold">(d)</num><heading class="bold"> Report to Congress</heading><content><p style="-uslm-lc:I11" class="indent0">Within one year after <date date="2010-10-11">October 11, 2010</date>, the Administrator shall report on the progress of implementing this section to the appropriate committees of Congress.</p>
