B, title III, § 10371, Aug. 9, 2022, 136 Stat. 1570.)","seq_in_title":8384,"parent_identifier":"/us/usc/t42/ch163/schIII/ptF","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch163","level":"chapter","num":"CHAPTER 163—","heading":"RESEARCH AND DEVELOPMENT, COMPETITION, AND INNOVATION","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch163/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"NATIONAL SCIENCE FOUNDATION FOR THE FUTURE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch163/schIII/ptF","level":"part","num":"Part F—","heading":"Research Infrastructure","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id1a397511-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081\"><num value=\"19081\">§ 19081.</num><heading> Facility operation and maintenance</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1a397512-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Director shall continue the Facility Operation Transition pilot program for a total of 5 years.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1a397513-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Cost sharing</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Facility Operation Transition program shall provide funding for 10 to 50 percent of the operations and maintenance costs for major research facilities that are within the first five years of operation, where the share is determined based on—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1a397514-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/b/1\"><num value=\"1\">(1)</num><content> the operations and maintenance costs of the major research facility; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1a397515-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/b/2\"><num value=\"2\">(2)</num><content> the capacity of the managing directorate or division to absorb such costs.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1a397516-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Report</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">After the fifth year of the pilot program, the Director shall transmit a report to Congress that includes—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1a397517-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/c/1\"><num value=\"1\">(1)</num><chapeau> an assessment, that includes feedback from the research community, of the effectiveness of the pilot program for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1a397518-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/c/1/A\"><num value=\"A\">(A)</num><content> supporting research directorates and divisions in balancing investments in research grants and funding for the initial operation and maintenance of major facilities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1a397519-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/c/1/B\"><num value=\"B\">(B)</num><content> incentivizing the development of new world-class facilities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1a39751a-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/c/1/C\"><num value=\"C\">(C)</num><content> facilitating interagency and international partnerships;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1a39751b-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/c/1/D\"><num value=\"D\">(D)</num><content> funding core elements of multi-disciplinary facilities; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1a39751c-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/c/1/E\"><num value=\"E\">(E)</num><content> supporting facility divestment costs; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1a399c2d-2957-11ed-8689-d724cb9b8ba1\" identifier=\"/us/usc/t42/s19081/c/2\"><num value=\"2\">(2)</num><content> if deemed effective, a plan for permanent implementation of the pilot program.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id1a399c2e-2957-11ed-8689-d724cb9b8ba1\">(<ref href=\"/us/pl/117/167/dB/tIII/s10371\">Pub.
