<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id572f0c69-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s19403"><num value="19403">§ 19403.</num><heading> Limitation on judicial enforceability of nondisclosure and nondisparagement contract clauses relating to sexual assault disputes and sexual harassment disputes</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id572f0c6a-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s19403/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">With respect to a sexual assault dispute or sexual harassment dispute, no nondisclosure clause or nondisparagement clause agreed to before the dispute arises shall be judicially enforceable in instances in which conduct is alleged to have violated Federal, Tribal, or State law.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id572f0c6b-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s19403/b"><num value="b" class="bold">(b)</num><heading class="bold"> Continued applicability of State law</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this chapter shall prohibit a State or locality from enforcing a provision of State law governing nondisclosure or nondisparagement clauses that is at least as protective of the right of an individual to speak freely, as provided by this chapter.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id572f0c6c-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s19403/c"><num value="c" class="bold">(c)</num><heading class="bold"> Continued applicability of Federal, State, and Tribal law</heading><content><p style="-uslm-lc:I11" class="indent0">This chapter shall not be construed to supersede a provision of Federal, State, or Tribal Law <ref class="footnoteRef" idref="fn004403">1</ref><note type="footnote" id="fn004403"><num>1</num> So in original. <subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id572f0c6d-0975-11f0-9636-eb55e8484e39" identifier="/us/usc/t42/s19403/d"><num value="d" class="bold">(d)</num><heading class="bold"> Protection of trade secrets and proprietary information</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this chapter shall prohibit an employer and an employee from protecting trade secrets or proprietary information.</p>
