<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaa4d6e0b-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a"><num value="1981a">§ 1981a.</num><heading> Damages in cases of intentional discrimination in employment</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa4d6e0c-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Right of recovery</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa4d6e0d-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Civil rights</heading><content><p style="-uslm-lc:I12" class="indent1">In an action brought by a complaining party under section 706 or 717 of the Civil Rights Act of 1964 [<ref href="/us/usc/t42/s2000e–5">42 U.S.C. 2000e–5</ref>, 2000e–16] against a respondent who engaged in unlawful intentional discrimination (not an employment practice that is unlawful because of its disparate impact) prohibited under section 703, 704, or 717 of the Act [<ref href="/us/usc/t42/s2000e–2">42 U.S.C. 2000e–2</ref>, 2000e–3, 2000e–16], and provided that the complaining party cannot recover under <ref href="/us/usc/t42/s1981">section 1981 of this title</ref>, the complaining party may recover compensatory and punitive damages as allowed in subsection (b), in addition to any relief authorized by section 706(g) of the Civil Rights Act of 1964, from the respondent.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa4d6e0e-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Disability</heading><content><p style="-uslm-lc:I12" class="indent1">In an action brought by a complaining party under the powers, remedies, and procedures set forth in section 706 or 717 of the Civil Rights Act of 1964 [<ref href="/us/usc/t42/s2000e–5">42 U.S.C. 2000e–5</ref>, 2000e–16] (as provided in section 107(a) of the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12117/a">42 U.S.C. 12117(a)</ref>), and <ref href="/us/usc/t29/s794a/a/1">section 794a(a)(1) of title 29</ref>, respectively) against a respondent who engaged in unlawful intentional discrimination (not an employment practice that is unlawful because of its disparate impact) under <ref href="/us/usc/t29/s791">section 791 of title 29</ref> and the regulations implementing <ref href="/us/usc/t29/s791">section 791 of title 29</ref>, or who violated the requirements of <ref href="/us/usc/t29/s791">section 791 of title 29</ref> or the regulations implementing <ref href="/us/usc/t29/s791">section 791 of title 29</ref> concerning the provision of a reasonable accommodation, or section 102 of the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12112">42 U.S.C. 12112</ref>), or committed a violation of section 102(b)(5) of the Act, against an individual, the complaining party may recover compensatory and punitive damages as allowed in subsection (b), in addition to any relief authorized by section 706(g) of the Civil Rights Act of 1964, from the respondent.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa4d6e0f-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Reasonable accommodation and good faith effort</heading><content><p style="-uslm-lc:I12" class="indent1">In cases where a discriminatory practice involves the provision of a reasonable accommodation pursuant to section 102(b)(5) of the Americans with Disabilities Act of 1990 [<ref href="/us/usc/t42/s12112/b/5">42 U.S.C. 12112(b)(5)</ref>] or regulations implementing <ref href="/us/usc/t29/s791">section 791 of title 29</ref>, damages may not be awarded under this section where the covered entity demonstrates good faith efforts, in consultation with the person with the disability who has informed the covered entity that accommodation is needed, to identify and make a reasonable accommodation that would provide such individual with an equally effective opportunity and would not cause an undue hardship on the operation of the business.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa4d6e10-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Compensatory and punitive damages</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa4d6e11-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Determination of punitive damages</heading><content><p style="-uslm-lc:I12" class="indent1">A complaining party may recover punitive damages under this section against a respondent (other than a government, government agency or political subdivision) if the complaining party demonstrates that the respondent engaged in a discriminatory practice or discriminatory practices with malice or with reckless indifference to the federally protected rights of an aggrieved individual.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa4d6e12-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exclusions from compensatory damages</heading><content><p style="-uslm-lc:I12" class="indent1">Compensatory damages awarded under this section shall not include backpay, interest on backpay, or any other type of relief authorized under section 706(g) of the Civil Rights Act of 1964 [<ref href="/us/usc/t42/s2000e–5/g">42 U.S.C. 2000e–5(g)</ref>].</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa4d6e13-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitations</heading><chapeau style="-uslm-lc:I12" class="indent1">The sum of the amount of compensatory damages awarded under this section for future pecuniary losses, emotional pain, suffering, inconvenience, mental anguish, loss of enjoyment of life, and other nonpecuniary losses, and the amount of punitive damages awarded under this section, shall not exceed, for each complaining party—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa4d6e14-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/b/3/A"><num value="A">(A)</num><content> in the case of a respondent who has more than 14 and fewer than 101 employees in each of 20 or more calendar weeks in the current or preceding calendar year, $50,000;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa4d6e15-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/b/3/B"><num value="B">(B)</num><content> in the case of a respondent who has more than 100 and fewer than 201 employees in each of 20 or more calendar weeks in the current or preceding calendar year, $100,000; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa4d6e16-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/b/3/C"><num value="C">(C)</num><content> in the case of a respondent who has more than 200 and fewer than 501 employees in each of 20 or more calendar weeks in the current or preceding calendar year, $200,000; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa4d6e17-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/b/3/D"><num value="D">(D)</num><content> in the case of a respondent who has more than 500 employees in each of 20 or more calendar weeks in the current or preceding calendar year, $300,000.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa4d6e18-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Construction</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this section shall be construed to limit the scope of, or the relief available under, <ref href="/us/usc/t42/s1981">section 1981 of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa4d6e19-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Jury trial</heading><chapeau style="-uslm-lc:I11" class="indent0">If a complaining party seeks compensatory or punitive damages under this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaa4d6e1a-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/c/1"><num value="1">(1)</num><content> any party may demand a trial by jury; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa4d6e1b-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/c/2"><num value="2">(2)</num><content> the court shall not inform the jury of the limitations described in subsection (b)(3).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa4d6e1c-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">As used in this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa4d6e1d-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Complaining party</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “complaining party” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa4d6e1e-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/d/1/A"><num value="A">(A)</num><content> in the case of a person seeking to bring an action under subsection (a)(1), the Equal Employment Opportunity Commission, the Attorney General, or a person who may bring an action or proceeding under title VII of the Civil Rights Act of 1964 (<ref href="/us/usc/t42/s2000e">42 U.S.C. 2000e</ref> et seq.); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa4d6e1f-77f4-11ed-9683-e8b0e237229e" identifier="/us/usc/t42/s1981a/d/1/B"><num value="B">(B)</num><content> in the case of a person seeking to bring an action under subsection (a)(2), the Equal Employment Opportunity Commission, the Attorney General, a person who may bring an action or proceeding under <ref href="/us/usc/t29/s794a/a/1">section 794a(a)(1) of title 29</ref>, or a person who may bring an action or proceeding under title I of the Americans with Disabilities Act of 1990 [<ref href="/us/usc/t42/s12111">42 U.S.C. 12111</ref> et seq.].</content>
