and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id424a5ea1-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/1/B\"><num value=\"B\">(B)</num><chapeau> which is—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id424a5ea2-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/1/B/i\"><num value=\"i\">(i)</num><content> for persons who are mentally ill, disabled, or retarded, or chronically ill or handicapped;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id424a5ea3-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/1/B/ii\"><num value=\"ii\">(ii)</num><content> a jail, prison, or other correctional facility;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id424a5ea4-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/1/B/iii\"><num value=\"iii\">(iii)</num><content> a pretrial detention facility;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id424a5ea5-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/1/B/iv\"><num value=\"iv\">(iv)</num><chapeau> for juveniles—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id424a5ea6-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/1/B/iv/I\"><num value=\"I\">(I)</num><content> held awaiting trial;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id424a5ea7-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/1/B/iv/II\"><num value=\"II\">(II)</num><content> residing in such facility or institution for purposes of receiving care or treatment; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id424a5ea8-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/1/B/iv/III\"><num value=\"III\">(III)</num><content> residing for any State purpose in such facility or institution (other than a residential facility providing only elementary or secondary education that is not an institution in which reside juveniles who are adjudicated delinquent, in need of supervision, neglected, placed in State custody, mentally ill or disabled, mentally retarded, or chronically ill or handicapped); or</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id424a5ea9-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/1/B/v\"><num value=\"v\">(v)</num><content> providing skilled nursing, intermediate or long-term care, or custodial or residential care.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id424a5eaa-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/2\"><num value=\"2\">(2)</num><chapeau> Privately owned and operated facilities shall not be deemed “institutions” under this subchapter if—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id424a5eab-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/2/A\"><num value=\"A\">(A)</num><content> the licensing of such facility by the State constitutes the sole nexus between such facility and such State;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id424a5eac-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/2/B\"><num value=\"B\">(B)</num><content> the receipt by such facility, on behalf of persons residing in such facility, of payments under title XVI, XVIII [<ref href=\"/us/usc/t42/s1381\">42 U.S.C. 1381</ref> et seq., 1395 et seq.], or under a State plan approved under title XIX [<ref href=\"/us/usc/t42/s1396\">42 U.S.C. 1396</ref> et seq.], of the Social Security Act, constitutes the sole nexus between such facility and such State; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id424a5ead-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/2/C\"><num value=\"C\">(C)</num><content> the licensing of such facility by the State, and the receipt by such facility, on behalf of persons residing in such facility, of payments under title XVI, XVIII [<ref href=\"/us/usc/t42/s1381\">42 U.S.C. 1381</ref> et seq., 1395 et seq.], or under a State plan approved under title XIX [<ref href=\"/us/usc/t42/s1396\">42 U.S.C. 1396</ref> et seq.], of the Social Security Act, constitutes the sole nexus between such facility and such State;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id424a5eae-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/3\"><num value=\"3\">(3)</num><content> The term “person” means an individual, a trust or estate, a partnership, an association, or a corporation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id424a5eaf-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/4\"><num value=\"4\">(4)</num><content> The term “State” means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, or any of the territories and possessions of the United States;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id424a5eb0-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s1997/5\"><num value=\"5\">(5)</num><content> The term “legislative days” means any calendar day on which either House of Congress is in session.</content>\n</paragraph>\n<sourceCredit id=\"id424a5eb1-3271-11e3-ab2f-8f7fedb88afd\">(<ref href=\"/us/pl/96/247/s2\">Pub.
