L. 103–141, § 2, Nov. 16, 1993, 107 Stat. 1488.)","seq_in_title":2580,"parent_identifier":"/us/usc/t42/ch21B","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch21B","level":"chapter","num":"CHAPTER 21B—","heading":"RELIGIOUS FREEDOM RESTORATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id275e1374-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb\"><num value=\"2000bb\">§ 2000bb.</num><heading> Congressional findings and declaration of purposes</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id275e1375-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Findings</heading><chapeau>The Congress finds that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id275e1376-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb/a/1\"><num value=\"1\">(1)</num><content> the framers of the Constitution, recognizing free exercise of religion as an unalienable right, secured its protection in the First Amendment to the Constitution;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id275e1377-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb/a/2\"><num value=\"2\">(2)</num><content> laws “neutral” toward religion may burden religious exercise as surely as laws intended to interfere with religious exercise;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id275e1378-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb/a/3\"><num value=\"3\">(3)</num><content> governments should not substantially burden religious exercise without compelling justification;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id275e1379-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb/a/4\"><num value=\"4\">(4)</num><content> in Employment Division v. Smith, 494 U.S. 872 (1990) the Supreme Court virtually eliminated the requirement that the government justify burdens on religious exercise imposed by laws neutral toward religion; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id275e137a-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb/a/5\"><num value=\"5\">(5)</num><content> the compelling interest test as set forth in prior Federal court rulings is a workable test for striking sensible balances between religious liberty and competing prior governmental interests.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id275e137b-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Purposes</heading><chapeau>The purposes of this chapter are—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id275e137c-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb/b/1\"><num value=\"1\">(1)</num><content> to restore the compelling interest test as set forth in Sherbert v. Verner, 374 U.S. 398 (1963) and Wisconsin v. Yoder, 406 U.S. 205 (1972) and to guarantee its application in all cases where free exercise of religion is substantially burdened; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id275e137d-4e00-11e3-bfbc-9f3100a4b203\" identifier=\"/us/usc/t42/s2000bb/b/2\"><num value=\"2\">(2)</num><content> to provide a claim or defense to persons whose religious exercise is substantially burdened by government.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id275e137e-4e00-11e3-bfbc-9f3100a4b203\">(<ref href=\"/us/pl/103/141/s2\">Pub.
